Public Hearings: On the 16th day of April 2008 at the hour of 6 o'clock p.m.,or as soon after as possible,and
on the 5th day of May 2008 at the hour of 6 o'clock p.m.,or as soon after as possible,at the Severance Town Hall,

PETITION FOR ANNEXATION TO THE TOWN OF SEVERANCE, COLORADO
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. Seq., Colorado
Revised Statutes, hereby petition the Mayor and Trustees of the Town of Severance, Colorado,
for annexation to the Town of Severance the unincorporated Arritory described herein and
described and shown on the map designated as „OALTorf s kn' ". Copies of said map
are submitted herewith and by this reference are incorporated herein. The description of the
territory hereby petitioned for annexation into the Town is set forth in Exhibit "A" attached hereto
and incorporated herein by reference,
Exhibit A must be an original printed property description on 8-1/2 x 11 inch white paper.
In support of this petition, the petitioner(s) allege(s) that:
1) It is desirable and necessary that the above described territory be annexed to the Town of
Severance, Colorado.
2) The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes
exist or have been met in that:
a) Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the Town of Severance;
b) A community of interest exists between the territory proposed to be annexed
and the Town of Severance;
c) The territory proposed to be annexed is urban or will be urbanized in the near
future;
d) The territory proposed to be annexed is integrated or is capable of being
integrated with the Town of Severance, Colorado.
3) The signatures of the Petition comprise one hundred percent (100%) of the landowners of the
territory to be included in the area proposed to be annexed and said landowners attesting to
the facts and agree that the conditions herein contained will negate the necessity of any
annexation election.
4) No land held in identical ownership, whether consisting of one tract or parcel of real estate or
two or more contiguous tracts or parcels or real estate:
(a) Is divided into separate parts or parcel without the written consent of the
landowner or landowners thereof, except and unless such tracts or parcels
are separated by a dedicated street, road or other public way;
(b) Comprising twenty (20) acres or more and which, together with the buildings
and improvements situated thereon has an assessed value in excess of Two
Hundred Thousand Dollars ($200,000.00) for ad valorem tax purposes for
the year preceding the annexation, is included within the territory proposed
to be annexed without the written consent of the landowner or landowners.
5) Except as otherwise provided, no part of the area proposed to be annexed is more than three
miles from a point on the municipal boundary, as such was established more than one year
before this annexation will become effective.

6) The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a town other than the Town of Severance.
7) The territory to be annexed is not presently a part of any incorporated municipality, town and
county, or town.
8) Petitioner represents that no part of the property to be annexed is included within any site
specific development plan approved by Weld County, Colorado.
9) The territory proposed to be annexed does not include any area that is the same or
substantially the same area in which an election for an annexation to the Town of Severance
was held within the twelve months preceding the filing of this petition.
10) The area proposed to be annexed comprises more than ten acres and an impact report as
provided for in Section 31-12-105.5, CRS will be required.
11) The area to be annexed is located within Weld County, (LIST AT�ALLS

12) The mailing address of each signer, the legal description of the land owned by each signer
and the date of each signature are all shown on this Petition.
13) Accompanying this Petition are the original and all required copies of the annexation map

14) A Concept Master Plan and supporting documents as required under the Concept Master
Plan Checklist within the Town of Severance Annexation Petition submittal requirements.

RESOLUTION NO. 2008-04R
A RESOLUTION FINDING THAT THE PETITION FOR
ANNEXATION OF PROPERTY KNOWN AS THE DALTON'S RUN
ANNEXATION IS IN SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-
12-107(1) AND SETTING A DATE FOR A HEARING BEFORE THE
BOARD OF TRUSTEES OF THE TOWN OF SEVERANCE TO
CONSIDER ANNEXATION OF THE AREA PROPOSED TO BE
ANNEXED.
WHEREAS, the owners of 100% of the property known as the Dalton's Run Annexation
have filed a Petition for Annexation of the hereinafter described property to the Town of Severance,
and;
WHEREAS, the Board of Trustees has determined that the Petition is in substantial
compliance with C.R.S. 31-12-107(1) and that a hearing on such annexation should be scheduled as
provided by Colorado law.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF
THE TOWN OF SEVERANCE,COLORADO AS FOLLOWS:
Section 1. The Board of Trustees hereby accepts the above described petition for
annexation and finds and determines that the petition for annexation of the property described as
Dalton's Run Annexations #1 - #4 and as described in Exhibit"A" attached hereto is in substantial
compliance with the requirements of C.R.S. 31-12-107(1) and Section 30 of Article II of the
Colorado Constitution and desires to initiate annexation proceedings in accordance with law.
Section 2. The Planning Commission will conduct a public hearing on the 16th
day of April at the hour of 6:00 p.m. or as soon after as possible and the Board of Trustees will
conduct a public hearing on the 5th day of May, at the hour of 6:00 p.m. or as soon after as
possible, at the Town Hall, Town of Severance, 231 West Fourth Avenue, Severance,Weld County,
Colorado for the purpose of determining whether the area proposed to be annexed meets the
applicable requirements of C.R.S. 31-12-104 and 105, and to determine whether the area should be
annexed to the Town of Severance.
Section 3. The Town Clerk is hereby directed to publish notice of this hearing once
each week for four weeks in the Greeley Tribune the designated newspaper for the Town of
Severance.

ANNEXATION IMPACT STATEMENT
(PROPOSED) DALTON'S RUN ANNEXATION TO THE TOWN OF SEVERANCE
PUBLIC HEARING DATES: April 16, 2008 and May 5, 2008
Location: 94 acre parcel located in the NW'/ of Section 13, T6N, R67W.
1. Please see the enclosed Vicinity, Land Use Plan, Utility, and Drainage maps.
2. The application materials did not include a draft or final pre-annexation agreement.
3. Municipal Services:
a. Water—North Weld County Water District will provide potable water service
to the proposed development. Acknowledgement of service by will be
required prior to annexation. A non-potable irrigation system will be used to
reduce the amount of potable water required.
b. Sewage Disposal—The Town of Severance is able to provide sanitary sewer
service for the proposed development.
c. Drainage Facilities—Drainage infrastructure, consistent with the Town's
requirements, shall be constructed by the developer.
d. Fire Protection—Windsor-Severance Fire Protection District
e. Police Protection—Town of Severance contracts with the Weld County
Sheriff's Department for full-time police services.
f. School —Weld RE-4 School District.
4. Installation and financing of infrastructure extensions, as well as any applicable
reimbursements for previously oversized infrastructure to serve the subject property
will be the responsibility of the developer.
5. Enclosed with the Petition is a list of districts covering the area to be annexed.
6. A statement from the Weld RE-4 school district will be forthcoming. Based on the
Town's IGA with the School District and conversations with the District, fair-
contribution will be in the form of payment-in-lieu at the effective rate at the time of
building permit. It is projected that 161 homes will be at the single-family rate which
at today's rate would roughly equate to a contribution of$288,872. It shall be
understood that no action will be taken until an ability to serve statement has been
received from the school district.

General Development Information
Planned Urban Growth throughout the Town of Severance, has indicated via the
Comprehensive Plan Map that the proposed "Dalton's Run" subdivision is in the planned
development area. Our proposed subdivision is less than a mile, from the Town of
Severance's plan to construct a primary school with adjacent shopping center named
"The First Street Center" therefore providing substantial support to the proposed school
and shopping center. "Urban Growth" impact is a sensitive issue to many of us, in order
to preserve our natural resources, Snowdance Group works closely with Tiglas
Ecological Services and our engineer/designer Drexel Barrell to ensure our Design
Principles preserve as much land as possible, therefore"Dalton's Run"has an open
space equaling 37% or approximately 35 acres wherein we have incorporated an intricate
trail system, with a statue and meeting areas with benches, two lakes and, a
neighborhood park owned and operated by a homeowners association, allowing all
residents to enjoy the open space within the community. Furthering the feel of rural
living we have designed the patio home area of the subdivision to share driveways (every
two patio homes share one driveway then split at 45degrees to the individual garages),
thus eliminating half of the driveways seen while driving home or walking out to get the
mail, and providing a tree lined corridor presenting full green trees and shrubs. We are
seriously considering shared driveways throughout the entire subdivision to provide it
more of an"open" feeling. The blocks are designed in an unique way, instead of using
the typical grid system for lot and block placement the engineer/designer and Snowdance
Group decided to use the topography of the land to terrace the lots offering many "walk
out homes", winding streets, breathtaking mountain views, and plenty of open space.
Landscaping of the subdivision has been designed by Alpine Gardens of Fort Collins
with shaded areas in mind, on either side of each lot (front and back). The streets are
lined with trees to lessen the visual impact to residents of the community. Two lakes have
been designed for the enjoyment of the resident; the entry lake will contain a fountain to
keep circulation throughout the lake. Also the entry lake will have an entry feature of
sandstone, plants, and lights with the identifying logo of the subdivision. The perimeter
of the entire property will be surrounded by a split rail concrete fence working with the
landscape of trees and shrubs to add buffer from arterial and collector streets to homes as
well as to identify our subdivision from adjacent properties. Snowdance Group has not
finalized a certain style of Architecture, although all home plans will be submitted to an
Architectural Review Committee (ARC) to control the quality and style of the home. We
have a strong mind set towards rock and stucco to be used on the exterior of each
building, although siding of lap and shingles will be looked at and may or may not be
approved by the committee, depending on the style.
