WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public meeting held on the 11th day of June, 1980, in the Chambers of the Board of County Commissioners of Weld County, Colorado that a certain parcel of land is owned by Gerald and Ellen Chapin, which land is more particularly described as follows, to-wit: Part of the South Half of Section 11, Township 6 North, Range 66 West of the 6th P.M. , Weld County, Colorado. WHEREAS, Gerald and Ellen Chapin desire to obtain a variance from the minimum lot size requirement so that they may make appli- cation for a recorded exemption, as set forth in Section 9-4.A. (6) of the Subdivision Regulations , and WHEREAS, the Board of County Commissioners of Weld County, Colorado feels that the applicants have not shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that a variance from lot size requirements be, and hereby is, denied to Gerald and Ellen Chapin for the above described parcel of land. Board of County Commissioners Weld County Colorado 915 10th Street Greeley, Colorado 80631 Re: Lot Size Variance #I13 Dear Commissioners: The attached letter and related materials are in reference to a request for a lot size variance from Gerald and Ellen Chapin. The property on which this request has been made is described as part of the Si., Section II , T6N, R66W of the 6th P.M. , Weld County, Colorado. This property is located I mile west and 2 miles south of Eaton. The property under consideration contains approximately 43 acres of Class II and III irrigated soils and Class IV nonirrigated soils. The request is to obtain a variance from the minimum lot size requirement, Section 9-4 A. (6) of the Weld County Subdivision Regulations, so that they may make application for a recorded exemption. If the request is granted, the Chapins will proceed with a recorded exemp- tion application to divide the property into a 1 .5 acre parcel more or less, and a 41 .5 acre parcel more or less. The Chapin's wish to sell the 1 .5 acre parcel which has an existing residence located on it and they will attempt to rent the balance of the property. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the request be denied for the following reasons: I . The proposed request does not comply with the Weld County Com- prehensive Plan because it would promote nonagricultural use of agricultural land and it would encourage urban encroachement on rural land use. The Plan urges residential development to be closely connected to service new developments within a reasonable service area from its incorporated boundaries. The plan further indicates subdivision of land should conform to the overall development goals and policies of the Comprehensive Plan. Board of County Commissioners June II , 1980 Page 2 2. This request is not in conformance with the intent clause of the Agricultural Zone District, Section 3.3.A. of the Weld County Zoning Resolution and the intent clause of the Recorded Exemption Procedure, Section 9-2 of the Weld County Subdivision Regula- tions. This request would not be encouraging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, it would be promoting the division of agricultural land into smaller, less economic parcel sizes, and increasing the residential density on the property. The parcel contains only one set of improvements. This request would allow another residence to be built on the 41 .5 acre parcel . Increased residential density results in greater demands on the services which residential development requires and, therefore, results in higher costs to the residents of the County in pro- viding those services. 3. The Eaton Planning Commission has recommended denial of this request. In a letter dated June 5, 1980 it was indicated that the majority of its members felt that this request might lead to the construction of a second or more houses on the remaining 41 .5 acres, which it opposes. 4. The minimum lot size in the Agricultural Zone District for irrigated parcels is 80 acres and for nonirrigated parcels is 160 acres. The intent is to maintain tracts which are large enough for farm purposes, and to assist in the encourage- ment of agricultural uses as the highest and best use of the land. At this meeting the Weld County Planning Commission , represented by Chuck Cunliffe , denied our request for the following reasons : 1 . ( note) "It would promote nonagricultural use of agricultural land; namely, encourage urban development . " 2. (9uote) "This request would not be encouraging agricultural uses as the highest and best uses . " 3. (Quote) "The Eaton Planning Commission has recommended denial of the regi=est . " ("uote) "The intent is tc maintain tracts which are large enough for farm purposes. " In replying to reasons 1 , 2,. 3 , and 4, we do not and never did plan to develop our 43 acres , more or less . We believe the Weld County Commissioners have the power to deny developments whenever they see fit . We feel there was insufficient thoroughness in the investigation of our property. We do not wish to be judged from the comfort of an automobile parked on the extreme south—west corner of our property. Since we believe the investigation of our property was superficial , we would like part of our fee returned to us . ` In the future we will be more attentive to the way the commissioners handle cases similar to ours . Vie hope this letter will serve as a guide for similar opinions. We are 65 and 68 years of age , and this variance is important to us . We will watch future opinions with close scrutiny. Please send us a copy of the Eaton Planning Commission ' s ' recommendation . We would like to check their approval or denial of re uest and the reasons leading to their decision .
