Comments made during this phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS AND REQUIREMENTS: Colorado State Highway 52 is under CDOT jurisdiction. Weld County does not maintain this roadway. Access: Utilize the existing access to this parcel. No new accesses are requested. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2418) to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (State Highway 52) Ohe applicant shall indicate specifically on the plat the type of right-of-way/easement that exists on the property. Storm Water Drainage: The historical flow patterns and runoff amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. This area IS in FEMA Regulatory Floodplain Floodplain Restrictions—the entire property is located in the Zone A Special Flood Hazard Area (floodplain) for Boulder Creek, as published on FIRM Panel 080266-0850-C, dated September 28, 1982. 1. The applicant must provide evidence that the proposed development and associated structures proposed for the USR are reasonably safe from flooding, under requirements published in Title 44 of the Code of • Federal Regulations (44 CFR), Sections 60.3 and 65.2(c). All proposed buildings and accessory structures on the parcel are currently located in the FEMA regulatory floodplain for Boulder Creek, and may or may not be located in the floodway. I a. Weld County will not permit any development (as defined by 44 CFR 59.1) that would occur in a • floodway and cause any rise on adjacent properties, per Weld County Code 23-5-250. b. If an appropriate Letter of Map Change (LOMC) is not approved by FEMA, then the current effective Zone A SFHA will be enforced from FIRM Panel 080266-0850-C. 2. Areas located in a SFHA will likely be inundated during a 100-year storm event, and will provide no detention storage if fully- or partially-filled. SFHAs need not be detained, but must provide structural appurtenances for water quality treatment. If a LOMC is provided to show the property is above the BFE, then detention of the 100 year developed condition rainfall and release at the 5 year historic undeveloped will be required. The current Letter of Map Amendment (LOMA) dated May 17, 2007, case# 07-08-0556A for the property is applicable only to the existing structure, and may not be used for any new development on the property. 3. A Flood Hazard Development Permit (FHDP) must be prepared for, submitted to, and approved by Public Works for any development in the SFHA prior to the issuance of any grading or building permits in the floodplain. pc: USR-1636 The applicant.shall address the comments listed above for this review process. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. • 2. The applicant shall provide written evidence to the Weld County Department of Public Health and Environment that the applicant has contacted the Colorado Department of Agriculture (CDA), Division of Animal Industry. This contact shall determine if a license under the Pet Animal Care Facilities Act (PACFA), as defined under C.R.S. 35-80-101 through 117. C.R.S. is required, or provide evidence that the applicant is not subject to the PACFA requirements. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • • We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed Office/Kennel and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to operation: 1. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a • stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. • 2 • 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 5. The applicant shall operate in accordance with the approved "waste handling plan". 6. The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of Animal Industry, if applicable. 7. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. 9. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility. 10.Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, • pertaining to Individual Sewage Disposal Systems. 11.The facility shall utilize the existing public water supply. The Fire District does not object to the project, provided the project is able to meet the requirements of the Fire District. Based on my review, I have the following comments: • Water supply for fire protection is required for this use. In accordance with Appendix 111-A of the Uniform Fire Code,the required fire flow for the building will be either 1,500 gallons per minute or 1,750 gallons per minute, measured at a residual pressure of 20 pounds per square inch based on the construction type of the proposed building. At least one fire hydrant must be provided such that it is within 450 feet of all portions of the building as measured along apparatus access routes and around the exterior of the building. The site plan submitted did not include show the location of • proposed fire hydrants. • Fire apparatus access to the building appears to be adequate as indicated on the plans. Fire apparatus access roads must be designed and maintained to support the imposed loads of fire apparatus(75,000 pounds). • Building construction plans and the final site plan showing a code analysis which includes, the gross square footage of the building, the building construction type, and occupancy classification(s) must be submitted to the Fire District for review and approval before building permits may be issued. • A final inspection of the occupancy by a member of the Fire District will be required before a Certificate of Occupancy is issued. Nothing in this review is intended to authorize or approve of any aspect of this project that does not comply with all applicable codes and standards. We offer the following comments and recommendations regarding wildlife. District Wildlife Manager Jason Duetsch visited the site located on approximately 13.74 acres north of Hwy 52 and 3.25 miles west of WCR 3.25 on October 296, 2007 at 4:00 p.m. General observations included: a very large active black-tailed prairie dog colony centered on the northern 2/3 of the property that spanned across the property • and onto the neighboring parcels on the east and west. There were also many cottontail rabbits. Under current land use conditions, we would expect to find a variety of mammals including,but not limited to: coyotes, foxes,raccoons,rabbits and black-tailed prairie dogs. The area is also typical habitat for avian species including,but not limited to: songbirds and raptors such as bald eagles, red-tailed hawks and american kestrels. Prairie Dogs Prairie dogs are an important food source for hawks,bald eagles and coyotes. Removal will likely create food stresses to these species. Trapping/transplant efforts or euthanasia are legal options if prairie dog removal is desired. • It is recommended that prairie dogs be removed only where necessary • Prairie dog removal on this site should be required prior to development or construction work begins • Euthanasia efforts must occur through the use of approved toxicants and trapping/transplanting of prairie dogs requires prior approval of the DOW and may require approval from the county commission • Note that bulldozing active prairie dog colonies is not an acceptable method of removal • DEPARTMENT OF NATURAL RESOURCES,Hams D.Sherman,Executive Director WILDLIFE COMMISSION,Tom Burke,Chair•Claire O'Neal,Vice Chair•Robert Bray,Secretary Members,Dennis Buechler•Brad Coors•Jeffrey Crawford•Tim Glenn•Roy McAnally•Richard Ray Ex Officio Members,Harris Sherman and John Stulp Birds Burrowing Owls,a species listed on the Colorado Threatened Species List, are known to occur within Weld • County and rely on prairie dog burrows as critical nesting habitat. As a migratory species and a raptor,both the USFWS and the Colorado Division of Wildlife protect Burrowing Owls. The critical nesting period for Burrowing Owls occurs between March 1 and October 31. When confronted with human disturbance near nest sites, Burrowing Owls abandon the nest. Efforts to relocate nesting owls have generally proven to be ineffective. If possible, construction in and around prairie dog colonies should be sequenced to avoid critical nesting periods for Burrowing Owls. If it should be necessary to break ground during the critical nesting periods for Burrowing Owls, impacted prairie dog towns should be surveyed for Burrowing Owls by a biologist certified for such work prior to onset of construction. If owls are found to occupy prairie dog towns,the active burrows should be protected as specified by accepted guidelines. The Division of Wildlife can provide specifics upon request. DOW identifies Bald Eagle activity near boulder creek approximately 0.45 miles away. This activity includes roost sites, summer and winter forage areas, and a winter concentration area. It is recommended that hours of construction be set for between 9 a.m. and 4 p.m. Dogs • Dogs must not be allowed to harass,chase,or disturb wildlife including ducks,geese and rabbits • It is recommended that a leash law is established for dogs traveling to the north of the customer parking lot • It may also be appropriate to designate the"dog exercise areas"away from the pond and other riparian areas within the development • Concerns regarding Construction Equipment With new construction taking place and machinery being transported from one site to another, it is important to help prevent the spread of noxious weeds. Noxious weeds reduce property value and wildlife habitat. Care should be taken to avoid spreading and introducing noxious weeds. Equipment should be cleaned periodically to remove weed seeds even if no weeds are recognized. The area should be promptly revegetated using native species to prevent erosion and invasions by weeds. It is also recommended that a weed management plan be developed for during construction and for at least 5 years after construction. Please note that we do not have information on threatened/endangered plants or invertebrates.
