RE: Lease OMA-2355 Ft. Lupton
Maintenance Shed; Lease
OMA-6947 , Eaton Maintenance
Shed.
Dear Mr. Lightwine:
Your supplemental agreement to the above referenced leases have
been referred to me for review. One particular section, section
16 is not entirely satisfactory to Weld County. This section
appears to allow notice to the county by posting notice of
termination on any building or by mailing it to your office. I
would suggest that section 16 be amended on these leases and any
subsequent supplemental leases to read as follows:
"This lease may be terminated by written
notice given by either the lessor or the
lessee to the other party on any date and such
notice stated, not less, however than 30 days
subsequent to the date on which such notice
shall be given. Said notice may be given to
the lessee by serving the lessee by mailing,
postage prepaid, to the Clerk to the Board of
County Commissioners of Weld County, P.O. Box
758 , Greeley, Colorado, 80632 . Notice may be -
given to the lessor by mailing, postage
prepaid, to the office of the Director of Real
Estate, Room 306 , 1416 Dodge Street, Omaha,
Nebraska, 68179 . Upon such termination and
vacation of the premises by the lessee, the
lessor shall refund to the lessee on a pro
rata basis, any honor rental paid in advance. "

These corrections are not, obviously, substantive but would much
better serve the Counties interest in insuring that the notice go -
to the governing board of the county and not be misplaced or
misdirected by a grader operator or maintenance person.
Thank you for your prompt attention to this matter. If this can
be satisfactorily resolved, anticipate prompt action by the Board
of County Commissioners to execute the supplements.
