RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST ELMER AND BETTY HERGENREDER FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Elmer and Betty Hergenreder, ZCV#0701142, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of May, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Elmer and Betty Hergenreder were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 13, 2008, to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-ways to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. No pictures were taken during this inspection. 10/25/2007 Office Visit Jim, James and Elmer Hergenreder came into the office. We discussed the violations. They (at first) tried claiming that everything was"Ag Exempt". I explained that the Derelict Vehicles were not"Ag Exempt". Towards the end of the conversation, they indicated that they were going to relocate and get rid of the Derelict Vehicles. I asked how long they thought it would take. They said a couple of months. I explained that I would send them a 60 day letter. If they saw towards the end of the 60 days that they were going to need more time, they would just need to give me a call. They said they would. 04/17/2008 Property Inspected Upon a visual inspection of the property, the following items were noted: same apparent derelict vehicles appear to still be situated on the property.
