HomeMy WebLinkAbout20083016.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DAVID, KATHY AND MICHAEL NAAB FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, David, Kathy and Michael Naab, ZCV#0800179, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 18th day of November, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, David Naab, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 2, 2009, to allow adequate time for the property owners to remove all debris and complete the clean-up of the site to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. If the Zone district allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way. SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or other materials USED with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding uses. A SCREENING PLAN shall be submitted and approved by the Department of Planning Services. REMEDY - While the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES is an allowed use in the Agricultural Zone District, they must be completely SCREENED from all adjacent properties and public rights-of-ways; otherwise, they shall be restored or removed from the property. - The Weld County Code does allow a property owner to maintain 2 (two) semi trailers as storage units provided they do not deteriorate to a derelict condition and maintain current license plates. - I noted 2+ (two plus) mobile homes on the property; however, I have been unable to locate the necessary Zoning and Building permits which are required to maintain a mobile home. Hopefully by scheduling this out till the November Violation Hearings, this will allow you enough time to finish bringing the property into compliance. If you feel you have finished bringing the property into compliance, please call me to schedule a final inspection. RECOMMENDATION The Department of Planning Services recommends that this case be referred to the County Attorney's Office for immediate legal action. LETTER HISTORY 07/16/2008 Complaint Validated 07/16/2008 LTTR: 5 Day Letter 07/23/2008 LTTR: Violation Notice 09/29/2008 LTTR: Hearing Notification OTHER CASE HISTORY 07/16/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: several apparent derelict vehicles, 2+ mobile homes (can not find any permits for mobile homes) and semi trailers. No pictures were taken during this inspection. 07/21/2008 Phone Call David Naab (303-489-9801 cell) called. He said he does have a semi trailer(without tires or an under carraige) that he would not be able to get license plates for, does that have to be removed? I explained that it would. He asked about the Derelict Vehicles all being removed. I explained about installing a fence and how if he is proposing a standard wooden privacy fence (like what you would see driving through town); otherwise, a plan (hand drawn map) and a picture of the material he was proposing would need to be submitted so we could let him know if it was acceptable. He said most of the vehicles are just going to go to the shredder. He then said that the mobile home isn"t even his, someone just left it on his site some time. He doesn"t know who it belongs too. I told him that I would start with a 60 day letter and if he had made considerable (obvious) progress, I might be able to grant him a little additional Violation Summary Report time. He said okay. 09/26/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: Derelict Vehicles, Commercial Vehicles and mobile homes. No pictures were taken during this inspection. 10/06/2008 Phone Call David Naab called. He said he got my letter scheduling his case for November. He asked if it had been 60 day since we spoke already. I reminded him that it was in July when he and I spoke. He said time has just flown by. He said he has been unable to figure out who owns those 2 mobile homes. He said he may just go out and demolish them this weekend. He said he"s going to have to tear the semi trailer apart as well. He asked if there was anything else he had to do. I explained the definition of Derelict Vehicles. He said he doesn"t have any left on the property. He did say that his previous tenant had start constructing a gooseneck trailer. He said it wasn"t finished and his tenant took off (abondoned the property). He said he would tow it off to the scrap iron/metal yard as well. DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is partially or totally dismantled; has all or portions of its body work missing or is substantially damaged; does not have valid registration with the State, as required by Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper equipment to the extent that it would be unsafe or illegal to USE on public road rights-of-way or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm tractors or vehicles customarily operated in a FARMING operation. NONCOMMERCIAL JUNKYARD: An area where any waste,junk or used or secondhand materials are stored or handled, including but not limited to scrap iron and other metals, paper, rags, rubber tires, building materials and bottles. A NONCOMMERCIAL JUNKYARD may also include the storage or keeping of DERELICT VEHICLES registered last or currently registered under the property owner and/or tenant's name. This definition does not include COMMERCIAL VEHICLES. If the Zone district allows, the NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or STRUCTURE or visually SCREENED from all ADJACENT properties and public rights-of-way. SCREENED: Construction and maintenance of fences, earth berms or the USE of LANDSCAPING materials or other materials USED with the approval of the Department of Planning Services to lessen the noise, light, heat or visual impacts of a USE on surrounding uses.
