Dear Mr. Ogle:
We are writing in regards to Weld County USR-1102, which was formerly known as Del Camino Sand and
Gravel, operated by Owens Brothers Concrete Company.
Weld County USR: USR-1102 (unchanged)
Operation Name: Firestone Gravel Resource (changed from Del Camino S &G)
Operator Name: L. G. Everist, Inc. (changed from Owens and Ready Mixed)

In July 2008, the Colorado Division of Reclamation, Mining, and Safety (DRMS or Division) approved the
Succession of Operator for this mine site from Ready Mixed Concrete Company to L. G. Everist, Inc. The
name of the operation under Ready Mixed was"Del Camino Sand and Gravel." L. G. Everist changed
the name of the operation to Firestone Gravel Resource. A copy of the Division's SO-2 approval letter,
dated July 11, 2008, is attached for reference.
Please note that Ready Mixed Concrete Company had succeeded Owens Brothers Concrete Company
as operator in 2005. A copy of the Division's SO-1 approval letter from April 2005 is attached.
This mine site has been under a status of Temporary Cessation since the Temporary Cessation was
approved by the Division in February 2006. A copy of the Division's TC-2 approval letter, dated February
13, 2006, is attached for reference. L. G. Everist, Inc. is maintaining the status of Temporary Cessation.
At this time, we do not have plans to make any changes to the State or Weld County permits.

Dear Ms. Shults:
On July 7, 2008,the Division of Reclamation, Mining and Safety approved the succession of operators from Ready Mixed
Concrete Company to L.G. Everist, Incorporated for this operation. L.G. Everist, Incorporated is now the permitted
operator of the Firestone Gravel Resource, and as such, is responsible for all provisions in M-1996-052, as well as those
specified in the Rules and Regulations. Ready Mixed Concrete Company is relieved of all responsibilities concerning this
operation.
Please Note:
1. All of the application materials, as amended and supplemented, are in integral part of your permit. They have
been incorporated into the permit by reference. We presume that you have a copy of all of these materials,therefore,none
have been enclosed with this mailing. We suggest that you keep a copy of the permit and the permit application at the
mining operation as a reference for operation personnel,to help ensure compliance with the terms of the permit.
2. Changes in the mining and reclamation operations that differ from those described in the permit may require a
modification to the permit. We suggest consulting the Rules and Regulations and/or contacting us to determine if a
modification to the permit is necessary. Rule 1.10 pertains to Amendments, Rule 1.9 to Technical Revisions, and Rule
1.11 to Conversions.
3. On your permit anniversary date each year,you must submit an annual fee and annual report to us. Please consult
the Rules,Act,and your permit for specific requirements.
The transfer of this permit does not result in the transfer of any other permits or licenses,with this Division,the State,
or Federal Agency,which might be associated with this operation.

Dear Mr. Owens:
On April 26, 2005, the Division of Minerals and Geology approved the succession of operators from Owens Brothers
Concrete Company to Ready Mixed Concrete Company for the Del Camino Sand and Gravel Mine, Permit
No. M-1996-052. Ready Mixed Concrete Company is now the permitted operator of the Del Camino Sand and Gravel
Mine, and as such, is responsible for all provisions in M-1996-052, as well as those specified in the Rules and
Regulations.
Enclosed is Colorado National Bank Letter of Credit No. 6-98-16-1561699, in the amount of$49,450.00, and the
Performance Warranty you originally provided. These have been released as of April 26, 2005 Division approval for the
succession of operators. You should advise your bank of this release by copy of this letter.

Dear Mr.Timmons:
On February 13,2006 the Division of Minerals and Geology approved the Temporary Cessation application submitted to the Division
on January 26,2006,addressing the following:
Change the status of the site to Temporary Cessation.Prior to recommencing operations at the Del Camino site, the operator
will post an additional financial warranty in the amount of$278,182.00.
Please be aware that Section 1.13.5(1Xa) of the Construction Materials Rules and Regulations and the Hard Rock/Metal Mining
Rules and Regulations state that Initial period shall be the first five years of Temporary Cessation beginning with the 180 day
i period of production cessation."
Rules 1.13.8 and 1.13.9 state that:
1.13.8 A permit granted pursuant to Rules shall continue in effect as long as:
(a) the mining operation is resumed within five(5)years of the beginning of Temporary Cessation;or
(b) the Operator files a report requesting an extension of the period of Temporary Cessation with the Board
stating the reasons for the continuation of those factors necessary to, and the plans for, resumption.
1.13.9 Ten Year Limitation for Temporary Cessation
In no case shall Temporary Cessation be continued for more than ten (10) years without terminating the mining
operation and fully complying with the Reclamation and Environmental Protection Plan requirements of the Act and
these Rules.
