J 11/4 462p7o5 I I. / . 400 RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR A SAND AND GRAVEL OPERA- TION FOR WELD COUNTY, 915 10TH STREET, GREELEY, COLORADO 80631 WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 15th day of October, 1980 at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the applica- tion of Weld County, 915 10th Street, Greeley, Colorado 80631 , for a Special Use Permit for a sand and gravel operation on the following described real estate, to-wit: A tract of land situated in the South Half of the Southeast Quarter (S; SEa) of Sec- tion Thirteen (13) , Township Two (2) North, Range Sixty-seven (67) West of the Sixth Principal Meridian and being more particu- larly described as follows : Beginning at the Southeast Corner (SE Cor. ) of said Section Thirteen (13) and consider- ing the South line of said Section to bear South 90°00 ' 00" West and with all other bearings contained herein being relative thereto; Thence South 90°00 ' 00" West, a distance of 1 , 953. 93 feet; Thence North 07°58 ' 00" West, a distance of 1 , 322 . 79 feet; Thence North 89°51 ' 58" East, a dis- tance of 2,136. 90 feet to the Northeast Corner (NE Cor. ) of the South Half of the Southeast Quarter (S1 SEa) of Section Thirteen (13) ; Thence South 00°00 ' 48" East, a distance of 1 , 305. 03 feet to the True Point of Beginning. WHEREAS, a representative of the Petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a sand and gravel operation on the abovedescribed real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Reso- lution authorizes such a use in an Agricultural District upon approval by the Board of County Commissioners , and 800705 WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, has studied the request of the Petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and having been fully informed, is satisfied that the request for a Special Use Permit for a sand and gravel operation on the hereinabove described real estate, conforms to the purposes of Section 3. 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of the Petitioner for a Special Use Permit for a sand and gravel opera- tion on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The attached Operations Standards being recommended and approved for this request. 2. The following note being placed on the Special Use Per- mit Plat: NOTE: The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities . Activities related to mining and reclamation are, therefore, under the jurisdic- tion of the Mined Land Reclamation Board , how- ever, Weld County has jurisdiction of those matters outlined in the Operations Standards . 3. The Operations Standards being placed on the Special Use Permit plat. The Special Use Permit Plat shall be delivered to the Department of Planning Services . 4 . The applicant identifying the 100 year floodplain boundaries on the plat. BE IT FURTHER RESOLVED by the Board of County Commissioners that Operation Standard #16 shall be amended to read as follows : "16 . The County will negotiate with William Gee, his heirs and assignees , the type and cost share of common ownership fences . The applicant identifying the 100 year floodplain boundaries on the plat prior to the Board of County Commissioners hearing. OPERATIONS STANDARDS VELD COUNTY SUP-426:80:16 1. The uses permitted on this site shall be the extraction of sand and gravel as described in the application materials and all other uses permitted by right under Section 3.3.B. of the Weld County Zoning Resolution. 2. No excavation or processing of materials shall be permitted nearer than 10 feet to the boundary of adjacent property- easement or irrigation ditch or right-of-way, nor nearer than 125 feet to any existing residence. 3. All extraction operations shall be conducted during the hours of daylight except in the case of public or private emergency or to make necessary repairs to equipment. This restriction shall not apply to operation of administrative and executive offices or repair facilities located on the property. 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust and growth of noxious weeds. The site shall be maintained in such a manner as to present a neat and well kept appearance. 5. Existing trees and ground cover along public road frontage and drainageways shall be preserved, maintained and supplemented if necessary, for the depth of the setback in order to protect against and/or reduce noise, dust and eroison. 6. Where topsoil is removed, sufficient arable soil shall be set aside, for respreading over the excavated area. 7. Insurance - The operator shall furnish evidence he is insured to the extent of not less than $100,000.00 against liability for any negligent act or omission by the operator from the operation or maintenance of the sand an gravel pit and the extraction and production of sand and gravel pit and the extraction and production of sand and gravel and all activities connected with or incidental thereto. 8. All phases of the borrow pit operation shall comply with all applicable County, State and Federal Health Standards and Regulations and other ap- plicable rules and regulations of governmental bodies having jurisdiction on the premises. 9. No diking or berming shall be allowed on the Special Use Permit area which would cause damage to adjacent properties or ditch right-of7way by alter- ing the historic drainage pattern. 10. The owner/operator shall ensure that the flow capacity of the Meadow Island Ditch #1 shall not be decreased or prior use diminished due to any modification made during the operations of the gravel pit. 11. The Special Use Permit shall be limited to the plans shown hereon and governed by the Operations Standards stated above and all applicable Weld County Regula- tions. Any material deviations from the plans and/or Operations Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners be- fore such changes from the plans and/or Operations Standards shall be permitted. .'jai Le Any ether changes from the plans and/or Operations Standards shall be filed in the office of the Department of Planning Services 12. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revoca- tion of the Special Use Permit by the Board of County Commissioners. 13. Screening me Winds, stockpiles, dikes, berms and of er features should not obstruct the passage of 100 year flood flows to the point that it creates any adverse effects on others. 14. Any fuel tanks, septic tanks and other items which might wash away during floodings should be located outside the 100 year floodplain or adequately floodproofed to avoid the creation of any hazardous conditions. 15. The County will provide suitable dust control and abatement treatment on the mining site during excavation and on unpaved haul routes during periods of hauling operations. Suitable treatment may include but is not limited to the following: liouid asphalt treatment, used crank case oil treatment, chemical treatment, wetting, vehicle speed reduction. 16. The County will negotiate with William Gee the type and a cost share of common ownership fences. 17. The County will complete unfenced boundaries with a 3 strand barbed wire fence and install gates at access points that will be locked when employees are not present. 18. The County will post " No Trespassing, Violators will be Prosecuted" signs every 500 feet along roads and at each access point. 19. During hauling operations truck dirvers will be instructed to use specific haul routes and to obey posted speed limits and load restricted bridges. 20. The County will increase the level of maintenance to compensate for road damage being caused during hauling operations. 21. Weld County will notify, by mail, adjacent land owners, that problems may be referred to Weld County Engineer, P. O. Box 758, Greeley, Colorado 80631, Phone 356-4000 Ext. 750. Lupton at Vollmar APPEARANCE: Drew Scheltinga, Weld County Engineering Department, explained that at the last meeting there were several surrounding property owners who voiced concerns in the area and in the middle of July a meeting was held at the residence of Mr. & Mrs. Gee to discuss some of these problems. Mr . Scheltinga stated the Commissioners proposed seven additional development standards. Mr. John Dent, representing the surrounding property owners , stated that he did not have any objection to most of the additional development standards. Mr. Dent did state concerns with using crank case oil as a dust treatment, that the County truck drivers be instructed repeatedly that they are to abide by the regulations as posted, and the continued concern with mosquito control . MOTION: It was moved by Bob Ehrlich and seconded by Bob Halleran that the Planning Staff's recommendation of July 1, 1980 and the development standards including seven standards proposed by the Commissioners be accepted by reference and for- warded to the Board of County Commissioners with recommendation for approval . I thought our meeting was very helpful and we appreciate the opportunity to have you correct some of the misinformation that had been floating around. Upon reflection, I feel that the concerns expressed by the residents can be broken down into basically two classifications, which class- ifications are not necessairly mutually exclusive. First of all, the residents are concerned about the existing operations in the area for which Special Use Permit has previously been obtained and which are not directly related to the present application. Secondly, the residents are concerned with the impact and effects of the even larger development which is proposed and which is the subject of the pending special use permit application. Many of the specific concerns raised, although directed at the present operation, are or might be applicable to the future operation if necessary permits are obtained. The residents of the area, although preferring not to have any gravel extraction operation in their vicinity, realize the necessity for the County obtaining gravel and that the pits have to be located near some- body's property. They would therefore like to minimize the adverse effects upon the neighborhood while conceeding the necessity for having the operations there at all. We therefore suggest that the following additional operational standards be included as part of the application for special use permit and if so included become binding upon the County as the owner/operator of this particular site. Ar Mr. Wayne Smith July 31, 1980 Page 2 PROPOSED ADDITIONAL OPERATING STANDARDS Ala Owner/operator shall prior to commencing excavation operations and continuously during any period of excavation or hauling, provide suitable dust control and abatement treatment to all unpaved roads over which all trucks may seek ingress or egress from the site. Suitable treatment may include but is not limited to any one or more of the following: oiling, chemical treatment, application of water as required, vehicle speed reduction. 2. Owner/operator shall fence and control all accesses to such site so as to limit or curtail public access to such site. Additionally, owner/ operator shall erect in conspicious locations on such site, signs indicat- ing that public access is not allowed and that violators may be subject to prosecution. 3. Owner/operator shall to the greatest extent possible control or reduce the mosquito population on any part of the proposed site, particu- larly with reference to any pits thereon containing water or other potential mosquito breeding sites. r4. Owner/operator shall by suitable instructions given to all drivers, inform any such drivers of the requirement of adherence to posted speed limits and traffic control devices on all routes being utilized, except that if speed limits are established lower than the otherwise posted speed limits, such drivers shall be so instructed. In addition to the above proposed additional operational standards, the residents whoud suggest the following items, directed at reducing or eliminating the problems existing in connection with the present opera- tional site. 1. "Special Flood Hazard Information Report, South Platte River, Volume I, Weld County, Colorado" prepared by the U.S. Department of the Army, Omaha District, Corps of Engineers in April, 1977. This report was designated by the CWCB on 11/15/77. 2. "Map of Flood Prone Areas , Platteville, Colorado 7.5 minute Quad" prepared by the USGS for USD - HUD-FIA in 1974. Findings : 1. In this particular reach, all reports are essentially in agreement. However, the Corp report contains the designated information and thus is referenced here. 2. The property is entirely within the 100-year floodplain of the South Platte River as described in the Corps report designated by this office. 3. The property was completely inundated by the flood of May, 1973. 4. The present application does not identify the 100-year flood boundaries . It does, however, state that the property is in a floodplain. 5. No water diversions or dam impoundments are proposed; however, open pits that will fill with groundwater will remain. 6. The project proposes use of "screening mounds"; however, the drawings do not show the "screening mounds" as described in the permit application. These mounds could be an obstruction to flood flows if improperly placed. 7. The "extraction standards" declare that, "No diking or berm shall be allowed in the SUP area which would cause damage to upstream or downstream properties by altering the historic flow patterns. " 8. Stockpiles , equipment, storage and office areas are not located in the drawings . 9. A reclamation plan is included which appears satisfactory from our viewpoint. Recommendations : A. The applicant should identify the 100-year floodplain on the special use permit application plans . Please see attached page for available information. Ms . Screening Mounds , stockpiles , dikes , berms and other features should not obstruct the passage of 100-year flood flows to the point that it creates any adverse effects on others. C. Any fuel tanks, septic tanks and other items which might wash away during floodings , thus creating "hazards to the public welfare", should be located outside the 100-year floodplain or adequately floodproofed to avoid the creation of any hazardous conditions. D. Locations of screening mounds, stockpiles , storage areas, equipment areas and other temporary facilities should be shown on the application, preferably in patterns parellel to flow with adequate spacing in order to insure minimum obstruction to flow patterns. E. The reclamation plan should return the area to its natural stateeas possible without any obstructions to stream flows that would adversely effect others. The northeastern tract has been worked out and reclaimed, and the southeastern tract is currently being worked. The largest of the three parcels, the western, will be mined in four stages according to the report, but the mining plan map shows only three stages for that tract. A question of greater concern is the volume and placement of the overburden. The construction of a visual screening mound certainly is desirable, but my rough calculations show that the volume of overburden that will be removed will greatly exceed that required for construction of the berm. Using the following information, berm configuration: 25 ft wide at base, 4 ft high, 2:1 outside slope, 3:1 inside slope pit configuration: 35 acres, 5,100 ft perimeter (measured from plan map) , I calculated that a berm of those dimensions completely circling the indicated pit configuration would require about 3.1 x 105 ft3 of material . Removing 2 ft of overburden from the entire pit area would yield about 30.5 x 105 ft3 of material (excluding the expansion factor) , which is nearly one order of magnitude higher than the amount needed for the berm. Even using this material for berms at the other two pit sites would, at most, double the volume that could be used. This suggests to me that a considerable volume of overburden will need to be backfilled into the excavated area. This may not drastically alter the reclamation plans, except to decrease the exposed pond acreage, but it is a point that should be clarified. Sincerely, Stephen D. The increase in traffic in front of our home and the dust this additional traffic will cause needs to be adressed. If the pit goes in we would like to see speed limits posted and speed restriction bumps on Rd 20. Also the noise that this traffic will cause is of concern. Maybe a work hour restriction of truck traffic between 8 am and 5 pm. Also road 20 will need additional care with this truck traffic. We have never lived near a Gravel Pit before so we do not know what additional noise the operation of the pit will make but we do hope that the operation of the pit will be in a manner respecting the residents rights. Also we would like to know the name of that person we can call if we do have any complaints about the operation of the pit. Right now we have a tremendous amount of truck traffic from the wells cound hen ant they do not drive careful and they speed. Methods of Mining ./ J On the portion of the west parcel which will be mined, there are no trees or shrubs which must be stripped. The topsoil and over- ) burden will be excavated and relocated to form a roadway/screening U mound along the periphery of the parcel . A backhoe capable of ex- cavating sand and gravel to a 25 foot depth will be utilized. The J mined material will be stockpiled and allowed to drain, since most of the material will be taken from below the groundwater table. B. Earthmoving J Small scrapers can be used to excavate and relocate topsoil and overburden. Dozers will be used to shape the screening mounds J and to move some mined sand and gravel to temporary storage locations. A backhoe capable of excavating to a depth of 25 feet will be used to do the actual mining of sand and gravel . Roadgraders will be .J used to build and maintain access roads. C. Water Management v There will be no water diversions and impoundments. Groundwater will simply collect in the excavated pit and remain at or below J the elevation of the groundwater table. See EXHIBIT G for more in- ,J formation on surface and groundwater management. D. Size of Areas `i (i ) Major disturbance - of the three parcels, only the West Parcel will have excavation operations. It is anticipated that of the Li approximately 45 acres which can potentially be mined, 5 acres at U a time will have topsoil excavated and sand and gravel mined and stored. J LJ J I (ii ) Moderate disturbance - The total area under this category be less than 5 acres. It will include overburden shaping, roach, parking, working, and equipment storage. The pond area will eveniu- —.....--- ...r ally cover 75-80% of the entire site. J (lii ) Minor disturbance - There will be less than 5 acres total which will undergo slope preparation prior to any revegetation. J E. Timetables (i ) Time periods - The material mined from this pit will be used J primarily for road base and gravel road maintenance in the southern J part of Weld County. It has been estimated that the pit will have a lifetime of 20 years. The pit will be divided into 4 acres or J stages with roughly 5 years per stage. (ii ) Size and locations - Each area will be approximately 10 acres J in size. The locations are shown on EXHIBIT C. Each area will be roughly 300 feet east to west by 1300 feet north and south. (iii ) Sequence - Stage 1 will be on the eastern side and operations J will progress to the west. EXHIBIT C shows the intended sequence, Stages 1-4. F. Soil Profile J The overburden and topsoil is 2 to 3 feet thick and consists of grayish brown loam to about 10 inches , brown to light yellowish 'J brown clay to 25 inches , and calcareous loamy sand or sandy loam to about 30 inches. u The material to be mined consists primarily of freely draining LJ pea-sized gravel to a depth of 25 feet and beyond. I E u U J ,„/ u EXHIBIT E RECLAMATION PLAN Li A, Types of Reclamation J The operator proposes to reclaim the land for wildlife habitat ,J because of its proximity to the South Platte River on the east boundary and a natural wildlife habitat within and adjacent to J the western boundary. In addition, because of the location in the flood plain, the pits will be "wet" . Two of the parcels have J been previously mined and the spring months high water level is ,J approximately 3 to 5 feet below the existing ground elevation. The entire acreage will accorded to fish and water fowl habitat, 'J along with small game animals. Each of the three parcels where open pit mining has and will occur Li will require no stripping operations. All that will be required ,J will be excavation of topsoil and overburden, roughly 2 to 3 feet. This material will be used to form screening mounds along the per- 'J iphery. These mounds can serve several purposes : screen views of objectionable operations , reduce noise and dust porblems , and Li provide buffer areas for revegetation between county roads and water habitats. Li , Scrapers can be used for most of the excavation of overburden. L' Then draglines or backhoes will remove overburden which perhaps is too wet for scraper operations. Dragline operations will be U necessary for actual mining of the sand and gravel deposits . Bulldozers can be utilized to shape and form the screening mounds. J J J J i J \J B. Land Use Comparisons J The proposed mining operations and all adjacent lands are located in the South Platte River floodplain as well as an aquifer re- J charge area. The present land uses are agricultural and conser- J vation or wildlife habitat. The proposed post-mining land use of wildlife habitat, therefore, will cause no conflicts with J adopted state and local land use plans. C. Implementation Requirements J The following is a list of applicable requirements of RULE 6 and corresponding implementation plans: 6.1 Grading a. Backfilling - There will be no need for backfilling. b. Erosion - The screening mounds along the periphery will J be constructed with side slopes of not greater than 2 1 ,_, and will be revegetated with properly selected grasses , shrubs, and trees to prevent erosion problems. c. Timeliness - Grading of screening mounds will take place at the very beginning of mining operations. L_J d. Aesthetics and Water Pollution - There will be no refuse ,J produced which could cause unsightliness problems, nor will there be any acid - forming or toxic materials which J could pollute the surface or groundwaters. e. Auger Holes - There will be no drill or auger holes , shafts J or addits to be filled and covered. ,J f. Slopes - The outside slopes of the screening mounds will I be constructed at a ratio or 2: 1 and the inside slopes a- ,_' bove and below the water line will not be greater than 3 1 . g. Farm Machinery - The land is not to be used for agricultural purposes. J J U U 6.2 Water J a. Hydrology and Water Quality - The mining operation will be in compliance with applicable water laws and regulations J governing injury to existing water rights. The mining and J reclamation operations will not require the use of any water, nor will the maintenance of the proposed conservation/wild- life habitat. The operation will also be in compliance with applicable federal and state water quality laws and regulations. J Although there are no plans to de-water the pit and discharge to "state waters" , an NPDES permit will be obtained and suffi - J cient treatment of the discharge water will be performed to meet permit limitations (see Water Management Plan) . The operation will be in compliance with Section 404 dredge J and fill regulations in that there will be no discharges of dredged or fill material into the Cache la Pourde River. There will not be any temporary or large siltation structures constructed. b. Earth dams - There will be no construction of earth dams for J purposes of mining or reclamation of the gravel pit. J J �J J J J IJ 1._/ 6.3 Wildlife J a. Safety and Protection - Any existing wildlife species which must be kept safe and protected are located on adjacent prop- erty and not on the mining site. No new access roads will be constructed. Although there may have been some wildlife species which used the crops as temporary cover, there will be no sig- nificant impact on wildlife. b. Habitat management and creation - The reclaimed site will con- sist of three ponds. Adjacent areas will be left in their ,J natural state. In order to minimize the impact from traffic on the two County Roads , screening mounds revegetated with trees , shrubs , and grasses will be constructed. Also it has been sug- gested by the Colorado Division of Wildlife to install a cul- 1 vert under the County Road connecting the two largest ponds to allow fish access from one pond to another. J -J U J U J U J U U J 6.4 Topsoiling a. Topsoil preservation - Some topsoil will be removed to form J screening mounds, negating the need for preservation. b. Trees - It will not be necessary to remove or incorporate trees Existing trees are located along the periphery of the parcel and need not be disturbed. c. Topsoil stockpile erosion - There will be no topsoil stockpiles. J d. Stockpiles relocation - N - A e. Grading - N -A f. Other material - N - A g. Fertilization - N - A h. Vegetative piles - N - A J J J J J Li J LJ J Li J J \-1 \_l 6.5 Revegetation J a. Self-sustaining - Native species will be used to vegetate the screening mounds. J b. Trees - There should be no problem in acquiring sufficient planting stock of the desired species. J c. Range - N - A -J d. Success - Because of the relatively small amount of proposed revegetation and favorable environmental conditions , the prob- J ability of success will be high. e. Site preparation - The screening mounds will be constructed J and prepared with applicable techniques to insure a diverse and long-lasting cover. J f. Weed control - Weed control will be practiced if it is found J that their existence and growth adversely affects the proposed reclamation. Noxious weed species which could spreed to adja- J cent farmland will be controlled. g. Roadways - N - A J h. Planting not required - Planting will not proceed until the J screening mounds are constructed to their ultimate size aid I shape. In addition, planting will not be required in the areas J of the permanent ponds. i . Adverse characteristics - N - A J J J J J J J �J D. Relationship to Environment J The entire area along the South Platte River consists of a naturo wildlife habitat - river, ponds , ground cover, cottonwood trees . The reclaimed area will consist of exactly the same. In fact, since the ponds will increase the amount of water surface in the area, more water fowl will be attracted to the area. J The three parcels will not actually impound water but simply con- -J tain groundwater. The ponds will not collect runoff or any other drainage water. J J u -J J J J J J J J E. Topsoil Management Plan -J The topsoil management plan will consist of the following items 1. Strip the top 6 inches to 1 foot of topsoil with a scrape' =i J type machine. 2. Using the scraper, relocate the topsoil to the north, east, J and south edges of the site. 3. Build screening mounds with the topsoil about 20-30 feet ,aide and 3-5- feet high. 4. Some extra topsoil taken from the west parcel could be used along the perimeters of the other two parcels, if necessary for adequate revegetation. F. Revegetation Plan The planned revegetation is for the perimeters of the three parcels . Li Trees and shrubs will help provide some cover and nesting areas for wildlife using the ponds , and reduce impacts from vehic ,lar LJ traffic along the County Roads. Preferred species - Cottonwood and Willow trees are preferred Methods of planting - Small 5 foot trees will be transplanted from along the old river channel to locations surrounding the future ponds. Availability of species - These trees are available in great .1 numbers. Proposed time - Planting could begin immediately after the screen- ing mound/roadways are constructed the first year. Identifications of Water Systems i An old channel of the South Platte River is located adjacent to the two eastern parcels along their eastern edge. The Meadow Is- __J land Ditch No. 1 runs through the western half of the west parcel J There are no wells, springs, stockwater ponds , or reservoirs on the affected land. The parcels are located in the South Platte groundwater reclidrye area. The aquifer is simply known as the South Platte Rive' J alluvial aquifer. B. Water Quality Management Plan The two eastern parcels have been mined and the excavated arfus '_' have filled with ground water to 4-6 feet below the adjacent ground elevations. There will be no dewatering operations or runof` froI either of these to parcels which would have the potential of Lousing pollution to any state waters . There will be no dewatering operation from the west parcel . Any ,-' storm runoff from disturbed areas will be directed toward the ex- cavated area. After mining operations cease, the entire nun, I aid J will fill with ground water and serve as a small lake or pour' J All three parcels could collect agricultural runoff and prevLnl it from entering surface waters. -, C. Project Water Requirements There will be no project water requirements for the development , J mining and reclamation phases other than occassional dust control J operations. The amont needed for dust control is not expectr 'l to exceed 1000 gallons per week during dry conditions. -J J Il U By spreading recently excavated sand and gravel on haul roads , J the need for dust control measures would be eliminated. Although there will be a measurable amount of water lost through J evaporation from the pond surface, it should not exceed the amount lost through evapotranspiration from agricultural crop production. Water Rights and Sources -.i According to the Executor's Deed contained in this application, the owner of this property also owns 86 shares of capital stock of J Luptonlleadows Ditch Company and on adjudicated irrigation well together with pump, motor, and any and all other water rights or J , equipment used in connection with the operation of the property J E. NPDES Permit The operator has applied for an NPDES Permit from the Water Quality J Control Division at the Colorado Department of Health J -J J J J J -J J f J \ 1 EXHIBIT II WILDLIFE INFORMATION -J A. Significant Wildlife Resources J This is primarily an area of small game species (du, Is , geese, rabbits, etc. ) and common non-game species. _J B. Included are sone soils with clay loam subsoils and some soils with evidence of poor drainage. Also in- __J cluded are some long narrow streaks of sand and gravel deposits. Typically _, the surface layer is grayish brown loam about 10 inches thick. The subsoil is brown to light yellowish brown clay loam and sandy clay loam about J 15 inches thick. The sub stratum is calcareous loamy sand or sandy loam about 6 inches thick over sand and gravel . Denth to sand and gravel ranges from 20 to 40 inches. Permeability is moderate and available water capacity ,� is moderate. Effective rooting depth is 20 to 40 inches Surface run- off is slow and erosion hazard is low. This soil is used almost entirely for irrigation and is suited to all crops adapted to this area . Wind breaks and environmental plantings are well suited on this soil , in- cluding all trees and shrubs adapted to this area. Trees that are best ,i suited and have a good survival are Rocky Mountain Juniper, Eastern Red Cedar, Ponderosa Pine. Siberian Elm, Russian Olive, and ilackberry. Shrubs best suited are Skunkbush Sumac, Lilac, Siberian Peashruh, and American Plum. This soil can produce habitat elements that are hinhly suitable Li for open wildlife including pheasants , cottontail , and mourning doves ,J Some types of crop production is also suitable for onenland wildlife, especially pheasant. Practices that would enhance open land wildlife ' ' populations could include three and shrub plantings , and undisturbed nesting cover. u v Aquolls and Aouepts , gravelly substratum Lr These nearly level soils are on bottom lands and flood plains of major _d streams. The Aquolls have dark colored surface layers , and the Aouepts are lighter colored. They are deep, poorly drained soils formed in recent alluvium. Typically they have mottled, midly to moderately alkaline, loamy or clayey surface layers and underlying material , and are under lain by sand and gravel within 48 inches. Most of these soils are sub- ject to flooding with the watertable located at or near the surface early in the spring, and receding to a death of 48 inches by Litn fall in some `i years. While most of these soils are used for rangeland and wildfire habitat, some have been reclaimed by major drainage and leveling operation, Li to productive farm land. The potential native vegetation on these soils 's dominated by alkali sacaton, switchgrass , western wheitgrass , saltgrass , LA edne, rush, and alkali bluegrass. LA LA LA LA J Dacano Clay Loam J This is a deep, well drained soil formed in mixed alluvium. Included are some long, narrow streaks of sand and gravel deposits. Depth to sand and gravel ranges from 20 to 40 inches. Permeability is moderately slow and available J water capacity is moderate. Effective rooting depth is 20 to 40 inches, surface run-off is slow, and erosion hazard is slow. B. Suitability for Plant Growth The Altvan loam soil is suited for all crops commonly grown in the area. Windbreaks and environmental plantings are generally well suited on this soil . All trees and shrubs adapted to this area will grow. Crop Production The western one-third of the west parcel has the potential to be used for rangeland. Seasonal Precipitation J Weld County has a climate consisting of semiarid steppe with mod- erately cold winters and warm summers. The area has low relative humidity and less than 15 inches of precipitation a year. The pre- `J cipitation is mainly in the form of thunderstorms, occasionally accompanied by hail and strong winds. Most of the precipitation occurs during the 140 day growing season. This amount is sufficient J to support native grasses and shrubs. B. Temperature Ranges Seasonal temperatures range between an average of 23.8°F in January to 74.80F during July. Periodic extremes find temperatures falling near zero a few days each winter and swimmer hot spells in the 90's, lasting one to two weeks. J J J J J J J J U \..../ EXHIBIT L RECLAMATION COSTS -J Because of the type of proposed reclamation and final land use, the costs i -J of reclamation are expected to be negligible. This is to say that the time and equipment costs to the operator above and beyond those expected for the J mining operation itself will be very small . The mining plan and mining meth- --, ods , which the operator has used in the past, have proven to result in an area that can be reclaimed to a conservation/wildlife habitat land use without ex- .--1 pensive reclamation efforts. The operator and owner, Weld County, being a governmental organization, is un- der unique financial constraints. It is more economical for Weld County to fol- d low a mining plan which will facilitate a natural reclamation process than to �, reclaim the land for other uses. The proposed land use was selected, in part, because of the negligible cost of reclamation. That portion of the site located in Section 18 has been approved for gravel extraction by the County.
