HomeMy WebLinkAbout20082886.tiff Minutes WELD COUNTY COUNCIL September 15, 2008 ' 4, CD 9A2008 r S /II 8 The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter, Monday, September 15, 2008, 6:30 p.m., at the Weld County Centennial Center, 915 10`h Street, Greeley, CO. ROLL CALL: The meeting was called to order by President Ginny Buczek. Vice President John Kivimaki, Councilman Don Mueller, Councilman Stille and Councilwoman Nancy Teksten were present, constituting a quorum of the members. Also present was Tom Honn, Lee Godfrey and Karla Ford, Council Secretary. AGENDA APPROVAL President,Buczek added two phone calls under Coordinator Reports. Councilman Kivimaki made a motion to approve the agenda with the additions. The motion was seconded by Councilman Stille and carried. APPROVAL OF MINUTES: August 18, 2008 Minutes Councilman Mueller made a motion to approve the August 18, 2008 minutes. The motion was seconded by Councilwoman Teksten and carried. REVIEW PROGRAM: Planning Director, Tom Honn, came and gave an overview of the use by special review (USR) process. A map was distributed to show the permits that have been given over the years by the different processes. The different terminology is as follows: BOA — Board of Adjustment - Appeals on administrative decisions CUP — Conditional Use Permit—Terminology change 1970's SUP = Special Use Permit — Change of terminology. USR — Use By Special Review- compatibility in neighborhoods The Planning Department has a new process for individuals requesting a permit. The goal is to have fewer issues at the Board of County Commissioners hearing and the time between the Planning hearing and the Board of County Commissioners hearing is shortened. This will also help the applicant know exactly what they need to do and will assist them in making the decision to pursue or discontinue the permit application. The process —When an applicant comes to the planning department, the information regarding the type of permit and the property is sent to health department, public works department and planning department. A pre-application meeting is set-up with the applicant within 7 days. This meeting is to go over the information and give the applicant any possible issues with the application. When an applicant submits an application, only four copies are needed initially to insure a complete submittal. The applicant will then need to make any changes and bring back all required applicant sets. These are sent out for the referrals. Once the referrals come back, the planning group goes over the CM/Wu it( Ca hrryc 10 I3I I wes 2008-2886 Weld County Council Minutes September 15,2008 Page 2 of 3 referrals with the applicant and they estimate a date of when corrections, if any, will take place and then schedule a hearing date with the Planning Commission and the Board of County Commissioners. Mr. Honn addressed the number of personnel in the Planning Department and said there are three fewer people in the department than at the beginning of the year and said the group is working well with the current case load. Councilwoman Buczek inquired about the oil and gas permits. Mr. Honn stated that a building permit is not needed for the well. Planning makes sure the equipment is placed properly. They also do electrical inspections. The only time a USR's for a well is needed is in non-agricultural areas. Councilman Stille asked how complaints are handled regarding the application process. Mr. Honn noted majority of complaints are related to current building permits or from an applicant that may feel more items are required than what are needed. In those cases, Mr. Honn contacts the case manager and tries to get the hurdles completed and get a resolution. Mr. Honn addressed Councilman Stille's concern regarding the oil and gas building permits. The major oil companies, such as Nobel, are trying to inventory the wells and come up with a program to manage these wells that have been around before January 1, 2008. If the wells were previously there, then a permit is not needed. Anything that is new after January 1, 2008, a permit is required. This information is going to be tied into the GIS mapping system. Councilman Mueller applauded Mr. Honn for streamlining the application process. SHORT RECESS PUBLIC COMMENTS: Ft. Lupton resident, Lee Godfrey, came to the meeting to give comments regarding the Weld County Commissioner salaries. He felt the Council was overly generous with the amount on the resolution. He appreciated the chance to come and give his comments. UNFINISHED BUSINESS: Resolution 172 — Setting Salaries for Weld County Commissioners Councilman Kivimaki made a motion to adopt Resolution 172 for setting the salaries for the Weld County Commissioners for$83,500 for the year 2011 and $87,300 for the year 2012. The motion was seconded by Councilman Stille and passed with a unanimous roll call vote. Weld County Council Minutes September 15,2008 Page 3 of 3 • NEW BUSINESS: February 2009 Meeting Date Generally the Council meets the second Monday in February due to the third Monday falls on President's Day. There is a conflict with the second Monday in 2009 and it will be suggested to meet the fourth Monday in February. This will be solidified at the January 2009 meeting. Coordinator Reports C. Holmes Follow-up — Councilman Kivimaki Councilman Kivimaki talked with Pat Persichino regarding the inquiry from Mr. Holmes. The Public Works Department is working with Mr. Holmes to work out a drainage solution. This process is still in progress. G. Neal Phone Call —Councilwoman Buczek Weld County resident, Glenn Neal, contacted the Council office and Councilwoman Buczek on September 12th regarding a road grading issue near his home. Councilwoman Buczek contacted Pat Persichino and stated that trip count meters were put on the roads and the data came back. Upon the information given to the council from Mr. Persichino, the Council will send a letter to Mr. Neal informing him that the Council believes that Weld County is making a good faith effort to maintain the particular roads near his home. Compensation Meeting — Councilwoman Teksten Councilwoman Teksten, Councilman Stille and Councilman Mueller attended the county compensation meeting. The department heads were briefed on the changes to retiree medical benefits. The plan will not impact retirees within the next five years. After that time, the new program will begin to cycle. BILLS Councilwoman Teksten made a motion for the bills to be paid as listed below: Mileage for Council President Ginny Buczek $ 36.16 Mileage for Council Vice President John Kivimaki $ 50.85 Mileage for Councilman Gene Stille $ 25.99 The Greeley Tribune (Report to the People) $ 108.03 The motion was seconded by Councilman Stille and passed with a unanimous roll call vote.
