Such hearing is the final hearing at which testimony, exhibits, or any other evidence may be introduced. If the decision of the BAA is further appealed to the Court of Appeals, only the record created at the BAA hearing shall be the basis for the Court's decision. No new evidence can be introduced at the Court of Appeals. (Section 39-8-108(10), C.R.S.) You and the CBOE select an arbitrator from the official list of qualified people. He also has the power to administer oaths, and all questions of law and fact shall be determined by him. The arbitration hearing may be confidential and closed to the public, upon mutual agreement. The value of our house has gone down not up. Therefore our taxes should be reduced not increased. The increase from $424,130 to $607,721, an increase of$183,591 or over 40% is what we're asking you to change for the following reasons: *Eric Kromwall from Remax said our house would sell at$400,000 as of May 4, 2008. He is the second realtor we've consulted. That is $40,000 less than we paid for it six years ago. *Five houses in Harborwalk, our neighborhood are going into foreclosure with the L/u o r; sl:i :_ auction dates set for Junel8th and June 12a'. Our realtor said after 1 or 2 foreclosures the y 1 1 Cysk, k homes in the immediate area are worth less. That is the state we're in and was the'5-,,,`01 ' r c 2 state when the assessment occurred. 1 540 4 *One of the houses in foreclosure, 400 Crystal Beach, was one of the homes used to compare our house with and its value dropped to $514,900 from $790,000. A reduction of$275,000. This house was sold from one investor to another and has never been lived in. It was artificially high. *The most recent sale, across the street (at an angle) from us was purchased for $416,102 (with a finished basement) and sold for$391,804 after taking two additional reductions of $4,896 for the seller paying points and $11,300 for a seller/credit/buyer incentive. Causing a loss of$24,298. *Twelve houses are on the market. Five, as I said are in foreclosure. Attached are several of the other houses listings. Many are not just reduced, they are significantly reduced. Prices for new construction across the street is $263,900. Reduced are $284,900, $349,900, $399,900, $399,900. Patio homes were overpriced. *We, unlike some of our neighbors, only have a 2 car garage, only have 2 bedrooms upstairs, have both the cheapest tile and cheapest carpet throughout. We do not have 40‹. fireplaces outside. We have white appliances. We didn't upgrade .At the time of the assessment didn't have a finished basement. Our neighborhood is still not finished after six years. There are piles of dirt and debris, with vacant homes for years. Our first realtor said our home without a finished basement would sell for$370,000. With a finished basement it would sell for $44;000, so we finished it ourselves earlier this year. Therefore it is worth more than the $370,000 now. Please reconsider your initial assessment. We feel it should be not more than we can list it for. We believe an increase in value of 43.28% (from $424,130 to $607,721) is unfair and creates a true hardship for us (we are retired educators from Ft. Collins). There are many reasons we feel our house has gone down in value each year we have lived in it-including the time specified in this assessment period. Because of time (we think we have 15 minutes to present our case)we have included just three reasons why we think the value of our house during the said period was$400,000. 1. During the specified time our house had only 2 bedrooms and a 2 car garage and an unfinished basement. Unlike other houses in our area, we opted for the cheapest carpet and tile throughout. We are appealing the assessor's determination of our valuation increasing $183,591, an increase of 43% for the reasons listed below. There is an important difference between our house and the ones it may be compared with. Our house was the first one to be built and occupied in Harborwalk now called Claremont. We are retired educators and took the basic(below average many times) options on everything from tile, carpet, white appliances and etherother options. The subsequent owners put in many upgrades. We didn't and our house is very basic. Some specifics are: 1.We do not have a finished basement. All of the others have one or are in the process of putting one in. 2.We only have a 2 car garage. 3.We only have 2 bedrooms. 4.We did not upgrade our home like our neighbors. We were the first house built and we have low grade tile and basic low grade carpet. Ashcroft who built our home has left the project in shambles. 5.We do not have a kitchen island,nor any built-in outside fireplaces, like our neighbors. 6.Nothing is selling in our neighborhood. It has such a bad reputation that the builder changed the name from HarborWalk to Claremont. 7.Problems in the neighborhood are many. Our sump pump has run lots in the past. 11.Major settling has occurred with some homes. If you drive through you will see piles of cement from patios of homes that have to be torn out. 12.These homes have not gone up in terms of saleable value. Water Valley south waterfront lots are 100,000 this year. There subdivision have lots of extras as standard-such as tennis courts, large green belts, and street parking in the neighborhood and many extras as standard in the house. hi our subdivision the homes are packed in like sardines, the city won't allow parking on either side of the street beacause the streets were designed so narrowly to allow Ashcroft to pack in more houses. E rn 13. The patio homes are being reduced dramtically to sell such as the one in Oasis Z (() that was listed for$479,900 and sold for$418, 126 on 9/30/2005. This house matches ours very closely. 14. For these reasons people aren't buying here and why we think our neighborhood , is struggling and our house is worth significantly less than your assessment.
