Peterson, Genevieve Clark and Mary Phyllis Patterson, , individually, as Grantors and Pease Oil and Gas Company, 2707 South County Road I I, Loveland, Colorado 80538,as Grantee. WITNESSETH: Grantors hereby grant unto Grantee an easement over, under and across their property located in the NW/4NW/4NW/4 of section 5,Township 4 North,Range 68 West,6th P.M.,Weld County,Colorado.The dimensions required for this easement shall be a 30'by 30'service area for the water hydrant located approximately 165'south of State Highway#60 and 87'east of Weld County Road#3, a 4'x 6'vault for the meter and pit located as shown on the attached plat;and a pipeline easement commencing at State Highway #60, approximately 87' east of Weld County Road#3 and running south 165'to the water hydrant. 2. This easement shall be only for the construction, reconstruction, repair, operation and maintenance of a water pipeline, water hydrant and filling area for service trucks owned and operated by Pease Ott and Gas Company and its related entities and assigns. 3. Grantor grants to Grantee the right of ingress and egress to and from this easement as necessary and reasonable for the exercise of the rights granted herein. 4. The term of this Easement and License Agreement will be for a period of five(5)years from the date first above written. Grantee has the option to extend this agreement for an additional term of five(5)years upon notice to Grantors of not less than sixty(60)days before the expiration of the initial five(5)year term 5. Installation, repair and maintenance of the facilities shall be entirely without cost to Grantors and the Grantee shall indemnify the Grantors and forever hold them harmless from liability for damage to third persons resulting from its exercise of the rights herein granted. The • Grantee shall also indemnify,save and hold harmless Grantors from all claims,demands, or causes of action whether for property damages, personal injuries or death, in any way arising or going out of the use of the easement or right of way granted herein. 6. Grantee agrees to fill and re-pack the surface and to repair any damages caused by Grantee's operations. 7. The consideration for this easement is Ten and More Dollars, and other valuable consideration to the undersigned in hand paid, the receipt and sufficiency is hereby acknowledged by Grantors. One such regulation that could be introduced to reduce Diesel exhaust fumes' pollutants is to require Diesel engines to be shut off if the engines will idle more than five (5) minutes. A "requirement" could be worded for any length of time. • Exceptions to this are always related to emergency vehicles (ambulances, fire/rescue response trucks), and those that require operating for lights after dark, etc. Daytime idling while waiting in queues significantly contributes to air pollution load and nuisance noise. We own property adjacent to the lot in question and wanted to become more educated about the issue before attending the hearing. Our understanding is that the Warners are applying for a special permit to continue operating their commercial oil business in an agricultural neighborhood. If the Warners are granted a special permit to continue operating, how would that affect the following factors: 1. Timeline for paving County Road 3 (their semi trucks kick up much more dust than residents' cars) 2. Requirements for managing the Canadian Thistle infestation (their lack of weed control in the past has led to a significant spread of noxious weeds into our hayfield that we have not yet been able to adequately control) 3 . Likelihood of needing to move or work on the supply line that runs through our property but is not within the required easement (our excavator found the supply line the hard way while digging our water line) In general, we are fine with the Warners keeping their Gas Support Facility as is, but would like to know how the ongoing effects of its presence could be affected by being granted a special permit, and whether we can ask for improved management of the property as a requirement of receiving the permit. My husband, James Skeen and I both planned on being in attendance, however James is currently on an out of state business trip and I am attending a funeral of a friend of ours. I was however in attendance at the hearing that was supposed to take place on January 16, 2008, but was cancelled. I wanted to be able to voice the concerns of both my husband and myself about the landowner's request being made for a site-specific development plan and use for an oil and gas support facility to be located across the street from our house. When we moved into our house,the industrial filling station was operating illegally. 18- wheeler trucks came in and out of this station all day long. Each time they came and went, so did the dust that filled our house. We had to keep all windows shut in attempt to keep at least some of it out. Some days, it was hard to be out in our yard because so much dust filled the air, making it hard to both breath and to see. Not only was the dust a problem for us, but also the sight of the trucks, the smell of diesel fuel and the sound of • engines running were all very annoying. When we built our home, we paid a certain amount of money to have the road paved to our entrance of the sub-division. We have concerns that this will never happen if this site is approved. We simply can't imagine what it might be like to live here if this site is approved. It was bad before, but I am sure with the enlargement planned for this facility, it will most assuredly become much worse. We also believe this will negatively impact our property values in a substantial way. It is our desire that you do not approve this proposal. We appreciate your time and consideration in this matter.
