This site plan review is approved with the attached conditions:
1. The Site Plan Review Map shall be prepared in accordance with Section 23-2-160.V of
the Weld County Code. The applicant shall submit a paper copy of the plat for
preliminary approval to the Weld County Department of Planning Services. Upon
approval of the paper copy the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in
the office of the Weld County Clerk and Recorder by Department of Planning Services'
staff within 30 days of the approval and with payment of eleven ($11.00) dollars per

2. Prior to recording the Site Plan Review plat, the applicant shall address the following to
the Department of Planning Services' satisfaction:
A. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. Evidence of approval shall be submitted to the
Department of Planning Services. The plan shall include at a minimum, the
following:
1. A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2. A list of the type and volume of chemicals expected to be stored on site.
3. The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number). (Department of Public

completed property maintenance plan in accordance with Section 23-2-250.B.7
of the Weld County Code. The current maintenance plan is partial missing.

of Colorado Division of Wildlife, as stated in the referral response received
February 18, 2008. Evidence of such shall be submitted in writing to the Weld

M. The applicant shall submit evidence to the Department of Planning Services that
all conditions and requirements as indicated in the Department of Public Works
letter dated February 25, 2008 have been met. (Department of Planning

1. The applicant shall enter into an Improvements Agreement according to policy
regarding collateral for improvements and post adequate collateral for parking
and landscaping requirements. The agreement and form of collateral shall be
reviewed by County Staff and accepted by the Board of County Commissioners
prior to recording the plat. Or the applicant may submit evidence that all the work
has been completed and approved by the Department of Planning Services and

J. The plat shall be amended to delineate the following:
1. The Site Plan Review Plat shall be prepared in accordance with Section

The proposed thirty eight (38) parking spaces including three (3) spaces
• designed to meet the Americans with Disabilities Act are adequate to

identify a landing area for non-ambulatory users of this facility.

5. The applicant shall delineate the location of all curb stops in the parking

The applicant shall adhere to the lighting requirements for off-street
parking spaces per Section 23-4-30.E of the Weld County Code. The
applicant may desire to place building lighting on the north and east sides

7. The applicant shall adhere to the lighting standards, in accordance with
Section 23-2-250 and Section 23-3-250.B.6 of the Weld County Code.

8. The detail of the dumpster enclosure shall be added to the plat.

9. Additional landscaping is required along the east and north portions of the

10. The proposed sign shall be located outside the setback area.

The following notes shall be placed on the plat:
1. In accordance with the Weld County Code, no land, building or structure
shall be changed in use or type of occupancy, developed, erected,
constructed, reconstructed, moved or structurally altered or operated in
the Commercial/Industrial Zone District until a Site Plan Review has been
approved by the Department of Planning Services. (Department of

2. The application does not propose any portion of the site to be leased to
another party. In the event that a portion of the building or lot is proposed
to be leased to another party in the future, the applicant shall submit a
copy of the lease agreement and information regarding the proposed use
of the leased portion to the Weld County Attorney's office, Weld County
Building Inspection Department, Mountain View Fire Protection District,
ATF and the Department of Planning Services for review. Based upon
the proposed use and/or impacts of the leased portion, the Department of
Planning Services may require a new Site Plan Review application and/or

3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100, C.R.S., as amended), shall be stored and
removed for final disposal in a manner that protects against surface and

4. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid wastes Disposal Sites and Facilities

5. Waste materials shall be handled, stored and disposed of in a manner
that controls fugitive dust, blowing debris and other potential nuisance

6. The facility shall adhere to the maximum permissible noise levels allowed
in the Light Industrial Zone District, as delineated in 25-12-103, Colorado

7. Fugitive dust and fugitive particulate emissions shall be controlled on this

8. The applicant shall operate in accordance with the approved "waste

10. Bottled water shall be utilized for drinking and hand washing during

12. The facility shall utilize the existing municipal sewage treatment system.

14. All potentially hazardous chemicals must be stored an handled in a safe
manner in accordance with product labeling and in a manner that
minimizes the release of hazardous air pollutants (HAP's) and volatile

15. If applicable, the applicant shall obtain a stormwater discharge permit
from the Colorado Department of Public Health and Environment, Water

16. The operation shall comply with all applicable rules and regulations of the
State and Federal agencies and the Weld County Code. (Department of

17. No staging or parking of vehicles on Stagecoach Road will be allowed.

18. The historic stormwater flow patterns and run-off amounts will be
maintained on site in such a manner that it will reasonably preserve the
natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions,
concentration and/or unplanned ponding of storm run-off. (Department

19. Landscaping materials as indicated in the approved landscape plan shall
be maintained at all times. Dead or diseased plant materials shall be
replaced with materials of similar quantity and quality at the earliest

20. All structures, including signs, on site must obtain the appropriate building

21. Effective January 1, 2003, Building Permits issued on the lot will be
required to adhere to the fee structure of the Weld County Road Impact

22. Effective August 1, 2005, Building permits issued on the subject site will
be required to adhere to the fee structure of the Capital Expansion Impact
Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8

23. Buildings shall conform to the requirements of the various codes adopted
at the time of permit application. Currently the following has been
adopted by Weld County: 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003
International Fuel Gas Code; and the 2002 National Electrical Code and
Chapter 29 of the Weld County Code. (Building Department)
3. Upon approval by the Department of Planning Services, the Site Plan Review shall be
prepared per Section 23-2-260.D of the Weld County Code and submitted to the
Department of Planning Services to be recorded. (Department of Planning Services)
4. One month prior to construction activities:
A. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (4 CCR-1002-61). Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements
(new rule effective 3/2/2001). (Department of Public Health and Environment)
5. Prior to the release of building permits:
A. A Final Site Plan and building construction plans must be submitted to the
Mountain View Fire Protection District for review and approval. The applicant
shall submit written evidence of approval to the Department of Building
Inspection. (Mountain View Fire Protection District)

B. A plan review is required for each building for which a building permit is required.
Plans shall include a floor plan. Plans shall bear the wet stamp of a Colorado
registered architect or engineer. Two complete sets of plans are required when
applying for each permit. Provide a Code Analysis Data sheet provided by the
Weld County Building Department with each Building permit application.

C. Each building will require an engineered foundation based on a site-specific
geotechnical report or an open hole inspection performed by a Colorado
registered engineer. Engineered foundations shall be designed by a Colorado
registered engineer. (Building Department)
D. Building height shall be measured in accordance with the 2003 International
Building Code for the purpose of determining the maximum building size and
height for various uses and types of construction and to determine compliance
with the Bulk Requirements from Chapter 26 and Chapter 23 of the Weld County
Code. Building height shall be measured in accordance with Chapter 23 of the
Weld County Code in order to determine compliance with offset and setback
requirements. Offset and setback requirements are measured to the farthest

6. Prior to the release of the Certificate of Occupancy:
A. A final inspection of the occupancy will be required by a member of the Mountain

The proposed facility will use the domestic water supply solely for
bathrooms, and janitorial services. This water will be discharged to the

Standard practices for the HVAC system will be used, and will not emit

This site plan review is approved with the attached conditions:
1. The Site Plan Review Map shall be prepared in accordance with Section 23-2-160.V of
the Weld County Code. The applicant shall submit a paper copy of the plat for
preliminary approval to the Weld County Department of Planning Services. Upon
approval of the paper copy the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval. The Mylar plat shall be recorded in
the office of the Weld County Clerk and Recorder by Department of Planning Services'
staff within 30 days of the approval and with payment of eleven ($11.00) dollars per

Re: Waste Handling Plan:
The waste generated in our sales and general areas will be office and retail-type trash
which will be picked up by a local trash collection company on a weekly or as-needed basis.
Waste Connections of Colorado is the dominant service provider in the area, we will most likely
contract with them as we have worked with them in the past. Our used cardboard target backers
will be recycled with other cardboard items through this general service provider.
Several companies in the precious metal recycling business have been contacted and have
offered to purchase the lead and brass that will be acquired from range use. We have attached a
copy of the letter from Joe Carpender of All Recycling and Jon Cymes of Rocky Mountain
Recycling, we anticipate that we will work with one of these companies for this recycling
process. Anticipated quantities of on site generated recyclable materials are as follows:
1,000-2,000 pounds of lead per month
500-700 pounds of brass per month
Lead is collected through the trap system that will be installed in every range. The lead
bullets that are fired through the range will all be collected into an Savage Range Bullet Trap
System. These systems are specifically designed to capture 100% of the lead projectile. The
bullet is funneled through a deceleration chamber and is deposited into a barrel that can be easily
changed out once it is at its designated weight or volume. These barrels will be stored covered
and indoors(collection area)until they are taken to/by the approved recycling company.
Brass is collected from the spent casings of the ammunition used by our patrons in the
range. Typically the spent casings are on the floor in the shooting area of the range and are swept
up regularly and deposited in designated barrels also located in the shooting area. Once the
appropriate volume is reached in the designated barrel, the barrels will be transferred to the
collection area awaiting recycling collection.
Chemicals will not be stored or used on-site other than general cleaning supplies
which would be similar to that stored by other typical retail and service businesses.
These products will be stored in our janitorial closet located in the main retail area of the
building.

Re: General Requested Information,Business Operations
Ammunition will be for sale in the retail portion of our business. This is unregulated by Bureau
of Alcohol, Tobacco, Firearms and Explosives (B.A.T.F.E.). All ammunition will be stored and
in factory containers in our storage areas other than that which is on the shelves for daily sales.
Anticipated quantities of ammunition: fifty (50) cases of ammunition in various calibers. This
amount may change based upon demand once the facility is open for business.
Contact with the B.A.T.F.E has been made and we received an email response from Daisy
Correa, Customer Service Specialist with the U.S.D.O.J./B.A.T.F.E. (copy attached). The A.T.F.
has no regulations concerning indoor or outdoor gun ranges—only the sale of firearms will apply
to us. We have received our application for a Federal Firearms License, but have to have the
building permit issued in order to submit that application to them. This is the only requirement of
B.A.T.F.E.for our business and facility.
We contacted the Colorado Attorney General's office and were directed to the Colorado Revised
Statutes. After much research, it appears that there are no regulations for an indoor shooting
range. Please see attached references to shooting ranges from the Statutes.
The State Police(Colorado State Patrol)were also contacted and we were told that this would fall
within the City/County jurisdiction and we should contact them. The Weld County Sheriff's
Office has already reviewed our Site Plan Review Application through our initial submittal and
have no apparent issues.
Our Business Plan is as follows: we plan to be open Tuesday thru Saturday from 9 a.m. to 8 p.m.
and closed on Mondays for the opportunity of leasing to local police/sheriff and/or training
We will have to have three to four full-time employees to cover the retail area as well as the
ranges. We will also have part-time employees on a seasonal,as-needed basis.

SAFETY PLAN
Safety is the top priority at Trigger Time Gun Club. There will be no exceptions!
Our Safety plan is two-fold: the range must be safe and operated in a safe manner at all times,
and the members must shoot safely at all times.
Not only is our air handling system exceeding OSHA requirements, we are using a wet bullet
trap system which will eliminate lead dust in the air. We will clean the range each night after
we close for business. We also will recycle all of the lead and brass collected.
Each of our staff members is a shooter with many years experience and are thoroughly familiar
with all aspects of shooting safety. Our range will be monitored with security cameras at all
times.
Membership to the club is contingent upon reading and agreeing in writing to abide by the
safety rules, which are clearly posted. Affordable introductory courses are available for novice
shooters,as well as additional courses for intermediate and advanced shooters.
Any member, guest, or student who engages in unsafe practices may immediately forfeit
membership in the club, along with all shooting privileges. The final decision is left up to the
senior staff persons direction.
Unsafe practices include, but are not limited to, careless shooting, unsafe firearms handling,
and disruptive behavior. The initiation fee and dues will not be refunded if membership is
revoked for unsafe practices.
TRIGGER TIME GUN CLUB SAFETY RULES
1. Shooting safety is ultimately the responsibility of each individual member, guest,
and student. Trigger Time Gun Club does its utmost to promote and ensure safe
gun handling, but must rely on the members to bring unsafe behavior and
situations to the staff's attention.
2. All members and their guests are required to conduct themselves in a sensible,
responsible, safe manner at all times. Unsafe, disruptive, disrespectful, or unruly
behavior is not tolerated. Members are responsible for the behavior of their guests.
3. There is no age limit for children, as long as parents ensure the club's high safety
standards are upheld. If there is any doubt about a child's safe gun handling skills,
the parent must be directly supervising the child at the shooting position.
4. Members are responsible for the safety and proper functioning of their firearms and
ammunition,as well as their appropriate use.

5. Sight and hearing protection are required on the range at all times.
6. Firearms may be brought into and taken out of the building in the following
manner:
• Holstered: loaded or unloaded and must be concealed. Holstered firearms may
not be drawn until the club member or guest is on the firing line.
• Boxed, bagged, or otherwise completely enclosed: unloaded only.
• Unboxed, unbagged, or otherwise unenclosed firearms may not be carried in-
hand, loaded or unloaded, in any portion of the building. Carrying a loaded
firearm unholstered anywhere on the premises will result in the immediate
revocation of membership.
7. Trigger Time Gun Club reserves the right to inspect firearms and ammunition for
safety purposes prior to allowing their use in the facility. Use of armor piercing and
tracer ammunition is prohibited since they can damage the backstops.
8. On the range, all firearms must be kept on the individual shooting positions, in
boxes or other closed containers, or holstered at all times. Guns at the shooting
positions must be positioned with muzzles facing the backstops. Shooters may
reload magazines at the tables behind the shooting positions; all unboxed and
unholstered firearms, however, must remain on the individual shooting positions
with muzzles pointing downrange.
9. Members are expected to sweep up their fired cartridge cases before leaving the
range, since they constitute a hazard underfoot. Containers are provided for brass
recycling; alternatively, members may simply sweep empty cartridge cases forward
from the shooting line. Shooters whose cartridge cases fall behind the shooting line
may take them home for reloading. Cartridge cases that fall in front of the firing
line may not be retrieved, but become the property of Trigger Time Gun Club, and
are recycled.
10. Targets must be taped to cardboard backing sheets provided by Trigger Time Gun
Club. Small targets must be positioned with their centers at the member's shoulder
height to prevent damage to the baffles and floor. It is the shooter's responsibility to
ensure that all rounds land in the steel bullet trap.
11. Only one door to the sally-port (the small rectangular room between the retail area
and the range) may be opened at a time, since gunfire is injurious to human
hearing.
12. All ammunition used in Trigger Time Gun Club rental firearms must be purchased
from the club.
13. Rental firearms are reserved for the exclusive use of Trigger Time Gun Club
members and their guests, as well as students enrolled in Trigger Time Gun Club
training classes. Damage to rental firearms or associated accessories such as laser
sights is the responsibility of the member.
14. Member and guest use of the range may be limited to one hour and one lane for
handgun and two hours for rifle during peak use periods. Trigger Time Gun Club
accepts reservations from members in good standing by telephone, in person, and
through this web site.
15. Members who experience problems with firearms while on the firing line are
required to leave their firearms at the firing line, pointed downrange, and seek
assistance from Trigger Time Gun Club staff. No firearm, loaded or unloaded, may
be carried by hand from the firing line or anywhere else in the building at any time
for any reason.
16. All damage to the building, including range facilities, through accidental or
negligent actions is the financial responsibility of the member.

17. Trigger Time Gun Club reserves the right to revoke any membership at any time for
any violation of a posted safety policy by the member and/or his or her guest

required by the B.A.T.F.E. regulations.
20. Firearms left for repair overnight or longer must be retrieved by the same person
who left them for repair. If the person who left them for repair presents a signed
release, another person may retrieve them, but a B.A.T.F.E. form 4473 and
background check are required by law to release the firearm.

Thank you for contacting the ATF's Federal Firearms Licensing Center (FFLC) with your e-mail inquiry.
ATF's concerns pertaining to indoor or outdoor firing ranges are based on the Gun Control Act (GCA),
rather than on the entire range of laws, including State laws, that are relevant to firing range
enterprises, whether indoor or outdoor. Thus,you would need to contact State and local law
enforcement authorities such as the State Police or the Office of the Attorney General, for general
information about shooting ranges in your State, including physical specifications and any State
regulations dealing with firearms permits or registration that would affect a shooting range enterprise.
ATF does not register conventional firearms or issue permits for ordinary long guns or handguns.
With respect to the GCA, ATF jurisdiction would pertain to the acquisition or sale of any firearms
involved in this business. If sales or similar transfers of firearms will be involved, you must obtain an
application for a Federal firearms license (FFL). I will mail you an application package.
Since loans or rentals of firearms may be planned, you should be aware that the GCA does allow clubs,
associations, or similar organizations to authorize persons to target shoot temporarily on association
premises without the need of an FFL and without licensee recordkeeping requirements such as
completion of 4473 firearms transaction documents. This provision is also applicable to private firing
range businesses that do not have FFLs. (See Code of Federal Regulations, Section 478.97, Loan or
Rental of Firearms).

Per our telephone conversation this morning, I would like to know what, if any, regulations the ATF has
for indoor gun ranges. I am in need of this in writing to obtain my building permit. I am aware of our
need to get an FFL to sell, trade or buy firearms. I would also like to request that an application for our
FFL be mailed so that we can get it submitted as soon as we get our building permit. How long does this
process usually take, and can we get it before our building is complete so as soon as we open we can
have our rental fleet of guns?

25-12-109. Exception - sport shooting ranges - legislative declaration.
(1) The general assembly hereby finds, determines, and declares that the imposition of inconsistent,
outdated, and unnecessary noise restrictions on qualifying sport shooting ranges that meet specific,
designated qualifications work to the detriment of the public health, welfare, and morale as well as to the
detriment of the economic well-being of the state. The general assembly further finds, determines, and
declares that a need exists for statewide uniformity with respect to exempting qualifying shooting ranges
from the enforcement of laws, ordinances, rules, and orders regulating noise. As the gain associated with
having a uniform statewide exemption for qualifying sport shooting ranges outweighs any gains
associated with enforcing noise regulations against such ranges, the general assembly further declares
that the provisions of this section, as enacted, are a matter of statewide concern and preempt any
provisions of any law, ordinance, rule, or order to the contrary.
(2) As used in this section, unless the context otherwise requires:
(a) "Local government" means any county, city, city and county, town, or any governmental entity,
board, council, or committee operating under the authority of any county, city, city and county, or town.
(b) "Local government official" means any elected, appointed, or employed individual or group of
individuals acting on behalf of or exercising the authority of any local government.
(c) "Person" means an individual, proprietorship, partnership, corporation, club, or other legal entity.
(d) "Qualifying sport shooting range" or "qualifying range" means any public or private establishment,
whether operating for profit or not for profit, that operates an area for the discharge or other use of
firearms or other equipment for silhouette, skeet, trap, black powder, target, self-defense, recreational or
competitive shooting, or professional training.
(3) Notwithstanding any other law or municipal or county ordinance, rule, or order regulating noise to
the contrary:
(a) A local governmental official may not commence a civil action nor seek a criminal penalty against a
qualifying sport shooting range or its owners or operators on the grounds of noise emanating from such
range that results from the normal operation or use of the qualifying shooting range except upon a
written complaint from a resident of the jurisdiction in which the range is located. The complaint shall
state the name and address of the complainant, how long the complainant has resided at the address
indicated, the times and dates on which the alleged excessive noise occurred, and such other information
as the local government may require. The local government shall not proceed to seek a criminal penalty
or pursue a civil action against a qualifying sport shooting range on the basis of such a noise complaint
if the complainant established residence within the jurisdiction after January 1, 1985.
(b) No person may bring any suit in law or equity or any other claim for relief against a qualifying sport
shooting range located in the vicinity of the person's property or against the owners or operators of such
range on the grounds of noise emanating from the range if:
(I) The qualifying range was established before the person acquired the property;
(II) The qualifying range complies with all laws, ordinances, rules, or orders regulating noise that
applied to the range and its operation at the time of its construction or initial operation;

(III) No law, ordinance, rule, or order regulating noise applied to the qualifying range at the time of its

13-21-111.8. Assumption of risk- shooting ranges.
(1) Any person who engages in sport shooting activities at a qualifying sport shooting range, as defined
under section 25-12-109 (2) (d), C.R.S., assumes the risk of injury or damage associated with sport
shooting activities as set forth in section 13-21-111.7.
(2) For purposes of this section, "engages in sport shooting activities" means entering and exiting a
qualifying sport shooting range, preparing to shoot, waiting to shoot, shooting, or assisting another
person in shooting at a qualifying sport shooting range. The term includes being a spectator at a
qualifying sport shooting range and being present in the range for any reason.

the following comments have not been addressed.
* A final drainage letter stamped, signed, and dated by a professional
engineer licensed in the State of Colorado will be required.
* Final drainage construction and erosion controls plans (conforming to the final
drainage report) stamped, signed, and dated by a professional engineer license in the
State of Colorado shall be submitted with each plan (phase) . These plans (storm water
management plans) shall be based upon urban drainage methodology.
* Please show how water will be safely conveyed to the regional detention pond without
creating a public safety burden, and without causing erosion on existing stormwater
facilities.
These have to be addressed prior to sign off from Public Works.

Weld County Public Works Department has reviewed this Site Plan Review request. Comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process.
Comments
External Roads: The external roadways are capable of handling anticipated traffic from the proposed facility.
Weld County Road Classification Plan (FHU): (June 2002)
❑ Stagecoach Road is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a
60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning(23-1-90), the required setback is measured from the future right-of-way line.
COMMENTS:
Access: The access is from Stage Coach Road. The internal roads are county maintained in the Western Dairymen
subdivision.
REQUIREMENTS:
MUD: The Western Dairymen Subdivision is located within the MUD. All MUD standards should be applied towards
the Site Plan Review.
Access: The applicant indicated 1 proposed access point on to Stage Coach Road but did not indicate width. The
accesses shall have adequate turning radiuses and the grade of the internal road system shall match the grade of the
County Road.
Storm Water Drainage: The applicant has provided information on how storm drainage will be handled in accordance
to"regional" drainage report.
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably
preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and
velocity increases, diversions, concentration and/or unplanned ponding of storm run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best management
practices.
A final drainage letter stamped, signed, and dated by a professional engineer licensed in the State of Colorado will be
required.
Weld County will not maintain drainage related areas, medians, and this must be addressed by the homeowner's
association or owner.

Final drainage construction and erosion controls plans (conforming to the fins' rainage report) stamped, signed, and
dated by a professional engineer license in the State of Colorado shall be submitted with each plan (phase). These plans
(storm water management plans) shall be based upon urban drainage methodology.
Please show how water will be safely conveyed to the regional detention pond without creating a public safety burden,
and without causing erosion on existing stormwater facilities.
Circulation and Parking: The site plan drawing shows good circulation patterns and parking bases.
Within the MUD Standards, the off-street parking and the access drive, curb, gutter, and sidewalk shall be surfaced with
asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems.
All parking for the site must be off street and internal. Each parking space shall be equipped with wheel guards or curb
blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into
contact with other vehicles, walls, fences or planting.
ADA requirements shall be met for this site. Parking Lots shall conform to all standards of the Americans with
Disabilities Act. Public Works recommends striping of the parking to identify the ADA space(s) with the appropriate
symbols and signs.

Environmental Health Services has reviewed this proposal for an indoor shooting range.
The site is served by Left Hand Water District for water provisions and Saint Vrain
Sanitation District for sewage disposal.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
• 1. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirement be incorporated into the permit as a
condition that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61) Alternately, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
(New rule effective 3/2/2001).

We recommend that the following requirements be incorporated into the permit as
development standards:
1. All potentially hazardous chemicals must be stored and handled in a safe manner
• in accordance with product labeling.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Light industrial Zone as delineated in 25-12-103 C.R.S., as amended. However,
the operation shall comply with all applicable State noise statutes and/or
regulations.
8. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility at all times.
9. Adequate toilet facilities (portable toilets) shall be provided during the
construction of the facility.
10.The facility shall utilize the existing municipal sewage treatment system. (Saint
Vrain Sanitation District)
11.The facility shall utilize the existing public water supply. (Left Hand Water District)
12.Bottled water shall be utilized for drinking and hand washing during construction
of the project.
13.If applicable, the applicant shall obtain a stormwater discharge permit from the

The Colorado Division of Wildlife (DOW)has reviewed the applicant's request for an indoor shooting range
including retail, sales, and safety training facility. We offer the following comments and recommendations
regarding wildlife.
Under current land use conditions we would expect to find a variety of species on the site. Mammals including,
but not limited to: coyotes, foxes, raccoons,rabbits and black-tailed prairie dogs as well as avian species
including, but not limited to: songbirds and raptors such as bald eagles, red-tailed hawks and american kestrels
may use a portion of the current site area for their individual habitat requirements.
Prairie Dogs
Prairie dogs are an important food source for hawks,Bald Eagles and coyotes. Removal will likely create food
stresses to these species.
Trapping/transplant efforts or euthanasia are legal options if prairie dog removal is desired.
• It is recommended that prairie dogs he removed only where necessary
• Prairie dog removal on this site should be required prior to development or construction work begins
• Euthanasia efforts must occur through the use of approved toxicants and trapping/transplanting of prairie
dogs requires prior approval of the DOW and may require approval from the county commission
• Note that bulldozing active prairie dog colonies is not an acceptable method of removal
Birds
Burrowing Owls, a species listed on the Colorado Threatened Species List, are known to occur within Weld
County and rely on prairie dog burrows as critical nesting habitat. As a migratory species and a raptor, both the
USFWS and the Colorado Division of Wildlife protect Burrowing Owls.
The critical nesting period for Burrowing Owls occurs between March 1 and October 31. When confronted with
human disturbance near nest sites, Burrowing Owls abandon the nest. Efforts to relocate nesting owls have

generally proven to be ineffective. If possible, construction in and around prairie dog colonies should be
sequenced to avoid critical nesting periods for Burrowing Owls. If it should be necessary to break ground during
the critical nesting periods for Burrowing Owls, impacted prairie dog towns should be surveyed for Burrowing
Owls by a biologist certified for such work prior to onset of construction. If owls are found to occupy prairie dog
towns, the active burrows should be protected as specified by accepted guidelines. The Division of Wildlife can
provide specifics upon request.
DOW identifies Bald Eagle activity near Boulder and St. Vrain creek's approximately 0.7 miles away. This
activity includes a large communal roost site, other roost sites,summer and winter forage areas, and a winter
concentration area. It is recommended that all mature cottonwood trees remain undisturbed.
Concerns regarding Construction Equipment
With new construction taking place and machinery being transported from one site to another, it is important to
help prevent the spread of noxious weeds. Noxious weeds reduce property value and wildlife habitat. Care
should be taken to avoid spreading and introducing noxious weeds. Equipment should be cleaned periodically to
remove weed seeds even if no weeds are recognized. The area should be promptly revegetated using native
species to prevent erosion and invasions by weeds. It is also recommended that a weed management plan be
developed for during construction and for at least 5 years after construction.

Hi Jacqueline,
Thank you for the referral regarding the proposed indoor shooting range. Please extend our welcome to the applicant and our
appreciation for bringing business to the area. We hope the applicant will join the area Chamber and work with local law
enforcement.
Upon review of the proposed Site Plan the Town requests that the County and Developer consider the following:
1. In accordance with the Towns Code, the general parameters outlined in the uniform design principals IGA, and the
Town's goal of annexing this area at some point in the future, please consider the following:
a. Please add a note to the site plan that the subject property is within the Town of Frederick's planning area and tht
annexation to the Town of Frederick is anticipated if and when contiguity occurs.
b. Please distribute trees and shrubs around the perimeter of the property, including the eastern and northern
boundaries as well as western edge of parking to soften views to and from adjacent developments, break up the
mass of the facade, and increasing energy efficiency and further screen parking areas.
c. While we anticipate that this business will be very successful, the interior and exterior of the structure should be
designed for flexibility in the event that the business relocates and other uses fill the space. Accordingly, please
articulate the entry and windows with an awning and columns and or other architectural treatments to break up till
mass of the facade, delineate the entry, and promote a sense of scale.
i. Please add a horizontal band and /or other articulation (recessed areas) to the structure for greatE
interest, architectural variation, or shadow to further soften the mass of the facade. This could consist
of material transitions, color transitions, and / or texture transitions and recessed areas and should be
applied all exterior sides of the structure.
d. As this area continues to urbanize connectivity with adjacent developments will be more critical. And as noted
above, designing for flexibility may extend the economic viability and options for the applicant in the future. Pleas
provide and connect the entry/entry plaza to the existing sidewalk with an ADA accessible route per the ADA
requirements for new construction. Perhaps the installation of a sidewalk within the eastern landscape island
plaza connecting to the existing sidewalk along Stagecoach Road would be the most efficient means of providing
an accessible route between the entry and the perimeter sidewalk while serving the ADA parking area, and
providing for flexibility of uses. This could also reduce the potential for conflicts between vehicular and pedestriar
traffic.
i. Please install curb cuts as necessary and a sidewalk connection between the entry plaza that
serves the proposed handicap parking and a link to the existing exterior sidewalk. Please add details
for the ADA accessible ramps and detectable warnings to the drawing set.
H. The handicap parking stalls are shown differently on different sheets—please revise per the intent
and applicable requirements.
e. Please consider extinguishing non-essential exterior lighting one hour after the end of business hours and no
sooner than one hour before opening. You may also consider lighting along the north and eastern sides of the
structure for greater security.
f. The landscape notes appear to be cut-off or incomplete (sheet 2 of 4).
Please note that businesses within the Town of Frederick may be able to assist in the construction. We also have several
excellent contractors that could assist in construction of this facility. For additional information please contact Linda Blount or
Kathy Larson at 303-833-2388 for a list of Frederick's businesses and contractors or the Tri Area Chamber for a list of area
businesses and services.
Upon implementation of the items mentioned above, the development will be consistent with the Town's adopted
Comprehensive Plan. The Town has no further comments regarding the proposed development.

Dear Ms. Hatch:
I have reviewed the submitted material for the indoor shooting range proposed for construction in
the Western Dairymens Subdivision on Stagecoach Road — South in Weld County (Case Name:
Frontier Companies, Case Number: SPR-417) and shall make the following comments with
regard to the plans:
• The total building, with the future second floor, will be approximately 21,000 square feet in
size. Water supply for fire protection is not adequate unless the building will be provided
with a fire sprinkler system or the building will be provided with firewalls and the
construction type be non-combustible for certain portions of the building. I have met with
the architect and we have determined that fire sprinklers are not an option as sprinkler
piping and sprinkler heads do not fair well with bullets. As this is the case firewalls are an
option, so it will be very important that the Fire District review building construction plans
before building permits are issued so that we can see that firewalls are going to be provided
even though the Building Code would not necessarily require them. Additionally, the
largest portion of the building (riffle range) must be of rated type of construction, as will
also be mentioned below, to reduce fire flow for that portion of the building to a level that
is available in the street. Having said that, if the requirements regarding fire flow can be
met, the proposed fire hydrant on the property will not be necessary,as the fire hydrants on
the street meet our distance requirements to the building.
• Fire apparatus access to the building is not adequate on the north side. As fire sprinklers
are not an option, again it will be important to see building construction plans as this
portion of the building will need to of Type 1 A or 1B rated construction with the north
wall having no openings even though the Building Code may not require it. Otherwise
access is adequate as indicated on the plans submitted.
• Building construction plans and the final site plan showing a code analysis which
includes, the gross square footage of the building, the building construction type, and
occupancy classification(s)must be submitted to the Fire District for review and approval
before building permits may be issued.

OPERATING AGREEMENT
LUCKY STARS CAR WASH, LC
This Agreement made effective July 2, 2002 betty en JoEllen L. Gonzales and Paul
Gonzales, as joint tenants hereinafter referred to as "member" a d Lucky Stars Car Wash, LLC,
hereinafter referred to as the "LLC".
I. INTRODUCTION
The parties have formed a limited liability company for the purpose of owning and
operating a business. The rights and obligations of the LLC and the members shall be provided in
the Articles of Organization and this Operating Agreement.
II. PLACE OF BUSINESS
The principal place of business of the LLC shah be 1716 S. Horseshoe Circle,
Longmont, CO 80504 or such other address to which the busikntess may from time to time be
moved.
III. DURATION OF THE LL
The LLC shall commence operations on July 2, 2 02 and shall continue thereafter
unless terminated sooner by operation of law or by agreement bet een the parties.
IV. CAPITAL CONTRIBUTIO S
The undersigned members have made capital cunt 'butions to the LLC according to
the percentage of their ownership. Each member owns an undiv ded interest in the business and
company as follows:

V. ADDITIONAL CAPITAL CONTRIBUTIONS
A. The members shall contribute in proportionat' amounts any additional capital
deemed necessary for the operation of the LLC as required by vote of the members, provided,
however, that in the event that any member refuses or fails to cont Bute his share of any or all of the
additional capital, then the other members or any one of them ma' contribute the additional capital
not paid in by such refusing member and shall receive therefore an increase in the proportionate
share of the ownership and profit interest in the entire LLC basefi on the new proportion of their
capital account as compared to the total of all capital accounts) of members. Unless otherwise
agreed, the right to make up additional capital contributions of a refusing member shall be available
in the same proportions as the members electing to make the contribution hold profit interests in the

B. In lieu of voting an additional assessment of apital to meet operating expenses
or to finance new investments, the LLC may, as determined by t e managers, borrow money from
one or any of the managers, members, or third persons. In th event that a loan agreement is
negotiated with a manager or member, he or she shall be entitle to receive interest at a rate and
upon such terms to be determined by the managers, excluding he manager making said loan, if
applicable, and said loan shall be repaid to the manager or member, with unpaid interest, if any, as
soon as the affairs of the LLC will permit. The loan shall be evidenced by a promissory note
obligating the assets of the LLC. Such interest and repayment of the amounts so loaned are to be
entitled to priority of payment over the division and distribution of capital contributions and profit
among members.
VI. PURPOSES
The purpose of the LLC is to own and operate a business, and such other lawful
business purposes of which the LLC may elect to pursue in the fu.ure.
VII. DIVISION OF PROFITS AND LOSSES
•
Each of the members shall own an interest in the LC as set forth in Paragraph N,
entitled "Capital Contributions", except as the same may hereaft r vary or change as provided in
Paragraph V, entitled "Contributions of Additional Capital" an as the same may be modified
pursuant to this Paragraph VII. All profits of the LLC enterpris shall be shared by each of said
members according to the percentage of ownership and profit) interest each member owns. A
separate capital account shall be maintained for each memb r. No member shall make any
withdrawals from capital without prior approval of the LLC. If t e capital account of the member
becomes impaired, his share of subsequent LLC profits shall be f rst credited to his capital account
until that account has been restored.
The profits and gains of the LLC shall initially be ivided and the losses, deductions,
and credits of the LLC shall be borne in the following proportions

The division of profits and losses and the ownership interests of Paragraph IV
above shall be adjusted from time to time based on member capital accounts existing on the last day
of December of each year to reflect the then existing capital account balances as a percentage of all
members' capital accounts.
All distributions of assets of the LLC, including cash, shall be made in the same
allocations among members as described above.
The managers shall determine, in their discretion, whether distributions of assets of
the LLC should be made to the members; provided, however, that no distribution of assets may be
made to a member if, after giving effect to the distribution, all iabilities of the LLC, other than
liabilities to members on account of their capital and income acc unts, would exceed the fair value
of the LLC assets.

A member has no right to demand and receive any distribution from the LLC in any
form other than cash.
The manner in which Capital Accounts are to be maintained pursuant to Paragraphs
IV, V and VII is intended to comply with the requirements of Section 704(b) of the Code and the
Treasury Regulations promulgated thereunder. If in the opinion of the Company's accountants the
manner in which Capital Accounts are to be maintained pursuant to the Preceding provisions of this
Paragraph VII should be modified in order to comply with Section 704(6) of the Code and the
Treasury Regulations thereunder, then notwithstanding anything' to the contrary contained in the
preceding provisions of this Paragraph VII, the method in whichl! Capital Accounts are maintained
shall be so modified; provided, however, that any change in the manner of maintaining Capital
Accounts shall not materially alter the economic agreement between or among the members.
Upon liquidation of the Company (or any member's membership interest),
liquidating distributions will be made in accordance with the positive Capital Account balances of
the members, as determined after taking into account all Capital Account adjustments for the
Company's taxable year during which the liquidation occurs. Liquidation proceeds will be paid in
accordance with Paragraph XI. The Company may offset damages for breach of this Operating
Agreement by a member whose interest is liquidated (either upon the disassociation of the member
or the liquidation of the Company) against the amount otherwise distributable to such member.
VIII. RULES RELATING TO THE MEMBERS
A. Additional members may be admitted upon the unanimous written consent of all
members.
B. A member shall be entitled to one vote on any matter for which members are
required to vote, with each vote to be weighted as to a member's percentage ownership interest of the
LLC. A member may vote in person or by proxy at any meeting of members. All decisions of the
members shall be made by a majority vote of the ownership interests owned by the members at a
properly called meeting of the members at which a quorum is present, or by unanimous written
consent of the members.
C. Meetings of members may be held at such •time and place, either within or
without the State of Colorado, as may be determined by the managers or the person or persons
calling the meeting.
D. An annual meeting of the members shall be held at a time and place designated
by the managers.
E. Special meetings of the members may be called by the managers or by at least
one-tenth of the ownership interests entitled to vote at the meeting.',
F. Written notice stating the place, day, and hour or the meeting and, in the case of a
special meeting, the purpose for which the meeting is called, shall be delivered not less than ten (10)
days nor more than fifty (50) days before the date of the meeting, either personally or by mail, by or
at the direction of the managers or any other person calling the meeting, to each member of record
entitled to vote at such meeting. A waiver of notice in writing, signed by the member before, at, or
after the time of the meeting stated in the notice shall be equivalent to the giving of such notice.
G. By attending a meeting, a member waives objection to the lack of notice or
defective notice unless the member, at the beginning of the meeting, objects to the holding of the
meeting or the transacting of business at the meeting. A member who attends a meeting also waives
objection to consideration at such meeting of a particular matter nit within the purpose described in
the notice unless the member objects to considering the matter when it is presented.
H. A majority of the ownership interests in the LUC entitled to vote shall constitute
a quorum at the meeting of members. If a quorum is not represented at any meeting of the
members, such meeting may be adjourned for a period not to exceed sixty (60) days at any one
adjournment; provided, however, that if the adjournment is for more than thirty (30) days, a notice
of the adjourned meeting shall be given to each member entitled to',vote at the meeting.
IX. MANAGERS
A. Management and the conduct of the business pf the LLC shall be vested in the
managers. The managers may adopt resolutions to govern their activities and the manner in which
they shall perform their duties to the LLC.
B. Managers shall be natural persons eighteen (1 ) years of age or older.
C. The number of managers shall be two. Th number of managers shall be
increased or decreased by the vote or consent of the members. Th' initial manager shall hold office
until the first annual meeting of members and until his successo has been elected and qualified.
Thereafter, each manager elected by the members shall hold offic for a one-year term or until his
or her successor has been elected and qualified. Managers shall he elected by a vote or consent of
the members at an annual meeting or at a special meeting called for that purpose. The initial
manager shall be JoEllen L. Gonzales and Paul Gonzales, Jr.
D. Meetings of the managers may be held at such time and place as the managers
by resolution shall determine.

Written notice of meetings of the managers shall ibe delivered at least twenty-four
(24) hours before the meeting personally, by telecopier, or by mail!actually delivered to the manager
within the twenty-four (24) hour period. A waiver of notice in writing, signed by the manager
before, at, or after the time of the meeting stated in the notice, shell be equivalent to the giving of
such notice.
By attending a meeting, a manager waives objection to the lack of notice or defective
notice unless, at the beginning of the meeting, the manager objects to the holding of the meeting or
the transacting of business at the meeting.
A majority of the managers, if more than one, entitled to vote shall constitute a

more than one, at a properly called meeting of the managers at v'hich a quorum is present, or by
unanimous written consent of the managers. In the event the managers are deadlocked, the majority
vote of the ownership interests of the members shall control.
E. The managers shall have the duties and responsibilities as described in the
Colorado Limited Liability Company Act, as amended from time to time. Either manager may
execute deeds, mortgages, promissory notes and leases on behalf Of the LLC.
F. At all times during the term of a manager, the anager shall give reasonable time,
attention, and attendance to, and use reasonable efforts in the bu iness of the said LLC; and shall,
with reasonable skill and power, exert himself or herself for the jo'nt interest, benefit, and advantage
of said LLC; and shall truly and diligently pursue the LLC objecti es.
G. Managers, employees, and agents of the LLC s all be entitled to be indemnified
by the LLC to the extent provided in the Colorado Limited Lia ility Company Act, as amended
from time to time, and shall be entitled to the advance of expense , including attorneys' fees, in the
defense or prosecution of a claim against him or her in the capacit of manager, employee, or agent.
X. BOOKS AND RECORDS
A. The books and records of the LLC shall be maintained at the principal office of
the LLC or at such other place as the managers by vote or consent shall designate.
B. Each member shall at all times have access to the books and records of the LLC
for inspection and copying. Each member shall also be entitled:
i. To obtain from the managers upon reasonable demand for any
purpose such information reasonably related to the member's membership interest in
the LLC. ,
H. To have true and full information regarding the state of the
business and financial condition and any other informatign regarding the affairs of
the LLC. '
Hi. To have a copy of the LLC's federal, altate, and local income tax
returns for each year promptly after they are available to the LLC; and
iv. To have a formal accounting of the LLC affairs whenever
circumstances render an accounting just and reasonable. :
C. The books shall be maintained on a cash basis. The fiscal year of the LLC shall
be the calendar year. Distributions to income accounts shall be made annually. The books shall be
closed and balanced at the end of each calendar year and, if any au it is determined to be necessary
by vote or consent of the managers, it shall be made as of the losing date. The managers may
authorize the preparation of year-end profit-and-loss statements, b lance sheet, and tax returns by a
public accountant.
XI. DISSOLUTION
A. The LLC shall be dissolved upon the occurrenc of any of the following events:
i. At any time by unanimous agreement of he members.
B.. Upon a dissolution of the LLC, the assets shill be used and distributed in the
following order: I
i. To pay or provide for the payment of all LLC liabilities to
creditors other than members, and liquidating expenses anci obligations;
ii. To pay the reasonable compensation and expenses of managers
incurred in liquidation; and
iii. The amount then remaining shall be paid to and divided among
the members in accordance with the statutory scheme for distribution and liquidation
of the LLC under the Colorado Limited Liability Compaty Act, as amended from
time to time.
Except as otherwise required in the Colorado Limited Liability Company Act (and
subject to Articles V and VII, no member shall have any liability to restore all or any portion of a
deficit balance in such member's Capital Account.
XII. RESTRICTIONS ON TRANSFER
I
No member's interest in the LLC may be transferr d, or disposed of in any manner
whatsoever to any person or firm, without the unanimous consent of all members and if applicable,
all joint owners. None of the interests in the LLC shall be ple ged by any member without the
written consent of the LLC and all other members. Each member by executing this Agreement
hereby consents to the transfer and/or admission of members only:if made pursuant to the terms of
this Agreement.

A purchaser of a Membership Interest of the LLC shall not become a member and
shall not participate in management of the LLC without the unanimous consent of the non-selling
members, but shall be entitled to receive the share of profits, gains, losses, deductions, credits, and
distributions to which the selling member would be entitled.
XIII. COLORADO LAW
This Agreement and all questions arising under it Shall be determined in accordance
with the laws of the State of Colorado.

XIV. NOTICE

Whenever under this Agreement, notice is required to be given, it shall be given in
writing, and if such notice is served by certified mail, it shall be deemed to have been given on the
date such notice is posted. Notices shall be addressed to the respective parties at the addresses listed
on the corporation's books.
XV. ACKNOWLEDGMENT OF INVESTORS
Each member who is or becomes a party to this agreement acknowledges that he is a
resident of Colorado, that he is acquiring the membership interest -or investment purposes only, for
his own account, and that he does not intend to sell such intere t in the LLC in the foreseeable
future; that he is aware that his investment in the LLC is strictly a eculation, and that he can afford
any loss he might suffer as a result of acquiring such interest; that e is aware that the interest in the
LLC of the LLC may be classified as a restricted security and that such may not be resold without a
federal exemption from registration, or registration of the security t the time of sale; and that he has
reviewed and understands the nature of the business
and propc)sed business of the LLC to his
satisfaction, and that no member, or agent of the LLC has made any representations to him as to
how much the value of such interest in the LLC might increase or how much income might be
realized by the LLC.
XVI. BENEFIT
This Agreement shall bind and extend to the heir, representatives, successors and
assigns of the parties hereto, including their creditors.
XVII. ATTORNEY'S FEES
In the event any party hereto initiates legal proceedings to interpret or enforce any
term of this Agreement, the prevailing party shall be entitled to an award of attorney's fees and costs
incurred.
XVIII. PRIOR AGREEMENT
This agreement supersedes all prior agreeme is and no amendment of this
agreement shall be effective unless set forth in a written amendme t signed by all the members and
the LLC.

Re: Proposed indoor shooting range
To Whom It May Concern:
As a former educator and almost 5-year resident of Idaho Creek
Subdivision, I am appalled at the idea of a shooting range in close
proximity to our neighborhood.
With 355 homes now inhabited, there must be at least 200 or more
children living within our subdivision. They are not always under the
watchful eye of a parent or caretaker.
I think the idea of a shooting range is absolutely unthinkable
considering the possible unsafe conditions and/or people who may be
drawn to our area. In fact, such a proposed business will definitely
bring down the value of our properties and make it an undesirable
place to live, especially for those raising children.
Please keep our neighborhood and children safe. Do not allow a place
where weapons will be used compromise our safety.

of approval as a homeowner in the adjacent community. I welcome independent business ventures to
our community. When applicable we support local and small businesses in our community whenever
possible. Due to the nature of this business, public comment is expected but should not hinder an
individual from free enterprise. Why we are not asked for our comments or concerns when the next
corporate fast food giant invades our neighborhood seems more absurd? More people die from poor
health and heart failure than indoor shooting ranges in America every year.We don't get the
opportunity to comment on the openings of corporate killers and local governments often extend tax
benefits that hard working citizens in their community don't even get,just to lure them in.

Dear Ms. Hatch,
I wish to express my concerns with the proposed amendment to a PUD Final Plat Redesign,
consolidating Lots 8 & 9 of Block 2 into one lot in the Western Dairymen Cooperative PUD. As
a resident within 500 feet of the proposed development, I have several concerns with this
proposal.
Compatibility of Land Uses: Safety
The merging of these two lots is proposed for the purpose of building an indoor shooting range
adjacent to high density single family housing. PUD Policy 4.1 states that "Flexible design
elements of a Planned Unit Development should consider compatibility with existing and
planned uses on adjacent properties." This proposal does not consider compatibility with
existing uses on adjacent properties, locating a firearms facility within 70 feet of high density
homes and less than %< mile from a future middle school.
PUD Goal 1 states that, "In an effort to promote the Planned Unit Development process for
development review, the County will cooperate with the development applicant to achieve the
objectives of the applicant while ensuring the proposal meets all health and safety needs; meets
the intent of the zone district(s) applicable to the land use proposed; meets the intent of the
goals expressed in this section; and conforms to the Comprehensive Plan." Please explain how
you find this proposal to meet these public values.
Structural Land Use Map
The 1-25 M.U.D. Structural Land Use Map (October 2006) identifies the subject property as
Regional Commercial — Medium Intensity. According to Sec. 26-1-50 of the Comprehensive
Plan, "Regional commercial centers are intended to provide safe, efficient areas offering
convenience goods and services to residents of surrounding neighborhoods. These centers
include commercial and industrial activities which are medium-intensity levels and have few
environmental and service related impacts. Activities in these centers may include the following:
1. Retail shops.
2. Civic uses such as libraries, community centers and churches.

3. Service businesses such as offices.
4. Public facilities and utility service facilities.
5. Restaurants.
6. Retail and wholesale establishments.
7. Light manufacturing and research facilities."
The proposed development is not compatible with adjacent land uses and does not provide
convenience goods or services to the residents of surrounding neighborhoods.
Urban Development
This indoor firing range is proposed adjacent to an urban residential development. Section 22-
2-70 of the Comprehensive Plan defines urban residential development as "high density multi-
family projects, single-family residential subdivisions and many variations between these two (2)
categories". It also states that "some commercial or neighborhood service uses such as
churches, day care, small-scale offices, schools, convenience stores, small shopping areas,
etc., are usually associated with urban residential subdivisions."
Furthermore, Section 22-2-170 (Commercial development goals and policies) of the
Comprehensive Plan states, "Neighborhood commercial uses will be allowed in residential
areas. These commercial uses will consist only of neighborhood-oriented businesses.
Commercial uses that service a greater area than the neighborhood and create undesirable
impact, such as increased vehicular traffic, are not considered appropriate in residential
neighborhoods."
The proposed development is not consistent with planned land uses, and deprives residents of
these desired services and goods. Where are the residents supposed to shop or obtain local
services if all of the surrounding land is developed with firing ranges, RV dealerships, and
garage condominiums?
Public Comment
I can imagine that you or the Planning Commission will discard these concerns because the
matter at hand at the March l8'" public hearing is the merging of two PUD lots, not an
evaluation of intended use. That is an unfair position to take, as this is the only opportunity for
public comment. Residents within 500 feet have been informed of an innocuous-sounding,
jargonistic "Amendment to a PUD Final Plat Redesign." No one would interpret this to mean that
a firing range is being proposed in their backyards, and near a future middle school. Weld
County residents deserve the opportunity to know what is being proposed in their
neighborhoods.
The Comprehensive Plan includes two Guiding Principles that will be violated if land use is not
considered in this public process:
It is an open process to facilitate public information and input, and should not be
approved or denied solely on the basis of public sentiment.

It provides open communication through the development review process to neighbors
and communities most impacted by proposed changes.
Private Property Rights and Land Values
I was informed that the proposed development is a Use by Right, and therefore not subject to
public comment. It is assumed that this policy was adopted to protect private property rights.
Yet, it is important to remember that an individual's (or corporation's) private property rights are
not absolute. As stated in Section 22-1-120 of the Comprehensive Plan, "Private property rights
are not unlimited rights but rather rights balanced with the responsibility of protecting community
health, safety and welfare." It is the responsibility of Weld County Planners, the Planning
Commission, and the Board of County Commissioners to respect this balance of rights and
prevent incompatible land uses.
It is also important to consider that adjacent homeowners have property rights as well. This
development will lower land values throughout my community. (I think you would be hard-
pressed to find a real estate agent to testify to the contrary.) By approving an incompatible land
use on this property, you risk infringing on the private property rights of every homeowner in the
Idaho Creek community and the possibility of a legal challenge to a poorly considered
development.
Of all places in Weld County for a firing range, why here?
