COLORADO SUBJECT: USR-1394, Zadel Family LLLP (NCCI Pit#1)
The Weld County Public Works Department has reviewed this proposal. This proposal falls
primarily under the purview of the Use by Special Review Standards, Weld County Code,
Chapter 23, Article 2, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 18 is a collector road and requires an 80-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is
measured from the future right-of-way line.
• WCR 25 is a local paved road and requires a 60-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is
measured from the future right-of-way line.
The proposed access shall be placed in such a location to have adequate sight distance in both
directions keeping the landscaping and trees out of the sight triangle at the entrance. The
applicant needs to place a stop sign at the entrance.
Long-Term Road Maintenance Agreement: The applicant has a road maintenance
agreement in place with the Weld County Public Works Department. For the past two years,
improvements to WCRs 18 and 25 have been occurring at this location in cooperation with the
four gravel operators in the area. The section of WCR 25 has been widened to 32 feet
adjacent to the NCCI Pit #1 facility. The bridge has been widened at the intersection of WCRs
18 and 25. Ongoing improvements will be continuing in the Spring of 2008. The applicant is not
required to amend the Long-Term Road Maintenance and Improvement Agreement, as it is in
place and working well.
CDOT — Traffic Study: The applicant shall contact Gloria Hess-Idler at the Greeley CDOT
office to determine if a traffic study is required for the US Highway 85 Access Control Plan, as it
is amending its operations to include an asphalt and concrete batch plant. The US Highway 85
Access Control Plan identifies US Highway 85 and WCR 18 as a full movement non-signaled
intersection with medium priority to improved acceleration/deceleration lanes.

Storm Water Drainage: The applicant's engineer, J & T Consulting, has provided a storm
water report. I will be forwarding this to Brian Varrella, in our Drainage Division, for evaluation
and comments. Brian will follow-up with a memo, which will be forwarded to Planning Service
and the applicant or the applicant's engineer.
Approach Surface: The approach to the concrete and asphalt batch plants shall be surfaced
with asphalt or concrete and shall have adequate turning radiuses in both directions. The
purpose of hard surfacing the approach lanes is to keep from tracking mud and debris on to the
public road system and to keep the dust mitigation down from both plant sites. This is typical
request within a gravel, concrete, and asphalt facilities.
Asphalt Batch Plant and Concrete Batch Plant; The surface from the asphalt scale house
and concrete loading dock to the County road shall be asphalt or concrete.
Circulation Surface: The remaining portion of the asphalt/concrete batch plant circulation and
parking area may be surfaced with recycled asphalt or equivalent, and have dust control.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
• property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.

Weld County Public Works Department has reviewed the Amended Use by Special Review(AmUSR)
materials and has the following development referral comments. Comments made during this stage of the
review process may not be all-inclusive,as revised materials will have to be resubmitted and other concerns or
issues may arise during further review
Drainage and Floodplain Requirements
Floodplain:
1. As noted in the Drainage Plan and Report, the NCCI Sand and Gravel Pit#1 is located in a Special Flood
Hazard Area(SFHA)determined by the Federal Emergency Management Agency(FEMA). The limits of
the area of operations are identified on Flood Insurance Rate Map(FIRM) Panel 080266-0866C and
Panel 080266-0868C. Activities in the SFHA must be approved through a Flood Hazard Development
Permit(FHDP) per Weld County Code 23-2-450.
a. FHDP-481 was processed by Weld County in 2005 for the NCCI Pit#1. The applicant must
amend the FHDP application and submit appropriate materials and fees for review by all County
• referral agencies.
2. The applicant and their engineer must provide additional information that:
a. Proves the proposed activities, fill, dredging, mining, stockpiling of materials, structures, and any
other activities identified as development are not located in a floodway.
b. Proves the proposed development activities will not increase flood risk on neighboring properties.
c. Provides FEMA-required supporting documentation of the base flood elevation at the site.
d. Ensures that proposed structures will be reasonably safe from flooding.
Drainage:
1. The AmUSR drainage report dated October 19,2007, submitted by J&T Consulting, Inc.,has not been
signed, stamped,or dated by a registered professional engineer licensed to practice in the State of
Colorado. Drainage submittals must be signed, stamped, and dated by a registered P.E. before they may
be accepted by Weld County Public Works.

In response to your request, and in accordance with House Bill 1041 (1974), I visited the site and
reviewed the referral materials. Included in the referral package were: The property is located at
8249 WCR 25, in Fort Lupton. The subject property is currently used as an existing gravel pit
operation.
• During my site visit, and review of the permit application, I observed no geological hazards or
conditions that can be identified within the site and vicinity that would prevent its continued use as a
gravel resource. Provided that the site is reclaimed pursuant to the mining permit and standards
set forth by the Colorado Department of Reclamation, Mining and Safety, the CGS has no
objections to the proposed special use permit application.

This referral does not appear to qualify as a"subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
• project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure,the issuance of a well permit, or the physical availability of water.
According to the submitted information, the Gravel Mining operation will cause depletions to
the South Platte River due to evaporative losses from exposed ground water and operational losses.
The applicant has an approved Substitute Water Supply Plan (SWSP)to replace the depletions
caused by the mining operation. That SWSP is currently valid through December 31, 2007 and
the applicant has submitted a request to renew that SWSP. The applicant has also obtained a
well permit for the gravel mining operation. If the depletions at the site will expand beyond
those allowed by the current SWSP, a new SWSP and well permit must be obtained.
Crave: pit operators typically must first obtain approval from the Colorado Division of
Reclamation Mining and Safety prior to mining. As part of that process the applicant will need to
address the potential concerns of State Engineer's Office as they relate to water rights.

Environmental Health Services has reviewed this proposal for the expansion of a
mineral resource development facility (dry open pit mining for sand and gravel).
USR application
The applicant was required to install a vault type septic system for the scale house per
amended condition of approval dated September 24, 2003. The applicant also had
obtained a septic permit (SP-0300479) for the repair of an existing residential system
on the property. A review of septic records indicates that the residential system was
never finaled by this office. Additionally, there is no record that a vault permit was
• obtained for the scale house.
AMUSR application
The expansion of the USR adds mining area only; no other changes are requested to
the application. There is a residence on the expansion parcel with an undocumented
septic system.
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. Provide clarification on the status of permit SP-0300479;
2. Provide clarification on the status of the vault system for the scale house;
3. All septic systems located on the property shall have appropriate permits from
the Weld County Department of Public Health & Environment. The
Environmental Health Division of the Weld County Department of Public Health &
Environment was unable to locate a septic permit for the residence on the
expansion parcel. Any existing septic system(s) which is not currently permitted
through the Weld County Department of Public Health & Environment will require

an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In .
the event the system(s) is found to be inadequate, the system(s) must be brought
into compliance with current I.S.D.S. regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. Fugitive dust shall be controlled on this site. The facility shall be operated in
accordance with the approved dust abatement plan at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
6. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
7. The applicant shall operate in accordance with the approved "waste handling
plan".
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
9. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.

10.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
11.Adequate toilet facilities (port-a-potty) may be utilized on sites that are temporary
location of the working face and portable processing equipment, etc. for up to six

months at each location.
• 12.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
13.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
14.Any vehicle washing area(s) shall capture all effluent and prevent discharges
from drum washing and the washing of vehicles in accordance with the Weld
County Code, the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.
15.The applicant shall comply with the requirements of the Air Pollution Control
Division, of the Colorado Department of Public Health and Environment.
16.The applicant shall comply with the requirements of the Water Quality Control

The Department of Planning Services reviewed the above referenced Use by Special Review application
materials and offers the following comments:
Per the application materials, the applicant is proposing a Site Specific Development Plan and an
Amended Special Use Permit for Mineral Resource Development Facility including an asphalt and
concrete batch plant, materials blending, import of materials and gravel mining in the A(Agricultural)Zone
District..
Staff reviewed the text associated with the amendment application as there was not a Landscape Plan or
a Reclamation Plan included in the referral packet. The existing landscape treatment consists of clumps
of deciduous and evergreen trees approximately six feet in height at time of installation and a dryland seed
mix covering the ground plane. Discussion was presented to have an opaque fence installed to screen the
asphalt and concrete batch plant. Staff did not find specific plant material identified in the USR-1394
documents as the plan is general and non-specific without common, botanical or cultivar species noted.• Per the application materials, the ground plane will be planted in native and/or drought tolerant grasses.
Future correspondence shall identify the species of grass seed mix and whether the mix is to be drilled or
broadcast for installation. Future correspondence shall identify the erosion control devices including but
not limited to rip-rap and seeding that will be placed within and adjacent to this area. If plant material is
proposed, please identify the species and how this plant material will be installed. Staff has additional
concerns with the selection of the native grasses and the potential for noxious weeds to gain a foothold
and establish themselves within the open space areas. Staff requests additional information on all plant
species and seed mix be provided.
The application also states there will be materials blending and importing of materials utilized with the on-
going asphalt and concrete batch plant. Storage of these materials may present issues with blowing,
erosionary actions and the creation of nuisance conditions. The applicant is directed to provide
additional detail in the methods to be utilized to present such activities from occurring.
The original USR-1394 plat does not delineate a change of grade through the action of creating berms to
screen the facility from adjacent road rights-of-way or residential structures. Given the close proximity of
the batching facilities, staff has concerns with lights, dust, noise and the impacts on the surrounding
properties. Staff requests that the applicant address this issue.
If required by the Department of Public Works or Planning Services, the applicant shall submit an
Improvements Agreement for Public and/or Private Road Maintenance for review and approval by this
office if so determined that one is needed.
