Dear Ms. Hippely:
This referral does not appear to qualify as a"subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition,the comments provided herein cannot be used to guarantee a viable water supply
• plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information the site will be served by an existing well constructed
under well permit no. 178537. The well is permitted for ordinary household purposes inside three
single family dwellings, fire protection, the watering of poultry, domestic animals, and livestock on
farms and ranches, and the irrigation of not over one acre of home gardens and lawns. The well was
constructed on July 15, 1994 into the nontributary Laramie-Fox Hills aquifer.
The referral information does not clearly specify all of the proposed uses for the well,
however, it appears that water from the well will be used to serve the home and shop, which will be
utilized by a maximum of 9 employees. In addition, water from the well will be used for landscape
irrigation around the home and the watering of large domestic animals (horses and steers). Since the
employees will utilize the drinking and sanitary facilities at the site, and water from the well may also
be used as part of the commercial operation, such uses are considered commercial and are not
allowed under the existing well permit. Therefore, the subject well cannot be used, as currently
permitted, to serve the site. If the well will be used for the purposes described, a new well permit
must be obtained for commercial, domestic, irrigation and livestock watering uses pursuant to C.R.S.
37-90-137(4).

Environmental Health Services has reviewed this proposal; there is a septic system for an
existing house and horse barn on the property(G19940320). The USR request is for a pipeline
directional drilling equipment business. There are no contaminated soils associated with this
business. The mud and water from the business are disposed on the site, east of the irrigation
ditch, which is outside the 100-year floodplain boundary. We have no objections to the
proposal; however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be recorded:
1. The applicant shall submit evidence to the Department of Planning Services, from the
Colorado Division of Water Resources, demonstrating that the well is appropriately

permitted for the commercial use.
2. The septic system serving the existing residence and horse barn shall be reviewed by a
registered professional engineer for the residence and business use. The review shall
consist of observation of each system and a technical review describing the systems
ability to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public Health
and Environment. In the event the system is found to be inadequately sized or
constructed, the system shall be brought into compliance with current Regulations.
3. The applicant shall delineate on the plat map where the mud/water disposal is located on
the site.
4. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment for the parking areas, access roads, and for the mud/water disposal site.
5. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
• 2) A list of the type and volume of chemicals expected to be stored on site.
• 3) The waste handler and facility where the waste will be disposed (including the facility
name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in
a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the Solid
Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions.
4. Only clean, uncontaminated soil shall be disposed of on site.
5. The applicant shall operate in accordance with the approved "waste handling plan".
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
• 7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate handwashing and toilet facilities shall be provided for employees and patrons
of the facility.
9. Any septic system located on the property must comply with all provisions of the Weld
County Code, pertaining to Individual Sewage Disposal Systems.

Upon review of my case files and computer, an active Zoning Violation (ZCV07-01111)was noted. This
violation was initiated due to the operation of the directional drilling operation without first obtaining the
necessary Weld County Zoning Permits. This case has not been presented to the Board of County
Commissioners through the Violation Hearing process.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, please ask the Board of County Commissioners to refer this case to the County
Attorney's Office, but to delay legal action for 30 (thirty) days in order to give them adequate time to
ensure that all operations and advertisements have been removed from the property.

Description: Change of use from a R-3 to B
There are 3 historical Building permits attached to this parcels .All have been finaled
1. A building permit shall be obtained prior to the change of use or construction of any
structure.
• 2. A plan review is required for each building for which a building permit is required. Plans shall
include a floor plan. Plans for new structures shall bear the wet stamp of a Colorado registered
architect or engineer. Two complete sets of plans are required when applying for each permit.
Include a Code Analysis Data sheet provided by the Weld County Building Department with
each Building permits application. Building plans shall also be submitted to Fort Lupton Fire
Protection District.
3. Buildings shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code; 2006 International Fuel Gas Code; and the 2005 National Electrical Code and Chapter 29
of the Weld County Code.
4. Building height shall be measured in accordance with the 2006 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of
construction and to determine compliance with 2006 International Building Code. After preliminary
review and site inspection.
5. All building plans shall be submitted to the Fort Lupton Fire District for review and approval prior
to issue of Building Permits.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 23 is a paved collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The applicant shall reserve or dedicate an additional 10-foot right-of-way parallel to the WCR 23 right-of-way
ar future build-out.
Our most current average daily traffic (ADT) count reflects 103 vehicles taken per day in 2006 and 2007 near
WCR 23 near this location. This USR application will add about 60 vehicle trips per day per the data supplied
by the applicant.
REQUIREMENTS:
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel.
Access:
The applicant indicated an existing access point onto WCR 23. This access shall have adequate turning
radiuses and the grade of the internal road system shall match the grade of WCR 23.
Storm Water Drainage:
The applicant shall provide documentation on how the storm water drainage is proposed to be handled on site
and disbursed.
All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed
USR from a one-hundred-year storm and release the detained water at a rate not to exceed the rate of a five-
year storm falling on the undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and 2006-7). All
storm water must be detained on site and follow the requirements per Weld County Code 24-7-130 D and
Ordinance 2006-7. Since this USR site is next to the 100-yr floodplain Public Works will waive the above
requirement and require the applicant to detain the fully developed USR from a ten-year storm and release the
iietained water at a rate not to exceed the rate of a five-year storm falling on the undeveloped site. The
pplicant shall also provide Water Quality Capture Volume as part of the detention requirement. The detention
pond shall capture the driveways, parking lots, buildings and area delineated as part of this USR stormwater
runoff. It shall be located to gravity flow into a roadside ditch, it shall be outside the 10-yr storm floodplain
limits and any overtopping shall be properly protected to prevent erosion and failure.

•ffsite runoff flows onto the site must be managed through the site, and contours shall be shown on the site
plan for a minimum of 200' from the property line, or as far as necessary to show the entire offsite contributing
area.
Please provide a figure in the Drainage Analysis that shows proposed conditions contouring for the site.
The applicant must take into consideration storm water quantity capture and provide accordingly for best
management practices.
Please provide more detailed information concerning the mud and water being dumped in the middle of the
site. Show the dumpsite location clearly on the USR plat. This dumpsite should be contained, lined and not
allow material to leave the site or enter the South Platte FEMA regulatory floodplain.
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
plan.
A portion of this parcel IS in a FEMA regulated Flood Zones. Show the FEMA regulated 100-yr floodplain on
the final USR plat.
The applicant will need to apply for another Flood Hazard Development Permit (FHDP) for any future
structures or fill to be located in the regulatory 100-year floodplain shown on FEMA's FIRM map(s)that include
the site. If they propose any fill in the floodplain (for structures, driveways, other construction), they will need to

rovide evidence in the form of a hydraulic analysis to ensure no construction is within the floodway and that
e fill does not block flow and cause any flooding impacts on adjacent properties or roadways.
Parking lot and internal drives:
Explain in detail what type of proposed surface will be or is installed for the driveways and parking lots include
dimensions to describe the size of these areas and the size of the existing and proposed buildings.
A stop sign shall be placed at the intersection of WCR 23 and the driveway into the USR facility to stop
westbound traffic entering onto the WCR 23.
Place signs to indicate where the trucks and trailers are to park.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access
road(s) for a commercial access.
Striping and signs will be required to define parking stalls for employees and visitors and for semi truck
parking.
All parking for the site must be off street and internal. Each parking space shall be equipped with wheel guards
or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from
coming into contact with other vehicles, walls, fences, plantings or buildings.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
"become established as a result of the proposed development, the applicant/landowner shall be responsible for
ontrolling the noxious weeds.
