• Dear Ms. Hatch:
This letter serves as Kerr-McGee Oil and Gas OnShore LP's ("KMG") official response
to the Department of Planning Services' staff recommendations for approval of USR-1666 and
provides written evidence that the following requirements have been or will be met prior to
recording the plat.
1. Prior to recording the plat:
A. The Mountain View Fire Protection District has reviewed and approved the Fire
and Emergency Response Plan submitted to the District by KMG and has no
objection to the drilling of the wells referenced above. KMG will comply with all
applicable codes and standards mentioned in the Fire Protection District's referral
letter dated June 20, 2008.
B. Lauren Light of Weld County Environmental Health submitted a Memorandum
noting three recommendations regarding KMG's USR 1666 specific to Air
Pollution Emissions Notice, Dust Abatement, and Development Standards.
i. An Air Pollution Emissions Notice (APEN) may be required to be filed
with the Colorado Department of Public Health and Environment. Kerr-
McGee will submit the APEN in a timely manner and a copy will be
• forwarded to you at that time.

• ii. The following development standards will be added as a part of KMG's
permit application, if not already stated in the body of the original
application:
1) All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored
and removed for final disposal in a manner that protects against surface
and ground water contamination.
2) No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the definition
of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-
20-100.5, C.R.S., as amended.
3) Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions.
4) Fugitive dust and fugitive particulate emissions shall be controlled on
this site. The facility shall be operated in accordance with the approved
dust abatement plan at all times.
5) The operation shall comply with all applicable state noise statutes
and/or regulations.
6) Adequate toilet facilities (port-a-potty) shall be provided during
drilling/construction.
7) Bottled water shall be utilized for drinking and hand washing during
drilling/construction.
• 8) If applicable, the applicant shall obtain a stormwater discharge permit
from the Colorado Department of Public Health and Environment, Water
Quality Control Division.
9) The operation shall comply with all applicable rules and regulations of
the State and Federal agencies and the Weld County Code.
C. The Town of Frederick's recommendation to install fencing to meet the Town's
requirements was taken under advisement. Given that the property in question has
not yet been annexed into the Town of Frederick KMG will comply with the
fencing guidelines established by Weld County.
D. CDOT Region 4 Traffic Section has reviewed the application and noted that traffic
control may be necessary to move equipment in and out of the site on SH 119.
KMG will monitor traffic flow on SH 119 during drilling operations and take
measures as necessary.
E. Frank Piacentino, with the Weld County Building Inspection Dept, submitted a
Memorandum noting the following recommendations
i. A building permit shall be obtained prior to the change of use or
construction of new structures. KMG has obtained all necessary building
permits.
ii. Plans have been submitted to the Mountain View Fire District for their
• review and approval.

F. Clay Kimmi, P.E., Weld County Public Works had the following recommendations:
i. The Applicant shall provide a paved tracking control pad at the entrance
location that extends from WCR 7.5 a minimum of 100 feet down the
access road. At the end of the pavement, the applicant shall install two
cattle guards back to back. KMG will install a tracking pad at the entrance
of the access road off of WCR 7.5 and two cattle guards back to back at
the end of the pavement.
ii. All Right-of-Ways and Easements shall be graded for appropriate drainage
according to KMG's Best Management Practices providing for all weather
access.
iii. Access roads will be shown on the plat as 30ft easements.
iv. KMG will adhere to all Colorado Dept. of Public Health and
Environment's rules and regulations in regards to stormwater discharge.
The Colorado Department of Public Health and Environment, under the
Colorado Discharge Permit System has issued to KMG a Stormwater Field
Permit that includes the Wells, individual permits are not required for each
site. A copy of the Discharge Permit No. COR-030000 is included in this
Section. The site will be incorporated into KMG's Stormwater
Management Plan as required by the CDPHE
In accordance with the guidelines of the Environmental Protection Agency,
KMG will abide by the Spill Prevention, Control and Countermeasure
Plan (SPCC). A copy of the basic SPCC Plan is included in this Section.
v. Weld County permits will be obtained for any oversized vehicles requiring
such permit.
vi. KMG has previously submitted a Flood Hazard Development plan and
subsequently received approval from Weld County Public Works
department on August 12, 2008. KMG will anchor oil and gas wells as
required by WCC Section 23-5 and 23-5-360-N.
vii. As requested KMG will install 5 rail open fencing rather then the standard
6' chain link.
G. Larry Rogstad, Area Wildlife Manager for the State of Colorado Division of
Wildlife submitted a letter of response recommending the site be surveyed for the
presence of the Preble's Jumping Mouse. KMG, through a third party contractor,
inspected the site and found it absent of riparian vegetation as wells dry and
disturbed due to gravel pit operations and over grazing by prairie dogs. The
surrounding ponds in the open space parcel do not contain PMJM habitat.
Throughout the operation KMG will employ best business practices in order to
minimize the impact on the wildlife in the vicinity.
2. Upon completion of 1. above, KMG will submit a Mylar plat with all other
documentation required as Conditions of Approval. The Mylar will be prepared in
accordance with the requirements of Section 23-3-260.D of the Weld County Code and
will be recorded in the office of the Weld County Clerk and Recorder by the Department
• of Planning Services' staff. KMG will submit the Mylar plat and additional requirements

• as soon as possible from the date of the Board of County Commissioners resolution.
KMG will pay the recording fee.
3. Per its letter dated July 21, 2008, KMG received an early release, and or waiver of any
requisite building permits from the Weld County Building Department in order that KMG
could proceed with the drilling of the subject Milky Way wells outside the final
resolution of the USR process. KMG agrees to complete the USR approval process and
conduct its future operations in accordance with the final Development Standards per the
USR-1666 Resolution crafted by the County Board of Commissioners.

2.1 DESCRIPTION OF INTENDED USE
Kerr-McGee Oil & Gas OnShore LP (KMG), an Anadarko Company, intends to use an existing oil
and gas operations area located in Township 2 North, Range 68 West, 6th P.M., Section 10:
NE/4NW/4 (WDCI-Open Space Western Dairymen Cooperative Inc PUD) to drill three oil and gas
wells. These wells will be known as the Milky Way 3-10, Milky Way 18-10 and Milky Way 21-10
(the Wells). The purpose is to produce hydrocarbons from underlying formations known to have
commercial potential for the production of such substances. The proposed Milky Way 18-10 will
twin the existing HSR-Carlson 6-10 well.
2.2 SITE IMPROVEMENTS
KMG will construct a temporary drill site of approximately three acres within the designated Oil and
Gas Operations Area for drilling the Wells to sufficient depths and adequately test the
Codell/Niobrara and J Sand formations as follows:

• After the Wells have been drilled to their total depths and completed and are capable of production
or plugged and abandoned as a dry hole(s), KMG will reclaim the drill site in accordance with the
applicable rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC).
If the Wells are completed as producers, each well head will consist of well head valving standing
approximately 4'-5' tall and will encompass a fenced, gated and locked area approximately twelve
(12)feet by twelve(12) feet each. The fences will be 6' tall, chain-link with three-strand barbed wire
around the top. Flow lines will be laid to connect these wells to proposed production facilities within
the existing HSR Carlson 6-10 production facilities area located approximately 100' west of the
Milky Way 3-10 well head in the NE/4NW/4 of Section 10, Township 2 North, Range 68West, 6th
P.M.
2.3 CHARACTERISTICS OF INSTALLATION
The Wells will each have a wellhead assembly installed on site. Production facilities and related
equipment will be placed within the Oil and Gas Operations Area. (See QUESTIONNAIRE— 3.5.4
for further details.)
2.4 CHARACTERISTICS OF DRILLING AND COMPLETION OPERATIONS
KMG management will utilize authorized employees and professional contractors to conduct the
drilling and completion operations on site. The actual drilling phase is approximately six(6)to eight
(8) days per well, under normal circumstances. Drilling will be continuous, 24 hours a day, for this
six to eight day period. Completion operations will be performed on each well following the drilling
• phase. The production facilities will be installed and the wells put on-line. The surface will be re-
graded to its prior condition as nearly as practicable. The entire process from building location to

reclamation takes approximately 60-90 days per pad. Steps will be taken to mitigate noise due to
drilling operations to the best of KMG's ability.
2.5 STATEMENT REGARDING MOTORS, PUMPS, ETC. TO BE USED
These well locations will have only wellheads installed on site. There will not be any associated
pumps or motors.
2.6 RELATIVE PLANS
• Noise: KMG will meet all applicable noise requirements set forth by COGCC regulations
during operations. Exhaust from all engines, motors and related equipment, shall be vented
in a direction away from occupied buildings where practical.
• Vibration: KMG will meet all applicable vibration requirements set forth by COGCC
regulations during operations. There is not any unusual vibration anticipated from the
proposed operation.
• Air and Water Quality: All requirements set forth in applicable COGCC regulations
regarding Air and Water Quality will be met by KMG in its' operations. KMG will comply
with the Colorado Department of Public Health and Environment regulations by filing an Air
Pollution Emissions Notice (A.P.E.N.) and any other additional required application data, if
production volumes exceed required thresholds, and will install emissions control devices as
warranted to obtain required reductions of ozone precursors. (Included at Section 2.7 is
correspondence from Korby Bracken, P.E., KMG Staff Environmental Analyst regarding the
A.P.E.N. requirements.) The COGCC sets forth specific requirements for casing depth in
order to protect ground water sources. Produced water will be hauled away and properly
• disposed of in accordance with COGCC regulations.
• Odor: KMG will meet all applicable odor requirements set forth by COGCC regulations
during operations. There is not any noxious, prolonged or unusually high amounts of odor
expected from the proposed operation.
• Visual Impacts: KMG will meet all applicable visual impact requirements set forth by
COGCC regulations during operations. The permanent facilities will be painted in
accordance with COGCC regulations and in a manner to harmoniously blend with the
surrounding environment. The site will be reclaimed to as near the original grades as
practicable.
• Wildlife Impacts: KMG will meet all applicable wildlife impact requirements set forth by
COGCC regulations during operations. There is not any significant impact of wildlife
expected. An outside Environmental consulting group has performed a site inspection and
has cleared this location for any wildlife issues.
• Environmental Impacts: An outside Environmental consulting group has performed a site
inspection and has cleared the proposed well locations for any environmental issues.
• Flood Plain: The oil and gas operations area is located in the 100-Year Flood Boundary and
as such a Flood Plain Hazard Permit will be obtained from Weld County. All equipment at
the drilling and production sites in the floodplain area will be anchored to the extent
necessary to resist floatation, collapse, lateral movement or subsidence per COGCC Rule
603 (k.).
• Waste: Please refer to section above, 1.6—Disposal Methods Statement.
• • Public Safety: The completed wellsites will be surrounded with a 6' chain-link fence and
gate with adequate lock. The completed wellsites will be monitored regularly by KMG

personnel. KMG personnel or authorized representatives shall be on-site during drilling and
• completion operations. A complete Emergency Response Plan will be prepared and
reviewed by the local Fire Authority for its review and approval. A copy of the approval will
be submitted to Weld County upon receipt.
• Access Roads: KMG will utilize the existing lease access road from SH 119/WCR 24 and
WCR 7.5. The dirt access road to the wellsites will be constructed to accommodate
emergency vehicles. The road shall be properly graded and culverts shall be utilized where
necessary.
• Dust Abatement and Noxious Weeds: All locations, including wells and surface production
facilities, will be kept free of weeds; rubbish, and other waste material. During drilling,
production, and reclamation operations, all disturbed areas shall be kept reasonably free of
noxious weeds and undesirable species as practicable. The temporary soil stockpiles will be
covered with hydro mulch to hinder weed growth and prevent wind erosion before they are
reclaimed into the site. When a well is completed for production, all disturbed areas no
longer needed will be restored and revegetated as soon as practicable. The area shall be
treated if necessary and practicable to prevent invasion of undesirable species and noxious
weeds. In early spring a contractor applies a liquid, annual, pre-emergent herbicide inside the
production facility and well site fence. Any weeds that come up after this will be sprayed
with a 2-4-D type weed-killer. Any weeds that escape these treatments will be cut
mechanically with a mower or line trimmer in mid or late summer. The access roads will be
treated with herbicide as necessary and be mowed with a rotary mower in mid or late
summer where necessary. During drilling, production, and reclamation operations, all access
roads and disturbed areas will be subject to Dust Abatement procedures, which are a part of
KMG's Best Management Practices. The dust prone areas will be treated with water or
magnesium chloride on an as need basis.

Dear Ms. Light:
Kerr-McGee is herein submitting Air Pollution Emission Notice (APEN) requirements to the
• Department for oil and gas facilities operating in Colorado. This information applies to all wells
proposed in the State.
Colorado Department of Public Health and Environment (CDPHE), Air Quality Control Commission
Regulation Number 3 "Stationary Source Permitting and Air Pollutant Emission Notice Requirements"
is the regulation used for permitting oversight. Part II of the regulation outlines the requirements a
public entity must follow when submitting an APEN. The paragraph between part II.D.1.111 and Part
II.D.1.mmm states:
"...if production will result in reportable emissions, the owner or operator shall file an Air
Pollutant Emission Notice with the division within thirty days after the report of first production
is filed with the appropriate state or federal agency but no later than ninety days following the
first day of production. "
Due to unknown production rates and system control requirements, Kerr-McGee can not submit APENs
prior to well completion so production rates can be established. Should your Department require copies
of APENs for the Milky Way wells we will send copies once they are submitted.

3.1 EXPLAIN, IN DETAIL, THE PROPOSED USE OF THE PROPERTY
Three natural gas wells will be drilled on the subject property, the Milky Way 3-10 is a straighthole
and the Milky Way 18-10 and 21-10 are directional well bores. The oil, water and natural gas
produced from the Wells will be separated on the property. The oil and water will be temporarily
stored in tanks on the property until it can be removed from the property by trucks. The natural gas
will be metered onsite and transported off the property through an existing natural gas gathering
pipeline.
3.2 EXPLAIN HOW THIS PROPOSAL IS CONSISTENT WITH THE INTENT OF THE WELD COUNTY
COMPREHENSIVE PLAN.
The Weld County Comprehensive Plan recognizes that "oil and gas development in the County is an
integral part of the County economy, and has a substantial direct and indirect impact on current and
future land use". ICMG has entered into a Surface Use Agreement with the surface owner, Milky
Way Owners Association Inc on August 17, 2001, recorded on October 22, 2001 at Reception No.
2893758 in the records of Weld County, Colorado (For copy, see Property Ownership Documents—
5. 4). The surface locations of the wells have been agreed to by the surface owner. KMG will
follow all state and county regulations and conduct its operations as a prudent operator.
3.3 EXPLAIN HOW THIS PROPOSAL IS CONSISTENT WITH THE INTENT OF THE WELD COUNTY
CODE, CHAPTER 23 (ZONING)AND THE ZONE DISTRICT IN WHICH IT IS LOCATED.
In this case, KMG's proposed surface locations of the wells are in a dry land location. Compatibility
• with existing and proposed uses is assured because KMG has entered into a comprehensive surface
use agreement with the surface owner and future developer of the site. Currently there are not any
productive agricultural lands or residential areas that will be impacted.
3.4 WHAT TYPES OF USES SURROUND THIS SITE? EXPLAIN HOW THE PROPOSED USE IS
CONSISTENT AND COMPATIBLE WITH SURROUNDING LAND USES.
The proposed wells will be located within an area designated as Open Space in the Western
Dairymen Cooperative Inc PUD. There are no current improvements in the Open Space. The
adjacent properties consist of dry land pasture, commercially zoned lots and undeveloped
residentially zoned areas. The residential development known as Idaho Creek is approximately
1,100' to the southeast of the oil and gas operations area. There are currently no structures within a
200' foot radius of any of the proposed well heads. Since there are an existing oil and gas well and
production facilities in place, it is a preferred location to directionally drill the proposed wells in
order to minimize surface impact in the vicinity.
3.5 DESCRIBE, IN DETAIL, THE FOLLOWING:
3.5.1 How many people will use this site?
During the drilling of the wells there may be as many as 15 individuals on-site. The drilling and
completion phase, for the subject wells, will take approximately 30 days. It is anticipated that the
subject wells will be drilled consecutively. Once the wells have been drilled and completed and the
production facilities built, it is anticipated that one individual will visit the site on a daily basis.

3.5.2 How many employees are proposed to be employed at this site?
• There will be no employees permanently stationed at the well site. A `lease operator' will visit the
site on a daily basis to take measurements and perform any needed maintenance.
3.5.3 What are the hours of operation?
The wells and production facility will affectively operated 24 hours a day.
3.5.4 What type and how may structures will be erected (built)on this site?
During the drilling phase there will be a drilling rig approximately 140'-150'feet tall. After the wells
have been drilled,there will be three wellheads consisting of valving that stands about 4-5 feet above
ground level. There will be a fenced, gated and locked production facilities area, consisting of two
oil tanks and one water tank and a fenced, gated and locked area encompassing the separators housed
in a quad-unit and a meter house.
3.5.5 What type and how many animals, if any, will be on site?
None.
What kind (type, size, weight) of vehicles will access this site and how often? During the initial
drilling phase, trucks will move the drilling rig in 16-20 loads and the total weight of the rig is
125,000 pounds. During the 75-90 day period of drilling and completion there will be ongoing
heavy duty vehicle traffic with trucks weighing up to 40,000 pounds. Once drilling and completion
of the wells has concluded,there will be a one-half ton pickup on the property daily.
3.5.6 Who will provide fire protect to this site?
• Mountain View Fire Protection District. Under separate cover letter, KMG will prepare and submit
an Emergency Response and Fire Prevention Plan to Mountain View Fire Protection District for its
approval. A copy of the signed approval letter will be forwarded to Weld County Planning upon
receipt.
What is the water source on the property (both domestic and irrigation)? Any needed water
during the drilling and completion phase will be brought in to the site. During the producing phase
Kerr-McGee will not need a water source. Bottled water will be utilized for drinking and hand
washing.
What is the sewage disposal system on the property (existing and proposed)? There will be no
need for a permanent sewage disposal system. During the drilling and completion phase a portable
toilet facility will be on-site.
If storage or warehousing is proposed,what type of items will be stored? The production facility
will house a water tank with capacity to hold 100-210 bbls, and 2 oil storage tanks with capacity to
hold 300 bbl each.
3.6 EXPLAIN THE PROPOSED LANDSCAPING FOR THE SITE. THE LANDSCAPING SHALL BE
SEPARATELY SUBMITTED AS A LANDSCAPE PLAN MAP AS PART OF THE APPLICATION
SUBMITTAL.
KMG plans no landscaping around the wellheads or the production facilities. Within the fenced
Operations area, the immediate area around the wellheads, production facilities and separators will
• be covered by road base. A metal fire-wall berm will be installed around the tanks.

3.7 EXPLAIN ANY PROPOSED RECLAMATION PROCEDURES WHEN TERMINATION OF THE USE
• BY SPECIAL REVIEW ACTIVITY OCCURS.
Once the wells have been drilled, Kerr-McGee will reclaim the disturbed land to its original
condition, as reasonably practicable. Once the wells have stopped producing, Kerr-McGee will plug
and abandon the wells, and reclaim the land in accordance with Colorado Oil and Gas Conservation
Commission rules and regulations.
3.8 EXPLAIN HOW THE STORM WATER DRAINAGE WILL BE HANDLED ON THE SITE.
KMG will adhere to all Colorado Dept. of Public Health and Environment's rules and regulations in
regards to stormwater discharge. The Colorado Department of Public Health and Environment, under
the Colorado Discharge Permit System has issued to KMG a Stormwater Field Permit that includes
the Wells, individual permits are not required for each site. A copy of the Discharge Permit No.
COR-030000 is included in this Section. The site will be incorporated into KMG's Stormwater
Management Plan as required by the CDPHE
In accordance with the guidelines of the Environmental Protection Agency, KMG will abide by the
Spill Prevention, Control and Countermeasure Plan (SPCC). A copy of the basic SPCC Plan is
included in this Section.
3.9 EXPLAIN HOW LONG IT WILL TAKE TO CONSTRUCT THIS SITE AND WHEN CONSTRUCTION
AND LANDSCAPING IS SCHEDULED TO BEGIN.
Kerr-McGee's intention is to drill each well in consecutive order. Once drilling begins, it will take
about 75-90 days to complete the drilling, completion and reclamation process. It is anticipated that
Kerr-McGee will commence drilling operations within 3 months of approval of the USR application.
• 3.10 EXPLAIN WHERE STORAGE AND/OR STOCKPILE OF WASTES WILL OCCUR ON THIS SITE.
No wastes will be stored and/or stockpiled on this site. Drilling mud will be removed and spread on
lands designated for this purpose and produced water will be disposed of off site in a manner
approved by the Colorado Oil and Gas Conservation Commission Rules and Regulations.
A commercial size trash bin will be located on site for use by all parties affiliated with the operations
for removing debris. Human waste will be properly handled by portable sanitary facilities that are
located on site and provided and maintained by Reliable Services,Inc.

2.04 Description of Facility Operations
2.04.a Unit Description and Typical Configuration
The facility(ies) operated by Kerr-McGee provides field separation of oil or condensate and water from
well(s) located in the area. Production equipment separates the fluids and the fluids are stored in
tank(s) until removal for sale or disposal. Individual tanks and production equipment at the facility are
described in the following subsections. Oil and water are removed as described in Section 2,04.c.
Fluids are moved within the facility as described in section 2.04.d. Site specific information is
contained in the last section of this document.

• 55-Gallon drums and small bulk storage containers for lube oils and chemicals maybe present on
a temporary basis at the facility. These containers are normally located at either well sites or at the
tank battery. These storage containers are small and internal corrosion poses minimal risk of failure.
They are inspected monthly and are normally placed on some type of rack where all sides are visible.
55 gallon drums without secondary containment at tank battery will be placed inside the berm area of
the tank battery or process equipment area. The service condition of the containers will be determined
by:
1. Content identification on drums
2. No corrosion
3. No dents
Other Equipment:
Process equipment utilized, standards of construction, and containment provisions
2.04.b Hours of Operation
This processing and storage facility receives, processes, and stores production 24 hours a
day, 365 days a year. The facility is not manned but an Operator inspects the facility on a
regular schedule.
2.04.c Transfer Facilities and Operations
Oil production is removed from the facility by truck or pipeline. Load line containment is
provided to catch any drips or spills from the transfer hose during any truck transfer
operations. Warning signs, wheel chocks, or vehicle break interlock system will be used to
prevent vehicles from departing before the complete disconnection of oil transfer lines. Prior
to filling and departure of any tank truck, drain valves should be inspected to ensure they are
• secure.
2.04.d Flowlines
Flowlines from the wells to the facility and other associated lines are commonly steel and/or
poly pipe. Typically, none of the lines have catholic protection but corrosion inhibitor is utilized,
where necessary, to prevent corrosion. Flowline rights of ways are checked for leaks and
lines are repaired or replaced as necessary.
2.04.e Areas of potential spills
Note: The following are examples only and the issues at the site would be addressed on an
individual site basis.
1. Tank Battery
Failure Modes: Leak from tank due to corrosion; hole in tank wall or floor from equipment
operating around tanks; lightning striking tank resulting in explosion with spillage and/or
fire; leaks from valve at load lines; vandalism; and overflow of tanks.
Rate of Flow: Variable, depending upon the type, size and location of the tank failure. The
ambient temperature at the time of the release may affect the viscosity of the oil and
thereby impact the rate of flow. Flow rates resulting from corrosion failure are typically low,
ranging from less than a gallon per day to a gallon per hour. Potential flow rates resulting
from valve and piping failures or vandalism may range from a gallon per hour to 400 bbls
per hour. Lightning strikes may result in a release that is essentially instantaneous.

Discharge Quantity: Variable depending upon the type and location of the failure. The total
quantity discharged would not exceed the working capacity of the largest tank.
Preventative Measures: Storage tanks are constructed in accordance with API industry
standards. Materials used in constructing the tanks are compatible with the substances

and buried flowline right-of-ways to detect failures. As warranted by soil conditions, corrosion
protection is provided for buried pipelines.
3. Process Vessel
Failure Modes: Leaks from corrosion or at valves and connections, or pressure vessel
rupture. If pressure relief valves dump to a flare or vent this would be included.
Rate of Flow: Variable, depending upon the mode and extent of the failure. The maximum
expected rate of flow from a process unit failure is the oil production rate of the well plus
any additional fluid volume contained in the vessel above the elevation of the event.
Discharge Quantity: Variable, depending on the type of failure and the length of time that the
failure went undetected.
Preventative Measures: Process units are constructed in accordance with API and ASME
industry standards. Where practicable, earthen berms or other diversionary structures are
utilized to control any released fluids.
4. Wellhead— Leaks at stuffing box, valves, and connections.
Rate of Flow: Variable, depending on the size and location of the failure. The maximum
potential rate of flow is not expected to exceed the well production rate.
Discharge Quantity: Variable depending upon the type and extent of the failure and the length

1. Cars and pickup trucks equipped with mobile telephones are available for transportation and
communications.
2. Pickups are equipped with shovels and hand tools for use in minor spills. Hazard tape is
available to identify exclusion areas. Pickups are also equipped with fire extinguishers.
3. An inventory of absorbent pads and blankets are not maintained onsite but they are available
at the location(s)shown in the Onshore Emergency Management Plan.

2.09 Plan Review and Amendments
In accordance with 40 CFR 112.5(b), a review and evaluation of this SPCC plan is conducted at least
once every five years. Documentation of the reviews is recorded on Record of Plan Amendments and
Periodic Review log contained on page iv of this plan. As a result of this review and evaluation, Kerr
McGee Rocky Mountain Corporation will amend the plan to include more effective spill prevention
and control technology if:
1) Such technology will significantly reduce the likelihood of a spill event from the facilities, and
2) If such technology has been field-proven at the time of the review.

• 3.0 RESPONSE PLAN
3.01 Planned Response Action/Emergency Action Checklist
This alert procedure becomes effective immediately upon the observance of or hearing of an oil spill
from any company facilities. Any employee observing or receiving knowledge of an oil spill must
immediately take actions to minimize injuries and damage and notify the designated person. All steps
should be taken in accordance with good safety practices. The priority in all circumstances will be to
protect life. The first ten action steps will be as follows.
3.01.a Emergency Action Checklist:
Step One: Evaluate situation for personnel safety hazards. Provide safe rescue of
personnel and provide first aid as required.
Step Two: Shut down the operation in progress following pre-established procedures to
prevent further damage. Obtain positive product identification. Shut down
should consist of shutting in well(s) at master valve.
Step Three: Conduct investigation to determine the source, utilizing appropriate personnel
protection equipment.
Step Four Activate Emergency Response Plan,
Step Five: Secure the source or minimize the potential discharge by transferring or
isolating product.
Step Six: Conduct containment activities, as appropriate, to minimize the spread of oil.
Step Seven: Contact facility person in charge. Transmit the information as shown below.
Step Eight: Simultaneously with other activities, contact emergency response officials
(Federal, State, and Local) as necessary.
Step Nine: Contact previously identified entities that could be impacted by the spill.
Step Ten: Begin preparation for product recovery and remediation activities.
3.02.b Internal Alert Procedures

3.01.c External Alert Procedures

3.01d Spill Management Team

3.02 Plans for Sampling,Testing,and Measuring the Volume of Substances Discharged
Delineation of the impacted area will follow guidelines established by the Regulatory Authority.
The impacted area will be delineated vertically and horizontally. A shovel, hand auger, backhoe or
other means will be used to determine the depth of impact.
Soil samples should be taken over the impacted area to estimate the volume (yd3)of soil impacted
with greater than one (1)weight percent TPH. The number of samples taken will depend on the area
of the spill. Samples will also be taken outside the impacted area and downgradient from the impact
to monitor movement outside the impacted area.

• 3.03 For the Recovery, Storage,Separation,Transportation,and Disposal of Waste
Vacuum trucks will remove accumulated liquids and return the liquids to the production system for
recycling and recovery of any oil or will haul the liquids to an approved disposal facility. Only carriers
who are in compliance with federal, state, and local regulations will be utilized to transport liquids. The
liquids will be hauled to sites that are also in compliance with federal, state, and local regulations.
Manifests(run tickets)will be obtained on the liquids hauled. This manifest must include the following
information:
1. Wellsite or facility source of fluids.
2. Name and address of transporter.
3. Volume, in barrels, of fluids hauled.
4. Disposal point identification by name, location, and current state regulatory disposal
number.
5. Disposal point National Pollutant Discharge Elimination System number, if applicable.
Soil remediation will follow state guidelines. In the absence of specific guidelines, areas over one (1)
percent TPH will be remediated using natural material or enhanced bioremediation. Impact deeper
than eighteen inches (18")will be excavated and placed so as to obtain a treatment area that is no
greater than eighteen inches (18") in depth and that contains no more than five(5)weight percent or
less TPH. The soil to be bioremediated may be mixed with ambient or other soil to achieve a uniform
mixture that contains no more than five (5)weight percent TPH.
If possible, keep recovery material such as absorbent pads, booms and other clean-up material apart
from natural materials such as grass, tree limbs or soil.
3.04 Probable Direction and Rate of Flow for Unauthorized Discharges
The direction of flow from the facility will be as described in Section 2.04.a.
3.05 Plans for Protection of Environmentally Sensitive Areas
Berms will be constructed between the site and any navigable water or sensitive area to prevent
migration overland to that area. If oil gets to navigable water, booms will be utilized to prevent
migration.
3.06 Response for Areas of Potential Spill
The following directions are to be used in conjunction with the response outlined in Emergency Action
Checklist(3.01.a).

4.0 DISCHARGE PREVENTION PLAN
Tank berms are constructed around the storage tanks to contain spills, overflows, or releases through rupture
of the tank. A description of the berm construction for the storage tanks and the other type confinement that
may be utilized is provided in Section 2.04.
Close surveillance will be maintained during periods of oil transfer to prevent spills from occurring. Drip
containment will be utilized at load lines to prevent drainage from lines or connections during hook up of lines.
In order to reduce the likelihood of a spill occurring due to a mechanical failure or as the result of corrosion or
other failure resulting in a spill, inspections will be conducted on a regular basis. Monthly, the attached written
inspection review will be conducted. The inspector will note any problems observed and sign the inspection
form. This form will be maintained with the SPCC plan for a period of three(3)years.
4.01 Inspections Procedures:
4.01.a Frequency of Inspections
The Operator will inspect the production equipment in his area each month in accordance with
the attached Monthly SPCC Inspection Checklist.
Supervisory personnel will inspect the production equipment at least annually and complete
the attached "Annual Inspection Checklist".
Each scheduled inspection will be signed and a copy submitted to the EHS staff for any
necessary discussion and filing. The original will be maintained in the SPCC plan for three(3)
years.
4.01.b Record Keeping
Inspections will be recorded. Records will show date, time, maintenance if needed, and
general condition. Record of inspection will have signature of inspector.
4.01.c Inspection Guidelines
The following check list is to be considered as a minimum inspection. Note condition of any
piece of equipment, storage tank or drum, and other items that could lead to a spill or
adversely effect the operations or safety of the facility,

4.02 Drainage of Rainwater from Facility •

5.0 DISCHARGE PREVENTION AND RESPONSE TRAINING PROGRAM
Personnel will be instructed in the operation and maintenance of equipment used at this facility to prevent
discharges of oil and in applicable pollution control laws, rules, and regulations. Training exercises will be
conducted for all personnel, and training will be given to new employees.
5.01 Spill Prevention Briefings
Spill prevention briefings will be conducted annually to assure adequate understanding of the SPCC
Plan. These briefings will include discussions of:
1. Known spill events or failures
2. Malfunctioning components
3. Recently developed precautionary measures
5.02 Additional Instruction
Instruction will also be given in:

2. Operation and maintenance of equipment to prevent oil discharges

• 6.0 WRITTEN INSTRUCTION FOR CONTRACTORS:
Written instructions discussing duties and obligations to prevent pollution are prepared for contractors
servicing a well or systems appurtenant to a well or pressure vessels are outlined below. These instructions
will be made available to contractors conducting work at the facility.
6.01 Oil Drilling and Workover SPCC Plan
All drilling and workover contractors operating on company leases must have a written SPCC plan for
their operations as required by 40 CFR 112.3(c). The contractor's plan must be implemented before
operations are initiated. At a minimum, the SPCC plan must comply with the general requirements of
40 CFR 112.7 and the following:
•
1. Blowout preventer(BOP)assembly and well control system will be installed before drilling below
any casing string. When working over a well, a BOP and well control system will be used when
required.
2. BOP will be capable of controlling any expected pressures and will be tested.
3. Casing and BOP installations will conform to state regulations.
4. Drip pans and other devices will be used to prevent ground pollution.
5. Tanks and pits will be properly inspected and maintained to prevent leakage.
6. Contractor is responsible for keeping area and equipment in good order and is to be held
responsible for same.
7. In the event of a spill of effluent substances, the contractor shall notify company personnel
immediately so that control and cleanup operations may be put into effect.
8. A company representative shall be present at times when abnormal conditions are encountered or
expected to assist contractor in maintaining control of well.
6.02 SPCC Plan Instructions for Contractors
The area in which operations will be conducted is in compliance with current EPA SPCC Regulations.
It shall be the contractor's responsibility to properly instruct their personnel as to their obligation to
prevent any pollution. These instructions shall be in accordance with the regulations prescribed by the
EPA.
The equipment used in this operation shall be in proper working condition, size, and quality to
adequately perform the operation, and equipped with drip pans and other pollution devices to prevent
ground pollution.
Contractor will not, under any circumstances, dispose of pollutants onto the ground or into any
drainage or containment devices without prior approval of a company representative.
Contractor shall instruct own personnel to be alert at all times to prevent damage to equipment in your
work area.
If at any time, contractor personnel determine that a spill may occur, Contractor is instructed to notify
a company representative so that they can be present for instructions and assistance.
On completion of Contractor operation, Contractor shall return the area to its original condition.

note that I have included as an attachment to this cover letter a copy of the completed Flood Hazard
Development Permit Application and like the USR it is being simultaneously submitted to the Weld County

OVERVIEW
' Kerr McGee Oil & Gas OnShore LP has an existing well on the subject property. The
property is located near the intersection of Highway 119 and Weld County Road 7% in
' Section 10, Township 2 North, Range 68 West(see attached map). Kerr McGee plans to
drill an additional three wells on the property as shown on the map. They are currently
going through the Weld County Use by Special Review process.
' The property is shown to be within the 100-year floodplain of St. Vrain Creek, as mapped on
FEMA FIRM Panel number 080266-0850C. A portion of the property just north of the wells
has been removed from the floodplain by Letter of Map Amendment (LOMA), Case Number
02-08-319A. This same LOMA sets the Base Flood Elevation (BFE)for the site at 4849.0
feet. The LOMA is attached in Appendix C.
MEETING WELD COUNTY CODE 23-2-480
' Floodway
A cross-section was marked perpendicular to the watercourse and a profile drawn showing
elevations across the site and the corresponding watercourse (St. Vrain Creek).
Calculations were performed to determine the 'floodway'. The resulting floodway is shown
on the accompanying map and is almost 4000 feet to the west. Therefore, the site and the
proposed improvements are not within the floodway. The floodplain calculations utilizing the
I • cross-section as shown on the attached map are shown in Appendix A.
Structures
' The development in question is not an addition of structures as related in the code. Kerr-
McGee is drilling some new wells in an area where one well already exists. Also existing in
place is a tank battery and separator area. The tank battery will remain and be expanded
' somewhat. The separator area will remain, but one larger separator will replace multiple
separators. The attached map shows the location of the existing and new wells, along with
the separator and tank battery area.
' Fencing
The wells, tank battery and separator areas are all enclosed with fencing. The areas are
' fenced with six-foot high galvanized chain link fencing. The chain link type fence allows any
floodwater to flow through. The chain link is also necessary, as opposed to pipe rail,
because of the population in the area and the danger with potential vandalism. An example
fencing configuration is shown in Appendix B.
Betming
' As with all oil and gas facilities the wells, separator and tank battery areas are also enclosed
with berms to capture any potential spill. Kerr-McGee now uses corrugated steel berms that
are approximately 2' tall and 1/16"thick. By utilizing this type of containment, instead of the
' standard earthen berm, the amount of area utilized is significantly reduced and therefore any
• potential floodwater displacement is also minimized.

• Anchoring
The tanks included within the tank battery will be anchored to hold them in place if and/or
' when flood waters encompass the site. Each tank will be anchored with four cork-screw
anchors that are screwed into the surrounding ground approximately 4.5 feet. The anchors
Iare attached to cables that are subsequently attached and/or tied together on top of each
tank. Combining the anchors, the tank weight along with the other equipment attached to
the tank, as well as the fact that the site is located on the periphery of the floodplain and that
Iwater depths expected during a 100-year flood are less than 12 inches and the flow velocity
at the periphery will be near zero, the tanks will stay put and will not float away to cause
injury or damage to others. An example tank anchoring is shown in Appendix B.
ISeparator
The separator is not typically anchored as the tanks are. The separators are held in place
Iby their own weight (38,000 lbs.) and the piping/tubing connected to the separators that is
installed below plow line.
Displacement
I
The approximate amount of displacement, caused by the steel berms being above the
floodplain elevation, which would occur during a 100-year event, is 2680 ft3. This small
Iamount of displacement would have no significant affect on the floodplain elevation as the
area taken up by the floodplain is so large (200-foot wide path along the cross section
alignment is approximately 1.3 million ft', or 30 acres). The displacement calculation is
summarized in the following table.

No sanitary sewer is part of this site, nor is there one expected.
This site is not within the floodway.
The site will not use fill to remove items from the floodplain. The steel berms, while
' protecting the items from floodwaters and protecting the surrounding area from potential
spill, do not raise the elevations. Since the flood waters will have a velocity near zero the
strength of the steel berms does not really come into question. They should perform and not
be swept away during a 100-year event.
No water course alteration or relocation is involved with this site.
Conclusion
Through graphical representation, calculations and common sense, it is apparent that
adding the new wells, and the ancillary equipment involved will have no noticeable impact
on the 100-year flood event for this area.

Thank you for your cooperation regarding the Early Release for both the Carma-Rademacher
Wells (USR #1664) and the Milky Way Wells (USR #1666) . I have mailed to you an Early
Release Request for the Milky Way Wells and have also attached the request to this e-mail
along with the site plan map and surface use agreement. You should have the Early Release
Request for the Carma-Rademacher Wells, but please let me know if you should need another
copy.
The building permits for the Carma-Rademacher Wells have been submitted to Weld County and
the building permits for the Milky Way Wells will be turned in shortly. I will be sure to
notify you when Weld County has receipt of the completed permits.

Kerr-McGee Oil and Gas Onshore LP (KMG) has a Use By Special Review Permit
Application for the above referenced wells presently submitted for review by the Weld County
Planning Department.
Due to certain time constraints, well inventory, drilling rig availability and in light of the
fact that KMG has negotiated and agreed to the above well locations with the surface owner,
Carma Bayshore LLC, KMG is respectfully requesting an early release, and or waiver of any
requisite building permits from the Weld County Building Department in order that KMG
may proceed with the drilling of the subject Milky Way wells outside of final resolution of the
USR process.
KMG agrees to complete the USR approval process as required by the Weld County
Planning Department, and to conduct its future operations in accordance with the final
Development Standards per the USR Resolution to be crafted by the Weld County Board of
Commissioners.
If this meets with the Weld County Planning Department's approval, it is kindly
requested that you forward this request for early release and/or waiver for a building permit to
the appropriate parties within your Department and the Building Department. We believe KMG
should actually be waived of any building permits as the subject oil and gas operations do not
include any buildings that would require a building permit by Weld County. To assist you in this
• request, 1 have enclosed a copy of the USR Site Plan Map detailing the subject well head
• locations and oil and gas operations area, and a copy of the Surface Agreement between KMG
and Milky Way Owner's Association, Inc.

Dear Mr. Spencer,
Weld County Public Works has reviewed the above mentioned project. It is understood that the project was
originally completed in 2005 and will be a re-completion of the 16-36 well into the J sands. There will be no
additional facilities or expansion of the site, Since the facility has been in existence since 2005, it has been
determined that a Flood Hazard Development Permit will not be required. However, in order to be consistent
with FEMA regulations for developing in a floodplain, the tank battery must be anchored to avoid the potential
for floating during a flood event. If the tank battery is already anchored, please provide evidence showing how
the tanks are anchored. If the tank battery is not anchored, please provide a design showing how the tanks will
be retrofit with anchoring devices.
As you requested, I have also enclosed a copy of the work map submitted to FEMA for the Pelican Shores
subdivision. The location of the tank battery has been highlighted. As you can see, the tank battery is very
close to the floodway of the St. Vrain River.

Remarks: Please respond by August 7,2008. Application is for three new wells, an existing well
a tank battery, and a separator located in the St. Vrain Creek floodplain. The applicant has provided
information showing that the facility will be located out of the floodway. The tank battery will be
anchored. There is not expected to be any water or sanitary systems on this site.
