There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Radiuses for the drive shall be 60 feet to accommodate large trucks. Traffic Study: In the Narrative please specify the units for the 57 loads heading for the landfill and 28 loads for recycling are these per day? per month? Drainage Report: Please update the submitted Drainage Report to reflect the release rate from the detention pond per County Code. All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed USR from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five-year storm falling on the • undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7). All storm water must be detained on site and follow the requirements per Weld County Code 24-7-130 D and Ordinance 2006-7. Please provide a letter from the Railroad Company to the south to allow a storm pipe to be installed under the tracks to drain this property and offsite storm water flows. Soils Report: Will be required for the building. We recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The Operations Plan submitted in the application materials shall be amended to address the Colorado Department of Public Health and Environment Hazardous Materials and Waste Management Division's October 9, 2008 comments. This amended plan shall then be submitted to and approved by the Hazardous Materials and Waste Management • Division and the Weld County Dept. of Public Health& Environment. 2. Evidence shall be submitted to the Weld County Dept. of Public Health& Environment and the Colorado Department of Public Health and Environment Hazardous Materials and Waste Management Division that demonstrates the recycling facility was constructed in accordance with the approved design. 3. A fugitive particulate emissions control plan(dust control plan) shall be submitted and approved by the Weld County Dept. of Public Health&Environment. 4. Applicant shall demonstrate through their Operations Plan that all process wastewater will be collected and disposed of in accordance with the Colorado Water Quality Control Commission and U.S. Environmental Protection Agency Regulations. 5. The facilities Fire Protection Plan shall be approved by the Union Colony Fire Rescue Authority and be included in the Operations Plan. Development Standards: 1. The property owner or operator shall comply with the applicable sections of the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2)and operate in compliance with the approved Operations Plan. 2. The facility shall comply with the approved Fire Protection Plan and any additional 40 • requirements of the Union Colony Fire Rescue Authority. 3. Volume records shall be maintained,which include solid waste processed, solid waste shipped for disposal, and the amounts and types of materials shipped for recycle. An annual report shall be submitted to the Weld County Department of Public Health& Environment and the Colorado Department of Public Health and Environment Hazardous Materials and Waste Management Division by May first of each year. 4. Only residential and commercial solid waste may be accepted at this facility. No medical waste,hazardous waste, special wastes, asbestos waste,contaminated soils or demolition/construction wastes may be accepted for processing. 5. All material received at the facility shall be processed within 24 hours. After processing all solid waste shall be stored in closed containers. After processing all recyclable materials shall be stored under cover on an impervious surface or in closed containers. 6. The property owner or facility operator shall notify the Weld County Department of Public Health&Environment,Department of Planning Services and the Colorado Department of Public Health and Environment in the event of any deviations from or • proposed changes to the facilities Operations Plan or Fire Protection Plan. 7. No permanent disposal of wastes shall be permitted at this site. 8. Any liquid or solid wastes(as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities", as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30,Article 20,part 1, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 9. The facility shall be operated and maintained in a manner to prevent nuisance conditions from the attraction, breeding and emergence of birds, rodents, insects and other vectors. Additional control measures shall be implemented at the request of the Weld County Department of Public Health& Environment 10. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall comply with their approved fugitive dust control plan. 11. The maximum permissible noise level shall not exceed the light industrial limit of 70 dB(A), as measured according to Section 25-12-102, CRS. 12. There shall be no shredding, melting, grinding or other secondary material processing. 13. Exhaust removal systems shall be installed in enclosed areas and for dust producing processes and equipment. . 2 A 14. Visible stack emissions from exhaust removal and material processing shall not exceed 20%opacity(measured in accordance with EPA Reference Method 9). There shall be no visible emissions from any building openings(measured in accordance with EPA Reference Method 22). 15. In accordance with the Colorado Air Quality Control Commissions Regulation Number 2, odor detected off site shall not exceed the level of seven-to-one(7:1) dilution threshold. 16. The Colorado Department of Public Health&Environment,Weld County Department of Public Health& Environment and the public shall be provided with notification in the event of temporary or permanent closure. Upon closure, the facility shall follow the closure plan portion of the Operations Plan. All solid waste, wastewater and recyclables shall be removed and properly disposed of. 17. Waste materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in a manner that controls fugitive dust,blowing debris, and other potential nuisance conditions. 18. An individual sewage disposal system(I.S.D.S.) is required to dispose of sewage from the facility and must be designed by a Colorado Registered Professional Engineer and in accordance with Weld County I.S.D.S. Regulations. Any I.S.D.S. on the property shall be permitted, installed, maintained and operated in compliance with Weld County I.S.D.S. Regulations. No process wastewater may be disposed of in this system. 19. Process wastewater(such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation,maintenance, and proper disposal shall be retained. 20. The applicant shall obtain stormwater discharge permit coverage from the Colorado Department of Public Health&Environment, Water Quality Control Division. 21. In addition to these requirements, the plat scale shall be 1" = 40 feet. The Vicinity Map scale of 1" = 2000 feet scale accurately be delineated on the plat. This application shall be in compliance with Section 23-3-250 A. and B and is address in the following comments. Section 23-3-250.A.1 Stormwater Management. All users of land shall provide and maintain stormwater retention • facilities designed to retain the stormwater runoff in excess of historic flow from the developed site. The stormwater retention facility on a developed site shall be designed for a one-hundred- year storm. The stormwater retention facility shall be designed and operated to release the retained water at a quantity and rate not to exceed the quantity and rate of a five-year storm falling on the undeveloped site. The application materials do address this issue, stating that the surface water will be collected by engineered swales and held in ponds. There is no evidence of the applicant's ability to pipe under the railroad and discharge on lands to the south of the proposed facility. The applicant shall contact the Storm Water Engineering Staff of the Weld County Department of Public Works, to further discuss this issue. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.2 Parking. Sufficient screened, off-street, paved parking areas shall be provided to meet the requirements of employees, company vehicles, visitors and customers of the Uses Allowed by Right and Accessory Uses. Appendix 23-A describes the design requirements for parking spaces and Appendix 23-B delineates the number of parking spaces required by use for this property. The proposed facility is comprised of several structures with large expanses of gravel surface. For the purposes of this referral staff has taken the position for full buildout of the property, i.e., 18000 SF Structure and up to twenty employees using the property. The required parking spaces by definition is twenty personal vehicle spaces plus eighteen additional spaces for the [warehouse- 1 space per 1000 SF of space]. Total on site parking will be a minimum of twenty eight spaces. Additionally, semi-tractor spaces shall be provided to accommodate the staging of • Northern Colorado Disposal,USR 1670—Page 1 vehicles associated with this facility. All parking spaces shall comply with the minimum design requirements for off-street parking as delineated in Appendix 23-A of the Weld County Code. Compliance with the minimum parking and access standards for the Americans with Disability Act shall be followed at all times, as • applicable. Should the employee or visitor numbers increase, the parking requirement shall be structured according to Appendix 23-B of the County Code. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.3 Street Access. Lots shall have safe access to an approved public or private street. The design designation of any street or highway as to type shall be in conformance with that shown on the county thoroughfare plan and/or the master plan of the affected municipality. Visual inspection of the USR Plat identifies one point of ingress and egress, onto County Road 64. The internal circulation is unclear, additional information shall be submitted delineating the internal circulation pattern and the proposed parking areas associated with this facility. Further, the applicant shall delineate on the plat the proposed parking layout, including adequate aisles, and wheel stops. Written evidence of compliance from the Department of Public Works, the Fire Protection District and associated emergency responder personnel shall be submitted to the Department of Planning Services. The Fire District of record may require a second point of ingress and egress for this facility, including, potentially the upgrade and maintenance of County Road 31 right-of-way. All approved access roads shall be graded and drained to provide all weather access. Accesses shall be placed in such a location as to have adequate sight distance in both directions, shall not be placed below the crest of a hill or where physical obstructions are present. Written evidence of compliance shall be submitted to the Department of Planning Services. • Section 23-3-250.A.4 Required Yards - Setback No use or accessory use may be located closer than twenty (20) feet to the existing or proposed (whichever represents the greater right-of-way width) highway or street right-of-way. Off-street parking areas may be permitted in the required setback area when the area is screened from direct view of persons on the public rights-of-way. Fences over six (6) feet in height are not required to comply with the minimum setback and may be located on the property line. Fences located on corner lots abutting public right-of-way shall not obstruct the view of vehicular traffic at an intersection. There was not a scaled elevational drawing of the proposed facility, therefore, prior to the release of building permits, the set back shall be verified given the existing proposed site conditions, specifically addressing the landscape and screening component that is delineated within the County Road 68.5 right-of-way. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.4 Required Yards - Offset No use or accessory use may be located closer than ten (10) feet to its lot line. Off-street parking areas may be permitted in the required offset area when the area is screened from adjacent lots zoned R-1, R-2, R-3, R-4 or R-5. Fences over six (6) feet in height are not required to comply with the minimum Offset and may be located on the property line. The plans submitted with the application materials have not delineated the offset. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.5.A • Northern Colorado Disposal,USR 1670-Page 2 Required Landscaped Areas No more than eighty-five percent (85%) of the total area of a lot shall be covered. Land shall not • be deemed covered if it is used for growing grass, shrubs, trees, plants or flowers or if covered by decorative gravel or wood chips, or if it is otherwise suitably Landscaped. There was not a schematic Landscape and Screening Plan submitted with the application materials. It is also unclear from the submitted drawings if the fifteen (15) percent landscaped requirement has been met. The applicant shall address this issue and provide additional documentation including all proposed fencing, lighting, adjacent property screening and landscape treatment to meet this section of the Weld County Code. Further, given that the faciltity is proposed within 0.5 miles of the Poudre City townsite, Staff will substantial screening and the placement of plant material to soften and blend the facility with the neighborhood. Further, staff will require an approved weed management plan and a reseeding /post construction plan to facilitate soil stabilization and plant material growth. Further, staff will require an updated landscape and screening plan that addresses the issue of the landscape and screening component for the buffer between the outdoor storage component and the adjacent properties for this proposed facility. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.5.B That portion of a lot which abuts a public or private street right-of-way shall be landscaped for a distance of ten (10) feet, measured at a right angle from the lot line towards the interior of the lot. Driveways may pass through the required landscaped areas. There was not a schematic Landscape and Screening Plan submitted with the application materials. Additional information is required prior to accepting the plat for recording. Written evidence of compliance shall be submitted to the Department of Planning Services. • Section 23-3-250.A.6 Areas used for trash collection shall be screened from public rights-of-way and all adjacent properties. These areas shall be designed and used in a manner that will prevent wind- or animal-scattered trash. The application materials did identify the location of the three dumpsters for recycling on the plat, however, there was no evidence of immediate screening or other recycling material control device employed to control this issue. Future submittals shall address this issue as outlined in this Section of the Code. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.7 Water Supply. Uses shall have an adequate source of potable water. The application materials state that water is provided via a North Weld County Water District water tap. The applicant shall meet the requirements of the Weld County Department of Public Health and Environment at all times. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.8 Sewage Disposal. Uses shall have adequate sewage disposal facilities. The application materials state that individual sewage disposal systems (ISDS) will handle the effluent flow. Further, the applicant shall meet the requirements of the Weld County Department of Public Health and Environment. Written evidence of compliance shall be submitted to the Department of Planning Services. Section 23-3-250.A.9 • Northern Colorado Disposal,USR 1670—Page 3 Outside Storage. Uses involving outdoor storage of vehicles, (including the parking of employee vehicles) equipment or materials when permitted shall be screened from public rights-of-way and • all adjacent properties. The applicant shall submit documentation as to how the outside storage will be screened during the construction period, and for periods thereafter as applicable. Section 23-3-350.B. Operation Standards. Uses shall demonstrate conformance with the following operation standards to the extent that they are affected by location, layout and design prior to construction and operation. Section 23-3-350.B.1 Noise. Uses and structures shall be located, designed and operated in accordance with the noise standards as established in Section 25-12-101 C.R.S. The applicant shall meet the established standards set by the Weld County Department of Public Health and Environment. Section 23-3-250.6-2 Air Quality. Uses shall be located, designed and operated in accordance with the air quality standards established by the Colorado Air Pollution Control Commission. The applicant shall meet the established standards set by the Weld County Department of Public Health and Environment. Section 23-2-250.B.3 Water Quality. Uses shall be located, designed and operated in accordance with the water quality control standards established by the Colorado Water Quality Control Commission. • Section 23-2-250.6.4 Radiation and Radioactive Materials. The handling, use, storage and processing of radioactive materials shall be in accordance with the applicable regulations of the State and the United States government Section 23-2-250.B.5 Heat. Uses shall not emit heat in such an amount sufficient to raise the temperature of the air or of materials at or beyond the Lot line more than five (5) degrees Fahrenheit. The application materials do not indicate this is applicable, should this not be the case, the applicant shall provide additional information to the Weld County Department of Public Health and Environment and the Department of Building Inspection. Further, the applicant shall obtain a written approval from the jurisdictional Fire Protection District stating that the facility is in compliance with the Fire Code. Section 23-2-250.B.6 Light. Any lighting, including light from high temperature processes such as welding or combustion, shall be designed, located and operated in such as manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets; and no colored lights may be used which may be confused with or construed as traffic control devices. The application materials did not include a Lighting Plan. Should exterior lighting be a part of this facility, all light standards shall be delineated on the USR Plat. Section 23-2-250.B.7 Property Maintenance. Property shall be maintained in such a manner that grasses and weeds • Northern Colorado Disposal,USR 1670—Page 4 are not permitted to grow taller than twelve (12) inches. In no event shall the property owners allow the growth of noxious weeds. The application materials do not address property • maintenance. Future correspondence shall identify how the property will be in compliance with this Section of the County Code. Section 23-4-50. Off Street Loading. The applicant shall delineate on the plat the location of the loading zone that is in compliance with this Section of the Code. There shall be no parking or staging of vehicles within the public rights-of way. Further, the applicant shall meet all requirements of the Department of Public Works concerning access and internal circulation of vehicles for this proposed facility. Section 23-4-90 Signs. The application materials did not address the issue of on-site signs. The applicant shall provide written evidence that all proposed signs are in compliance with this section of the Code. The applicant shall enter into an Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all transportation (access drive, parking areas, et cetera) and non-transportation (plant materials, fencing, screening, et cetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. The Division conducted a technical review of the proposed site and facility documents and its operation plan in consideration of the requirements set forth in the Solid Waste Disposal Sites and Facilities Act,Title 30,Article 20,Part 1,C.R.S. (Act) as amended;and the Regulations promulgated thereunder,6 CCR 1007-2(Regulations), specifically Sections 7 and 8 of the Regulations. Based on our review,we offer the following comments regarding the above referenced documentation: General Comments: 1) Part 30-20-102(5)of the Act states that a recycling facility is not considered a Solid wastes disposal site and facility. Specific Comments: 7) In accordance with subsection 7.2:1(A),the operations plan shall be amended to include the facility mailing address if and when applicable. A Concept Plan drawing and an untitled US drawing were included in the application and they did meet some of the requirements of the egulations for a site map(s). However,the Division prefers the term/title Site Plan to Concept Ian and a state licensed surveyor or engineer shall certify the site maps, as appropriate in ace ce with subsection 7.2.1(E). Moreover,the content of the application should be consis ent throughout. 11)In accordance with subsection 7.2.1(F), the operations plan shall include site aps and drawings showing'all the proposed structures and areas designated for unloading, bailie , compacting, storage, and loading, including the dimensions, elevations, and floor plans of ese structures and areas, including the general process flow. 12)In accordance with subsection 7.2.1(G),the operations plan shall contain the facility's drainage system and water supply system. 13)The operations plan indicates that at this time,gravel will be placed in all are of truck traffic with the exception of the access apron onto Weld County Road 64,which is to e asphalt paved. • CO DEPT HELTH HAZ MAT Fax:3036399833 Oct 9 2008 11 :38 P. 04 Mr. Chris Gathman October 9, 2008 • Page 3 of 7 Subsection 7.2.2(A)(2)of the Regulations requires that unloading and loading)areas shall be constructed of concrete or asphalt paving material and equipped with adequate drainage structures. The operations plan should provide that future construction of asphalt/concrete pavement in loading and unloading areas may be implemented if the gravel b e is unsuitable. 14)The operations plan indicates that the overhead doors would be programmed that only one side could be open at anytime to avoid impacts by the wind and any odor. Ad 'tionally,the operations plan indicates that in the event that a dusty load is being processed;the downwind garage doors will be closed for containment. The operations plan shall incorporate that the personnel training plan(i.e.,req, ' by subsection 7.2.3(C):of the Regulations)will emphasize worker safety procedures in the etent that dusty conditions are encountered inside the building. 15)The operations plan indicates that a Traffic Impact Study has been prepared as part of the applicant's USR submittal. , Subsection 7.2.2(B)(1)indicates that on-site roads are to be designed to accommodate expected traffic flow in a safe and efficient manner. Subsection 7.2.2(B)(2)indicates that the road surface design shall be suitable for heavy vehicles.and the road base shall be capable withstanding expected loads. Subsection' 7.2.2(B)(3)indicates that on-site roads are to be pSsable, in all • weather conditions,by loaded collection and transfer vehicles. The design of the on-site roads . should be included in the plan•. •., 16)The operations plan indicates that the facility will include a public rccyclables rop-off area oriented'close to the entrance to lessen any impacts on truck traffic onsite. The operations plan should explicitly state that the required signage must defiriteiy meet Weld County requirements. The plan shall include text that the signage will also meet the requirements of the Regulations. 19)The operations plan indicates that it is anticipated that 239 incoming residential trash trucks with full loads will be received at this site per month. In addition,the operations plan indicates that any solid wastes will be processed or transferred within 24 hours of receipt and there will be no long term storage of any solid waste materials, Subsection 7.2.3(A)of the Regulations requires that the operations plan inclu a the types, composition,and expected daily volume of all solid waste to be accepted at th facility in cubic yards or tons/per day,the maximum time any such waste will be stored,and a proposed capacity of the facility. Additionally, subsection.7.2.3(I)of the Regulations ' icates that facilities handling more than 100 cubic yards of waste per day shall be clean daily of all loose materials and litter,by wash-down or other approved method,to prevent odo and other ; nuisance conditions. The plan shall explicitly state the proposed capacity of the facility(in terms o allowing' sufficient internal storage areas to provide for incoming solid waste)and specify a.deflnitive maximum time period any wastes will be stored at the facility in the plan. Subsection 7.2.3(K)• • of the kegulations requires that=compacted wastes will not be allowed to regain on the tipping ; floor overnight and removal of all putrescible solid waste from the transfer station is required ; I whenever transfer containers are full,or weekly,whichever comes first, 20)The operations plan lists the anticipated recyclable materials at the facility. . , . . ' Subsection 8.4.1(A)(4)of the Regulations requires that new recycling facilities shall submit upon.. their opening a notification to the Department that contains the types of recyclable.material recycled or reused at the facility. Paperboard is not listed as a recyclable material at the facility. This point shodld be clarified and the plan modified accordingly. Additionally,waste tires are not listed as a recyclable material. Section 16(Disposal of Motorized Equipment Wastes)of the Regulations prohibits disposal of residentially generated waste tires at transfer stations. Management of such waste tires must be described in the operations plan. 21)The operations plan anticipates that up to a total of 15 to 20 employees will be employed at the site during operation hours. It is recommended at the plan incorporate the option of using wind screens,where necessary. In addition,th plan should clearly include that reasonable measures shall be employed to collect and prapOrly dispose of litter(i.e., generated by the facility)that is located outside the perimeter boundary of the facility. 23)The operations plan indicates that a letter dated August 5,2008 has been incl to demonstrate i that the process of developing a fire protection plan is underway. A copy of the above referenced August 5,2008 letter should be included with a application. Additionally,a fire protection plan approved by the local fire department,shat be made available to site personnel and the letter of approval added to the operations pl in accordance with subsection 7.2.3(F)of the Regulations. +n 24)The operations plan shall appropriately address maintenance of operational rec!+ds(i.e:,,,a daily ', . log of the quantity of solid waste received and transported, as-built construction details;.and . variations from approved,operations procedures)per subsection 7.2.3(G)of the Regulations.. ;i , • • 25.)The operations'plan indicates that a Contingency Plan for the facility willbe.i4place at all times and will Specify the procedures to be followed to handle any hazardous anateriels:.incidents; ' , contaxnidation of surface or ground water;address any nuisance conditions; and have alternate , solid waste handling solutions in the event of a period where the facility is una4le to operate. . . • The Division received a facsimile fiom Don Frei(Northern Colorado Disposal line:),on , • September 19,2008 that evidently consists of a draft that pertains,in part,to. contingency plan(see enclosure). A contingency plan should be added to the operations pl in accordance with subsection 7.2.3(11)of the Regulations. 26)The operations plan indicates that the building floors will be sloped to a floor drain that collects any residuals from the refine as well as any equipment cleaning and wash dow-i water. The plan goes on to indicate that the collected water will be diverted to a water tight storlage tank where it can be pumped and hauled to an approved processing facility. The enclosed facsimile from Don Frei apparently contains draft language for irJsertion into the operations plan regarding sampling and laboratory analysis requirements for cllaracterizing the tank contents for purposes of disposal. The plan should require that the tank acid associated piping be double lined and be installed in accordance with the manufacturer's ommendations. Additionally,the plan should require the corresponding as-built construction ls. Furthermore, subsection 7.2.3(N)of the Regulations requires at the amounts and source of water for use on site for the control of nuisance conditions, fire lkotection, construction purposes and personnel use shall be presented. 28)The operations plan text indicates that the facility will follow a closure plan tikt conforms to the Department's Regulations. The operations plan shall explicitly specify detailed and comprehensive closure activities for the removal,of all stored solid wastes and washdown liquids. The proposed facility is also subject to the closure requirements in the Regulations pertinent to recycling facilities. 29)The Concept Plan drawing indicates that storm water from the on site detenti pond will apparently be discharged offsite onto Great Western Railroad property throw an outlet pipe that traverses through their railroad tracks. , ,, • :The storm waterthat is discharged through the outlet pipe is Subject•to'req>tirc4nents elite storm water rules of the Department's Water Quality Control Commission. Accordingly, a grading plan with supporting calculations should be included with the operatiobs plan. 31)USR drawing Development Standards 19 and 20 indicate that no buildings are planned for this initial USR application,which appears to be inconsistent with the content of the operations plan and other application documentation. The content of the application should be consistent throughout. 32)USR drawing Development Standard 26 refers to an accompanying Concept Pan.
