RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND
USE BY SPECIAL REVIEW PERMIT #1464 FOR AN OIL AND GAS SUPPORT AND
SERVICE FACILITY, AND A SINGLE FAMILY DWELLING UNIT OTHER THAN THOSE
PERMITTED UNDER SECTION 23-3-20.A OF THE WELD COUNTY CODE (AN
APARTMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT - ALFONSO BORREGO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 20th day of
October, 2004, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing
the application of Alfonso Borrego, 9492 Weld County Road 4,Wiggins, Colorado 80654,for a Site
Specific Development Plan and Use by Special Review Permit#1464 for an Oil and Gas Support
and Service Facility, and a Single Family Dwelling Unit other than those permitted under
Section 23-3-20.A of the Weld County Code (an apartment) in the A (Agricultural) Zone District,
on the following described real estate, being more particularly described as follows:
Lot A of Corrected Recorded Exemption #3089;
being part of the S1/2 of the SE1/4 of Section 33,
Township 5 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the current property owner, Jose Nieto, 2620 Hawk Drive, Evans, Colorado
80620, submitted a written request to withdraw said application, attached hereto, and incorporated
herein by reference, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and, having been fully informed, finds that
this request shall be accepted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Jose Nieto to withdraw the application for a Site Specific
Development Plan and Use by Special Review Permit #1464 for an Oil and Gas Support and
Service Facility, and a Single Family Dwelling Unit other than those permitted under
Section 23-3-20.A of the Weld County Code (an apartment) in the A (Agricultural) Zone District,
be, and hereby is, accepted.

SUBJECT: USR-1464
In a letter dated November 3, 2008 the applicant is requesting USR-1464, for A Site Specific
Development Plan and Special Review Permit for a Mineral resource development facility
including an oil and gas support, and service facility in the A(Agricultural) Zone District be
withdrawn. USR-1464 was approved by the Weld County Board of County Commissioners on
10/20/04. Attached is a copy of the applicants request.

Jose Alfredo Nieto has purchased property from Alfonso Borrego which the County had
approved the Use By Special Review USR-1464. As you are aware,Mr.Borrego never posted
the bond to complete this USR.
Jose Alfredo Nieto, the present property Owner, would like to withdraw the Borrego
application fox USR-1464.
A copy of the present Warranty Deed is attached for your review
