The applicant shall address and resolve with the Public Works Department the comments listed below prior to recording the Final Plat. Comments made during this phase of the final plan process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Final Plan Review o Weld County Public Works has received The Home Ranch Site PUD Proposed Road Improvements drawings, herein referred to as the Construction Drawings; The Home Ranch Plat; and The Home Ranch CR74 Widening Plan and Profile Exhibit drawings. Public Works also received The Home Ranch PUD Final Drainage Report, herein referred to as the Report. Public Works also received an updated access sheet for the site. All the above materials were received on April 23, 2008. o The Report, Construction Drawings and the plat have not been signed, stamped or dated by an engineer licensed to practice in the State of Colorado. • o The applicant is proposing an eight lot residential subdivision under PUD Development standards and procedures on approximately 35 acres north of and adjacent to WCR 74 between WCR 15 and SH 257. General Comments: The Drawing set and Drainage Report were well done, thank you for your effort, below are a few minor clarification items that need to be cleaned up. • Please resolve all redline comments in the Report, Construction Drawings and the plat. Plat: 1) Please provide all applicable reception numbers on the plat. External Roadways: Weld County Public Works has received The Home Ranch PUD CR74 Widening Plan and Profile drawing, and has the following comments: 1) Please provide a letter of understanding from the ditch company that future activities towards the full build out conditions of WCR 74 may impact the ditch crossing under WCR 74. 2) Please show all sight distance triangles in conformance with Green Book standards. 3) Please show that the proposed manhole for the Lee Lake Lateral pipe extension under WCR 74 will not adversely impact public safety being so close to the edge of roadway. Please provide Public Works with a blow up of this location for evaluation. This item was discussed at the April 28, 2008 meeting and an angle CMP fitting is acceptable at this location please include in the detail on the plan set. 4) Please follow current MUTCD guidelines for solid white striping. • 5) Please show the existing Lee Lake Lateral pipe in the profile view of CR-74 for clarification. See redlines for more detail. Drainage Report Comments: The Construction Drawings must be stamped, signed and sealed by a Professional Engineer licensed to practice in the State of Colorado prior to recording the Final Plat. The Report is dated April 2008. The following items must be resolved prior to recording the Final Plat: 1) Please address and resolve all red line comments in the Report. Pages with redlines are marked with an "X" in the lower right hand corner of the page. 2) Please include all applicable stamped drainage detail sheets in the map pockets of the Report. 3) A driveway culvert must be provided at the entrance to the Sterk's property. Please show this on the Construction Drawings and the Drainage Map and provide engineering calculations for this pipe. 4) All called out water surface elevations on the Construction Drawings and the Drainage Map must match those in the Report. Please see redlines. a) Please remove the water surface line on the Drainage Map that was the micro pool from previous submittals. 5) Please place the Low Tailwater Riprap Basin detail on a drainage detail sheet. *The submitted Private Road Maintenance Agreement will be reviewed under separate cover. • Recommendation The Public Works Department will continue the review of this final plan application upon receipt of the required items. The Sheriffs Office requests that builders and developers designate an area by the entrance of the sub-division in which to place a shelter for school children awaiting the school bus. This area should also include a pull off for the school bus which enables it to safely load and unload children out of the roadway. 2. Either mail distribution within the sub-division or a central drop off location within the sub-division • should be developed so that residents do not have to cross a county road to obtain their mail. 3. A permanent sign should be placed at the entrance to the subdivision detailing the name of the sub-division, address, and a graphical presentation of the roadways within the subdivision. There should be a plan developed to maintain this sign. 4. If the roadways within this sub-division are not maintained or adopted by the county, individuals purchasing property in this sub-division should be notified that the Sheriffs Office will have limited traffic enforcement powers. 5. A plan should be developed to maintain roadways within the sub-division especially during inclement weather conditions for emergency vehicles. 6. The Sheriff's Office is very supportive of homeowner funded homeowner's associations. These associations provide a contact for the Sheriff's Office and a means of maintaining common areas. 7. If there are oil or gas production facilities within this sub-division,they need to be fenced off in order to mitigate the potential for tampering. These facilities are known to create an attractive nuisance for young people. Tampering not only creates a significant danger to safety but also of environmental damage with extensive mitigation and clean-up costs. 8. The names of all streets within the sub-division should be presented to the Sheriffs Office for approval. This will eliminate duplication of street names within the county. 9. The Sheriffs Office encourages Law Enforcement Authorities to provide additional funding for law enforcement requirements in the future. •The Sheriffs Office lacks the ability to absorb any additional service demand without the resources recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as 1 indicated by growth not considered at the time the plan was developed. The subject property is located within the Town's Growth Management Area • (GMA) and is contiguous with the Town's corporate limits along the eastern property line, therefore,the property appears to be eligible for annexation to the Town. On the Town's Land Use Plan map, the subject property is delineated as Neighborhood and General Commercial along Harmony Road and High Density Estate Single Family Residential on the northern portion of the property. The proposed residential uses along Harmony Road are inconsistent with the Neighborhood and General Commercial land use depictions on the Town's Land Use Map. The referral materials indicate that the proposal is to be served by the North Weld County Water District and individual sewage disposal systems, however, the subject property is located within the Town's sewer service area. The Town adopted the East Side Sanitary Interceptor Plan(ESSIP) in 2002. The ESSIP design has been sized to serve all of the properties within the eastern and northern portions of the Town's GMA at the densities shown on the Town's Land Use Plan map, including the subject property. Implementation of the ESSIP has begun as the Town has extended sanitary sewer from the sewage treatment plant on the south side of the Cache la Poudre River to the north side of SH 392, where the line crosses the Winter Farm Subdivision to a point on WCR 19. From that point,the Greenspire Subdivision is currently extending the line across their property on the northeast side of Windsor Lake. Although the Town cannot commit to specific timeframes or dates at this time, there are several annexations that have • recently been approved that will conceivably continue the sewer extension to the west side of SH 257 and north. • Based upon the aforementioned information, the Planning Commission recommends denial of the PUD change of zone application, further recommending that the Weld County Department of Planning Services refer the applicant to Windsor for annexation and development through the Town's processes. Department of Public COLORADO Health and Environment CASE NO.: PF-1129 NAME: Chris Serbousek/Homestead PUD The Weld County Health Department has reviewed this final plat application for an 8 lot PUD on 34.97 acres. The application was previously reviewed under case number PZ-1129. The minimum lot size of 2.5 acres coupled with an overall density of one septic system per 4.3 acres does meet current Department policy. The equestrian activities and facilities have been eliminated from the development. Water The application has satisfied Chapter 27 of the Weld County Code in regard to water service. The application states that water will be supplied by North Weld County Water District. A water service • agreement has been included in the application materials, which has been updated to provide for 8 residential taps and 1 irrigation tap. Septic Sewer will be provided by individual sewage disposal systems. As the equestrian activities and facilities have been eliminated from the site, the Department is not requiring primary and secondary septic envelopes be placed on the lots. However, there is no language for the protection of absorption fields in the development Covenants. Add the following language into the covenants: Activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. There were no notes on the Final Plat. The Change of Zone was approved with the following conditions which should be included as notes on the final plat. 1. Water service shall be obtained from North Weld County Water District. 2. This subdivision is in Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. A stormwater discharge permit may be required for a development/redevelopment/ construction site where a contiguous or non-contiguous land disturbance is greater than or • equal to one acre in area. Contact the Water Quality Control Division of the Colorado 1 • Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. 4. During development of the site,all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration,the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 7. The applicant shall address and resolve with the Public Works Department the comments listed below prior to recording the Final Plat. Comments made during this phase of the final plan process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Final Plan Review o The Final Plan application for The Home Ranch PUD was received on February 12, 2008. o Weld County Public Works has received The Home Ranch Site PUD Proposed Road Improvements drawings, herein referred to as the Construction Drawings. Public Works also received The Home Ranch PUD Final Drainage Report, herein referred to as the Report. The Report also included a Drainage Area Map, herein • referred to as the Map. o The applicant is proposing an eight lot residential subdivision under PUD Development standards and procedures on approximately 35 acres north of and adjacent to WCR 74 between WCR 15 and SH 257. Important Comments: These comments are important to the safety of the general public and to the water rights of the downstream users of the irrigation ditch crossing the site. These comments shall be resolved before any plat can be recorded. ❑ The Report shows the existing culvert under WCR 74 to be a 24" CMP. Per a site visit by the Weld County Public Works staff on 28 March 2008,the culvert was measured to be an 18" CMP. Please correct all references and calculations associated with the culvert under WCR 74. • The capacity calculations for the WCR 74 CMP are incorrect. The head on this pipe will not be the water surface elevation of the detention pond. The orifice plate over the pipe inlet will restrict the water flow in the pipe to the 5-year historic flow rate. The outlet pipe for the detention pond is being shown as operating under outlet control conditions, and this may submerge the required orifice flow condition at the inlet of the pipe causing back water into the detention pond. Please correct all associated calculations and cross-check the outlet pipe and the WCR 74 pipe against this condition. • The outlet structure for the detention pond will need to be redesigned per Weld County Code. Please see item number 5 under Drainage Comments. • The Report shows the HW/D= 2.0 for the 10-year event and HW/D = 2.5 for the 100-year event of the 18" CMP under WCR 74. The design of this pipe shall meet the headwater to diameter ratios as set forth in the Weld County Code (Sec.8-11-40(2))or additional conveyance will be required. • PF-1129 The Home Ranch PUD(Final Plat)#1.doc Page 1 of 5 7 April 2008 • • ❑ Please provide all necessary agreements with the irrigation ditch owner(s). • Please provide a written and signed agreement with the irrigation ditch owner(s) for the proposed culvert(s)underneath Hannah Lane. • Please provide a written and signed agreement with the irrigation ditch owner(s) for the improvements to the inlet of the irrigation pipe under WCR 74 that will be impacted by the WCR 74 road improvements. General Comments: 1) Please add the following note to the text of the Final Plat, Final Construction Drawings and the Final Drainage Report: "Weld County will not be responsible for the maintenance of drainage related facilities." 2) The Weld County Road Access Information Sheet as provided by the applicant, dated 14 December 2007, states that there is only one (1) existing access, but the associated schematic shows the agricultural access on the east end of the property. Please resolve this issue by labeling this access as an agricultural access and revise the Road Access Information Sheet. a) As the applicant committed in prior meetings, please show on the plans how this access will be limited to agricultural traffic only as Lots 1, 2,and 3 of Block 2 border this access. 3) Weld County Public Works staff has not received any on-site improvements agreement, off-site improvements agreement or any other agreements. All agreements shall be supplied and signed prior to recording the Final Plat. a) As stated in the July 18, 2007, review memo from Don Dunker, Weld County Public Works, "The applicant shall submit Improvements Agreements According to Policy Regarding Collateral for (on-site) Improvements with the Final Plan application. These agreements must be reviewed by Public Works and shall be approved by the Board of County Commissioners(BOCC)prior to recording any Final Plat." • b) As stated in the July 18, 2007, review memo from Don Dunker, Weld County Public Works, "The applicant shall submit Improvements Agreements According to Policy Regarding Collateral for (off-site) Improvements with the Final Plan application. These agreements must be reviewed by Public Works and shall be approved by the Board of County Commissioners (BOCC) prior to recording any Final Plat." Please submit the required agreement. c) Merrick's May 21, 2007 response to the initial Change of Zone comments states that [Homestead PUD] The Home Ranch PUD has reached an agreement with the adjacent property owners to the east(Sterk) for a shared access that straddles the east property line. A formally documented access agreement showing the dimensions and location on the Plat is necessary. Please provide this document. d) As stated in the July 18, 2007, review memo from Don Dunker, Weld County Public Works, "Proposed Basin E is shown flowing undetained to the property to the east. Please provide written acceptance of these undetained flows from those property owners." 4) As requested in the July 18, 2007, review memo from Don Dunker, Weld County Public Works, please provide a construction detail of typical lot grading. Also, proposed septic envelopes shall be shown on the Construction Drawings. 5) As stated in the July 18, 2007, review memo from Don Dunker, Weld County Public Works, "Stop signs and street name signs will be required at all intersections and shown as a signing plan on Final roadway plans. The current edition of the Manual on Uniform Traffic Control Devices (MUTCD) shall govern the signing plan." 6) Please provide Public Works with location information, details and acceptance by the appropriate fire district(s)relating to the proposed gate to The Home Ranch. Plat: 1) Please show on the plat drainage easements for all swales. See redlined Plat. • 2) Please ensure that the entire detention pond is inside of a drainage easement. PF-I129 The Home Ranch PUD(Final Plat)#1.doc Page 2 of 5 7 April 2008 V • External Roadways: Weld County Public Works has received The Home Ranch PUD CR74 Widening Plan and Profile drawing, and has the following comments: 1) Weld County has reviewed the proposed vertical curve alignment to WCR 74. WCR 74 currently carries 8996 ADT and is a strategic arterial road with a posted speed limit of 55 miles per hour and requires a 140- foot right-of-way at full build out. Forty feet of additional right-of-way(ROW)has been deeded on the Final Plat from The Home Ranch PUD. a) Public Works has concerns regarding the contructibility of the proposed vertical curve profile for WCR 74. Please address the following considerations: i) There is an irrigation crossing at approximately Sta 17+75. Address this irrigation structure. Please provide documentation from the irrigation owner(s) for any construction involving this structure. ii) Please show the impacts of the proposed vertical profile to adjacent properties. Please see the redlined plans. iii) Please show the impacts that full build out conditions will have on utilities along WCR 74. b) Please address impacts of the proposed vertical alignment and full build out road width on the proposed detention pond for The Home Ranch PUD. Internal Roadways: 1) Please correct the cul-de-sac radius for all three cul-de-sacs in the Final Construction Drawings. These radii shall be fifty(50) feet to edge of pavement with a 65 foot right of way. (Sec. 24-7-20(A)14) Final Geotechnical Report Comments: 1) Weld County Public Works has not received a Final Geotechnical Report for The Home Ranch PUD. Please • provide this report for review. 2) Final pavement designs for the internal and WCR 74 road improvements shall be prepared by a professional engineer licensed to practice in Colorado. Construction Plans: The Construction Drawings must be stamped, signed and sealed by a Professional Engineer licensed to practice in the State of Colorado prior to recording the final plat. 1) Please address and resolve all red line comments in the Construction Drawings. 2) Public Works has received The Home Ranch PUD internal road plans and profiles. The Construction Drawings set was incomplete. Please provide the site grading plan, drainage plan, culvert details, pond details, pond outlet details, WCR 74 improvements and associated details, typical road cross sections, utility locations and any other details necessary for the construction of the subdivision. 3) The Construction Drawings show only 0.61 feet of cover over the 18" CMP under the entrance to The Home Ranch. Please provide adequate cover over this pipe or consider another possible solution, such as a concrete pipe. 4) Please show the location of the existing access to the Sterk property on the Construction Drawings. Drainage Report Comments: The Report is stamped and signed by Sacremento Ayala, P.E. (#26663, Colorado). The Report is dated January 2008. The following items must be resolved prior to recording the Final Plat: 1) Please address and resolve all red line comments in the Report. Please provide manufacturer specifications for this pipe or consider using a standard available shape and size. Please address roadway loading, it should be HS-20 minimum. 8) Please show calculations and details for the CDOT Type C inlet between the proposed 24" CMP pond outfall pipe and the 18" CMP under WCR 74. The theoretical capacity of a CDOT Type C inlet is reduced to 50%. (Sec.8-11-30(45)) Provide calculations to verify that this inlet will not surcharge. a) Weld County will not maintain this inlet. Please provide a maintenance schedule for this structure by The Home Ranch PUD IIOA. 9) All channels shall be designed to be stable under all flow regimes. District Wildlife Manager Troy Florian made a site visit to the parcel. In this letter you will find our comments concerning the proposal. The site is located north of and adjacent to WCR 74 and 1/4 mile east of WCR 15. The parcel appears to be a mixture of short to mid grass field adjacent to ground that is used for cultivated agriculture. If the parcel is divided for residential purposes and ultimately developed into residential purposes,the CDOW recommends that: • Ground-breaking construction occur between August 15 and April 1 to prevent the destruction of nesting wildlife. • Noxious weed and re-vegetation management plans are developed and implemented in areas where there will be ground disturbance due to construction activities. • Any fences built are recommended to be three or four strand fencing with a bottom strand height of 17 inches and a maximum top strand height of 42 inches, along with installation of double stays between posts. • Leash covenants are used in the development. • Future homeowners are made aware of traditional land uses that may impact them. • Future homeowners are made aware of nuisance wildlife in the area. Ground-breaking Construction. The landscape in this area is desirable nesting habitat and can contain a large number of different species of small birds. Most species of small birds are primarily ground nesting birds, although some species nest in trees or bushes. Some of these species are permanent residents while others are migrants or summer(breeding)residents. Many of these small birds are categorized as neo-tropical. Neo-tropical species are experiencing drastic population declines and the CDOW is concerned about any activities that could negatively impact them. All of the ground-nesting birds in this area could be subject to habitat loss, displacement and disturbance from future construction or development. It is possible that human activities around nest sites during critical nesting periods can have significant negative impacts. In regards to ground-nesting birds in the area, it is recommended that any ground breaking construction that takes place on the proposed area occurs before • April 1 and after August 15 to minimize any impacts that human activity may have on these ground nesting birds. USFWS staff recommends this as well as a way of avoiding violation of the Migratory Bird Treaty Act. Weed Management. Noxious weeds reduce property value and wildlife habitat. With new construction taking place and machinery being transported from one site to another, it is important to help prevent the spread of noxious weeds. Equipment should be cleaned periodically to remove weed seeds even if no weeds are recognized. It is recommended that noxious weeds are actively eradicated. A working weed management and disturbed area reclamation plan should be developed and implemented throughout construction and until all disturbed areas are properly re-vegetated to prevent erosion and invasions by weeds. The applicant may want to contact the Weld County Weed Inspector to facilitate development of reclamation and weed management plans for the development. Fencing. CDOW is concerned for the safety of the wildlife in the area if fences are erected, as some types of fencing can be dangerous and even fatal to wildlife. Therefore, we recommend that if any fencing is to be used within or around development sites,either during or after the project, it should be the type that would allow the free passage of wildlife. Fencing plans should avoid the use of woven wire type fences that will trap or prevent movement of wildlife. We prefers the use of three or four strand fencing with a bottom strand height of 17 inches and a maximum top strand height of 42 inches,along with installation of double stays between posts. Leash Covenants. The future residential development should include covenants that prevent domestic dogs and cats from running at large. Domestic dogs and cats roaming the open space in this area and adjacent property would have a definite adverse impact on wildlife in the area. Traditional Land Uses. As this area develops, it is important to maintain the legacy of traditional agricultural land uses. Hunting is one such activity that provides recreation and income to landowners and businesses along the 1-25 corridor. Waterfowl,doves and other small game species are hunted in this area. In fact,surveys indicate tothat Weld and Larimer Counties are among the most important in Colorado in the popularity of small game and waterfowl hunting activities. People travel from all over the United States to hunt waterfowl along the 1-25 corridor. Hunting is not only a recreational activity and economic asset, but also an important management tool used by the Colorado Division of Wildlife to manage wildlife populations. Hunting is used as the primary tool to balance wildlife populations with available habitat. With increasing rural development, it is advisable that new residents be informed of traditional land uses, such as hunting,occurring on adjacent land that may impact them. Living with Wildlife. It is recommended that future homeowners are made aware of nuisance animals that are found in rural areas. Coyotes, raccoons, skunks,foxes and prairie dogs can all potentially present problems for landowners. Homeowners should be made aware of the potential problems that coyotes and skunks can cause with domestic dogs and cats. The new homeowners should be made aware that it is their responsibility to prevent and handle any problems that may arise. The CDOW has brochures available for homeowners that talk about living with wildlife and will also be happy to give suggestions on how to prevent any potential problems.
