HomeMy WebLinkAbout820614.tiff RESOLUTION RE : APPROVAL OF RECORDED EXEMPTION NO. 530 - LAZY D GRAZING ASSOCIATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners at a public meeting held on the 20th day of January, 1982 in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 530 , being the property of Lazy D Grazing, described as W1/2 &WEE# of Section 24, Township 12 North, Range 66 West of the 6th P.M. , Weld County, Colorado, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE , BE IT RESOLVED by the Board of County Commissioners that the hereinabove described parcel of land owned by Lazy D Grazing Association be , and hereby is , exempt from the definition of the terms "subdivision" and "subdivided land" . Grazing Association for a recorded exemption. The parcel of land under consideration is described as the 1Wi WZ EZ of Section 24, T12N, R66W of the 6th P.M. , Weld County, Colorado. This property is located 7 miles north and east of Rockport, 21/2 miles east of Weld County Road 138 and Highway 85. The property contains 474 acres, plus or minus , of range-land in the agricultural zoned district. The existing improvements are on the proposed 20 acre parcel . The 454, plus or minus, acres will continue to be owned by the Lazy D Grazing Association. The Lazy D. Grazing Association wishes to sell the 20 acres, plus or minus , parcel with the existing improvements. Based upon the information submitted in the adopted policies in the County the Department of Planning Services staff recommends this request be approved for the following reasons : 1. The request complies with the submission requirements of Section 9-2 C. 2. The request complies with section 9-2 E as follows : The 474 acres under consideration will allow agricultural and related uses to be the predominant uses ; and the residential density will not exceed the limit as defined in the Weld County Zoning Ordinance. The use will be compatible with surrounding agricultural uses . - These facts support the proposal as being consistent with the intent clause of the agricultural district; the proposed use being compatible with existing and surrounding land uses; the proposed use not being inconsistent with efficient and orderly developments ; the proposal being in compliance with Section 1-3 of the Weld County Subdivision Regulations; and the proposed land division complying with the Weld County Comprehensive plan'. F7061.4 January 20, 1982 Page 2 - A letter from the Division of Water Resources dated January 7, 1982 and discussion with the applicant indicate the proposal will have an adequate water supply. - Weld County Road #138 will serve as the public road for this proposal . - A phone conversation on January 15, 1982 with a representative of the Weld County Health Department indicates the sewage disposal system is adequate. - The proposal does not exist in an Overlay District Area . - The proposed parcels are not part of a recorded exemption within the last five years. - The proposed parcels meet the minimum size require- ments for land divisions . After the transaction with Mr. Dulin was closed the improvements upon the premises were unoccupied. The Association explored several possibilities as to the use of the improvements. They had no immediate use for themselves. Mr. Ricky A. Cranmore and Robin Cranmore contacted the Lazy D Grazing Association through a real estate agent (Atlas-Dean Realty Company in Cheyenne, Wyoming) and made an offer to purchase the improvements and 20 acres surrounding the improvements. The offer has been accepted by the Lazy D Grazing Association subject to approval of a Recorded Exemption. As stated, the Lazy D Grazing Association has no need of the improvement itself. The improvements upon the property can be made habitable and Mr. and Mrs. Cranmore expect and intend to reside thereon. As a matter of fact, they intend to make rather substantial improvements to the property. If there is any hesitancy about granting the Application for Recorded Exemption we would appreciate it if you would advise us so that the officers and directors of Lazy D Grazing Association may appear before you: to give you any other information which you would require before you grant their request.
