Section 10: NW/4NE/4 and containing 40.00 acres, more or less, together with the rights incident thereto or obtained in connection therewith. For the same consideration, the Assignor covenants with the Assignee(s), its heirs, successors, legal representatives and assigns that the Assignor is the lawful owner of and has good title to the interest herein assigned in and to said Leases, estate, rights and property, free and clear from any liens, encumbrances or adverse claims created by Assignor and has good right and authority to sell and convey the same, that said leases are valid and subsisting leases on the lands therein-described, and that all rentals and royalties due thereunder have been paid, and all conditions necessary to keep said leases in full force and effect have been duly performed.
