HomeMy WebLinkAbout20080597.tiff RESOLUTION RE: APPROVE ACCEPTANCE OF DEED OF DEDICATION FOR RIGHT-OF-WAY ON COUNTY ROAD 48 AND AUTHORIZE CHAIR TO SIGN - HERB SMITH PROPERTIES, LTD. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Deed of Dedication between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Herb Smith Properties, Ltd., with terms and conditions being as stated in said Deed of Dedication, and WHEREAS, after review, the Board deems it advisable to accept said Deed of Dedication, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Deed of Dedication between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Herb Smith Properties, Ltd., be, and hereby is, accepted. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Deed of Dedication. The above and foregoing Resolution was,on motion duly made and seconded, adopted by the following vote on the 13th day of February, A.D., 2008. Attached is a Deed of Dedication from Herb Smith Properties, Ltd. and other owners of property located in Section 8, Township 4 North, Range 68 West of the 6`h P.M., Weld County, Colorado. Apparently this is associated with RE-4652. Note that the Acceptance has a caveat that makes it so that acceptance of the transfer of the property does not mean that Weld County is obligated to maintain the dedicated roadway. Don Carroll states that the Public Works Department has no objections to the dedication and acceptance of the road. Please let me know if you should have any questions. 1 Bruce-T.
