RE: SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED USE BY SPECIAL REVIEW
PERMIT#1193 FOR A JUNKYARD AND SALVAGE YARD IN THE A(AGRICULTURAL)
ZONE DISTRICT - GARY NOVOTNY
A public hearing was conducted on January 23, 2008, at 10:00 a.m., with the following present:
Commissioner William H. Jerke, Chair
Commissioner Robert D. Masden, Pro-Tem
Commissioner William F. Garcia - RECUSED
Commissioner David E. Long - EXCUSED
Commissioner Douglas Rademacher
Also present:

County Attorney, Bruce Barker
Planning Department representative, Jacqueline Hatch
The following business was transacted:
I hereby certify that pursuant to a notice dated January 4, 2008, and duly published January 9,
2008, in the Fort Lupton Press, a public hearing was conducted to consider the request of Gary
Novotny for a Site Specific Development Plan and Amended Use by Special Review Permit#1193
for a Junkyard and Salvage Yard in the A (Agricultural) Zone District. Bruce Barker, County
Attorney, made this a matter of record. Commissioner Garcia stated he is recusing himself from
the proceedings. Jacqueline Hatch, Department of Planning Services, entered the favorable
recommendation of the Planning Commission into the record as written. She stated Mr. Novoty
has sold the business to a company in Denver, and all of the equipment to be located on the site
will be brought from the Denver location. Ms. Hatch stated the sales contract indicates Mr. Novotny
has until May 15, 2008, to have all current items removed from the site. Based on the sale of the
property, Ms. Hatch requested the Board continue the matter until May 21,2008,at which time staff
will inspect the site and verify all items have been removed. She stated if the property is cleared,
staff will recommend dismissing this case and vacating the original permit.
No public testimony was offered concerning this matter.
Commissioner Masden moved to continue the request of Gary Novotny for a Site Specific
Development Plan and Amended Use by Special Review Permit#1193 for a junkyard and salvage
yard in the A(Agricultural)Zone District,to May 21, 2008,at 10:00 a.m. The motion was seconded
by Commissioner Rademacher, and it carried unanimously. There being no further discussion,the
hearing was completed at 10:15 a.m.
