RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV#0800222 AGAINST JOHN MAROTTEK FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John Marottek, ZCV #0800222, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 18th day of November, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, John Marottek, property owner, was present at said hearing, and WHEREAS, the Board deems it advisable to dismiss said matter due to the conclusion of the Board of County Commissioners as to the vehicle in question being considered recreational, not commercial, which brings the property in compliance. REMEDY As we discussed, while I believe the semi truck and trailer situated on your property appear to be utilized in a Recreational capacity, the Weld County Code does not differentiate between a commercial use or a recreational use, when it pertains to the presence of a vehicle of this size and type. Since you have indicated that getting the semi cab and trailer permitted as a Recreational Vehicle was so difficult, you are not inclined to permit it as a Commercial Vehicle; therefore, the Board will need to make the determination whether this vioaltion should proceed or be dismissed. See picture dated 08/20/08. 08/29/2008 Other I brought this issue to our weekly Friday staff meeting. Staff determined for consistency sake, the Board would need to make the determination to dismiss or proceed. Since the code does not address a commercial vehicle vs a Recreational Vehicle as it pertains to this size and type of a vehicle. 10/03/2008 Phone Call John Marottek (303-659-5474) called. He said he received my letter. He said he wasn"t going to see about permitting as a Commercial Vehicle, he said he went through too much of a headache to get it permitted as a Recreational Vehicle. I asked which hearing would be better for him. He said the November 18th hearing would work out the best. I told him that I would get a letter out to him as soon as possible.
