RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A DOG BREEDING FACILITY AND KENNEL - HERBERT W. LEGG WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 27th day of July, 1983 , at the hour of 2 : 00 o 'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Herbert W. Legg, 15357 Weld County Road 18 , Fort Lupton, Colorado 80621 , for a Use by Special Review for a dog breeding facility and kennel , on the following described real estate, to-wit: Part of the Wz SW4, Section 22 , Township 2 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1 . The submitted materials are in compliance with appli- cation requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a) The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. b) The proposal is consistent with the intent of the Agricultural Zone District; and is provided for as a Use by Special Review. c) The activities proposed will be compatible with existing agricultural uses in the neighborhood, as well as the projected development in the future. The future uses are intended to remain agricultural in nature. The attached Standards for Use by Special Review be adopted. 2 . The plat for the use permit be placed of record by the Department of Planning Services staff prior to any build- ing permits being issued on the site. 3. Prior to starting the dog kennel operation, the applicant shall submit a letter from the Division of Water Resources indicating that an adequate water service is available to service this facility. LEGG USR-557:83:20 1. The use permitted on this site shall be a dog kennel operation as described in the application materials on file in the Weld County Department of Planning Services. The kennel operation shall not exceed eighty-five (85) dogs. 2. The dog breeding facility and kennel shall comply with all applicable Weld County Health Department and Colorado State Health Department regulations. 3. Design standards for Uses by Special Review, Section 24.5 et seq. of the Weld County Zoning Ordinance shall be complied with. 4. Operation Standards for Uses by Special Review, Section 24.6 et seq. of the Weld County Zoning Ordinance shall be complied with. 5. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 6. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated standards may be reason for revocation of the Permit by the Board of County Commissioners. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated June 20, 1983, and duly published on June 23, 1983, in the LaSalle Leader, a public hearing was held for the purpose of considering the request of Herbert W. Legg for a Use by Special Review for a dog breeding facility and kennel. Mr. Morrison read this request into the record. Rod Allison read the favorable recommendation, with conditions, from the Planning Commission into the record. Mr. Legg was present. Mr. Legg gave a short presentation on what he plans to do if this request is approved. He explained where the kennels would be located on this property for his Greyhound racing dogs. After further discussion, Commissioner Brantner moved to approve this Use by Special Review for a dog breeding facility and kennel for Herbert W. Legg with the conditions as set forth by the Planning Commission. Commissioner N. Carlson seconded the motion and it carried unanimously. Along with this item, the Board also considered the request of Adolph and Bettye Anderson for Recorded Exemption No. 616. Mr. Morrison explained that this request is in conjunction with the above Use by Special Review. Rod Allison said this request is to split off 10 acres from the 57.5 acres for the Use by Special Review proposal which was just approved. He then read the favorable recommendation, with conditions, by the Planning Department into the record. Mr. Herbert Legg, representing Mr. Anderson, answered questions of the Board. After discussion, Commissioner Martin moved to approve RE #616 for Adolph and Bettye Anderson and to include the conditions recommended by the Planning Department. Commissioner Brantner seconded the motion and it carried unanimously. C C SUPPORTING STATEMENTS A. Consistency with Weld County Comprehensive Plan. Dog Kennels are use specifically allowed by special use permit on agriculturally zoned areas. B. Consistency with Intent of Ap icultural District . Proposed SUP area is sandy marginally productive agland which is presently sitting fallow. Because of its proximity to Weld County Road 18 and adjacent existing development and uses, its continued use exclusively for agricultural uses only is not its highest or best use. No substantial diminuation of agricultural resource land will be served by approval of the requested SUP. C. Consistency with Adjoining Existing Uses . To the east, the subject property is adjoined by a waste oil disposal site . The next property to the east is an existing dog kennel . Immediately to the west is ag. land owned by Adolph Anderson, who joins in this application. The next property to the west also contains an existing dog kennel . Whether by design or default, this immediate area has become dog kennel oriented. In light of those udes no inconsistency of use is presented by the application. D. The system must be sized to include both homes if only one system is planned. 2. Burial of animal waste on-site must be covered daily by two feet of soil but the wastes should not be placed any deeper than six feet due to area groundwater levels. 3. The operation must not exceed the noise standards as specified in the Colorado Noise Abatement statutes 25-12-101 et. seq. C. R. S. 1973, as amended. S ;`. 4. Health statutes opedi£lLally do not regulate greyhound kennels if such dogs are used in racing. The Racing Commission of Colorado has guidelines which then must be followed. Mr. Anderson's RE stated that greyhounds will be raised. The Legg USR did not. If dogs other than greyhounds used for racing are raised, then Colorado health regulations relating to kennels would be applicable. Legg on a zoning permit for a mobile home and accessory structures , we are opposed to the subdivision of any more land in our area. At the time we purchased 25 acres from Adolph Anderson the county commissioners stated that the rest of Mr. Andersons land could not be subdivided. It would either have to be sold to people surr- ounding his land or sold in one piece as it lays. We are also opposed to having dogs on both sides of us. It is too close for as many dogs as these people have and we would have to listen to these dogs 24 hours a day. We feel that things in our area need to be cleaned up a bit before more subdivision is permited. Also , the land in question is not big enough in our opion to adequately be occupied by more than one mobile home. These people have told us that they will be putting three mobile homes on the land. That is entirely too many homes for this area. Thank you for letting us know when the meeting will be held.
