Binding Arbitration: You have the right to submit your case to arbitration. If you choose this option the arbitrator's decision is final and your right to appeal your current valuation ends. (Section 39-8-108.5, C.R.S.) Selecting the Arbitrator: In order to pursue arbitration, you must notify the CBOE of your intent. You and the CBOE select an arbitrator from the official list of qualified people. Both you and the CBOE are entitled to participate. The hearings are informal. The arbitrator has the authority to issue subpoenas for witnesses, books, records, documents and other evidence. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. The arbitrator's written decision must be delivered to both parties personally or by registered mail within ten (10) days of the hearing. Such decision is final and not subject to review. Fees and Expenses: The arbitrator's fees and expenses are agreed upon by you and the CBOE. In the case of residential real property, such fees and expenses cannot exceed$150.00 per case. The arbitrator's fees and expenses, not including counsel fees, are to be paid as provided in the decision. Account #R2704603 To Whom It May Concern: DMA is appealing the Assessor's decision of the 2008 real estate assessment for the Owens- Brockway (Owens-Illinois) facility located at 11333 County Road 64 in Windsor, Weld County, Colorado. This recently constructed heavy manufacturing plant totals 527,500 square feet, and is situated on a 74.806-acre parcel of land, identified as Account #R2704603. The 2008 Real Market Value levied by Weld County is $37,039,805, which equates to $70.22/square foot, including land. We have some concerns with this value. Although the property is very useful for Owens' manufacturing purposes, we consider the plant a strategic asset for the company, but lacking in broad market appeal. This is considered a "limited market property", with a very small pool of potential buyers. We examined sales of large industrial manufacturing properties across the United States, which sell for much less per square foot than the subject property's 2008 real estate assessment. We know Weld County has other taxpayers with large industrial properties, and has had to deal with this valuation issue before. Our research included examination of the assessments for such Weld County taxpayers as Eastman Kodak and the three Monfort of Colorado (Swift Foods) plants. Their unit values range from $13.60-$31 per square foot. It is true that these facilities are older than the subject, and we would expect our client's property value to be higher. However, we feel a value of $40-$50 per square foot is more appropriate than the current assessment. Therefore, we are requesting the Real Market Value be adjusted to $26,375,000. Our goal is to work with Weld County informally, to set a reasonable assessment for the Owens- Brockway plant. If the county would like to tour the facility, we would be happy to arrange a visit.
