RE: APPROVE VACATION OF USE BY SPECIAL REVIEW (USR) PERMIT #248,
AMUSR #248, AND 3RDAMUSR #248 - VARRA COMPANIES, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 24, 1974, the Board approved Use by Special
Review (USR) Permit #248 for a Gravel Pit Operation for Jack Varra, Route 2, Box 640,
Broomfield, Colorado, on the following described real estate, to-wit:
A tract of Land located in the NW 1/4 of Section 31,
Township 3 North, Range 67 West of the 6th P.M.,
Weld County, Colorado, and
WHEREAS, by Resolution dated July 17, 1985, the Board approved Amended Use by
Special Review Permit #248 to include an additional 155 acres in a Wet, Open-Cut Sand and
Gravel Mining Operation for Varra Companies, Inc., do Gilbert Rindahl, 2305 South Syracuse
Way#217, Denver, Colorado 80231, on the following described real estate, to-wit:
Part of the NE1/4 of Section 31, Township 3 North,
Range 67 VVest of the 6th P.M., Weld County,
Colorado, and
WHEREAS, by Resolution dated September 19, 2001, and subsequently corrected on
October 29, 2001, the Board approved Third Amended Use by Special Review Permit#248 for a
Solid Waste Disposal Facility(coal ash burial project), in the A(Agricultural)Zone District,for Varra
Companies, Inc., 12910 County Road 13, Longmont, Colorado 80504, on the following described
real estate, to-wit:
Part of the N'W 1/4 of Section 31, Township 3 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from Varra Companies, Inc., do Bradford
Janes, 1431 East 16th Street, Greeley, Colorado 80631, to vacate said Use by Special Review
Permit#248, AmUSR #248, and 3rdAmUSR #248, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#248, AmUSR#248, and 3rdAmUSR#248
be, and hereby are, vacated.

The Department of Planning Services has received the attached letter dated May 12, 2008 from
Bradford Janes for Varra Enterprises. Mr. Janes is requesting that USR-248, AMUSR-248 for
gravel mining & 3rd AMUSR-248 for a fly ash study be vacated.
Background information:
Legal Description: Part of N2 of Section 31, Township 3 North, Range 67 West of the 6th
P.M., Weld County, Colorado
Location: West of and adjacent to CR 13 and approximately 1 mile north of CR 26.
USR-248: USR-248 was approved by the BOCC on June 24, 1974, for a gravel pit
operation in the A (Agricultural) Zone District
AMUSR-248: AMUSR-248 was approved by the BOCC on July 17, 1985, for a gravel
pit operation in the A (Agricultural) Zone District
3rd AMUSR-248: 3rd AMUSR-248 was approved by the BOCC on September 19, 2001, for
a solid waste disposal facility (coal ash burial project) in the A
(Agricultural) Zone District

Hi Jacqueline -
I'm re-sending you a FAX of my correspondence of 29 February that reads in the
manner you described, below, along with the relevant attachments. Perhaps this
correspondence - sent to the Southwest office on that date, and later faxed to 720-
652-4211 on 2 April - never reached your desk?!.
This correspondence specifically requests the Actions requested to be taken; i.e.,
to Vacate these USR's (#248 #1,#2, and #3); along with the documentation for the
release of the operations by DMG and State Health. It requests in the first
paragraph that 'all lands under USR 248 should be vacated and the lands resume
their A-Agriculture status.'
In addition to the stated request, the three USR are citied both before and after this
paragraph stating the request: to vacate, showing the three named USR's with the
described action: 'vacate'). Please look over this correspondence and let me know if
this language works? It appears to fit your description - so I'm a bit perplexed at
this point as to the nature of the problem - as I thought this correspondence fully
addressed the matter as previously requested.
The only departure is one date in that my USR resolution shows the Resolution date
to be 29 October and not 19 September for USR 248 #3 - but they are by all
appearances the same given the year, actions and location of the USR's as
described. Hope this helps to clarify the request. Let me know.

Here are the proofs of release for the DMG permits you requested_ With the release
of all mining permits and correlated release of the fly ash pilot project from the
Colorado Department of Health, all lands under USR 248 should be vacated and the
lands resume their A-Agriculture status without modification by USR. The release
of these areas by the State of Colorado occurred with the release of the fly ash area
first, fo0owed by a release of the Nelson area second, and last by the release of the
original,Del Camino property, as follows:
1. Vacate [ISR 248 #1:Cor;respondence from the Colorado Division of Minerals
aid Geology (DMG) of 22 September 2005 releasing the original Del Camino
portion. and last remaining area contained in the DMG permit, located in the
NE/4, Section 31.
2. Vacate USR 248 #2: Correspondence from DMG of 28 November 2003 -
re,leasing the Nelson portion of the DMG permit area as located in the NE/4,
Section 31.
3. Vcate USR 248 #3; Correspondence of 2 November 2001 from DMG -
e ctracting the pilot project from the permit area and subsequently the
release of the pilot project and fly ash project with the release of the Letter
of Credit - as indicated in correspondence of 19 November 2003 from the
Colorado Department of Public Health and Environment.

Actions: Update and request for modification of requirements under the USR
process.
Dear Kim & Jacqueline:
Since our meeting Tuesday, I have made contact with both our surveyor and civil
engineer and began gathering and passing along information they will need to
commence the necessary site plan and drainage report requirements for the
forthcoming USR.
As part of our consideration for the survey, the need to obtain binders on adjacent
properties is necessary for the surveyor to obtain right-of-way and easement
locations to place in the survey. This information must be obtained from a land
title company and costs approximately $500.00 for each binder.
Referring to the map, below, showing the affected land and surrounding adjacent
properties: the Del Camino parcel (1) will have a binder ordered, as well as the
property (5) - where the bus depot is. To include the property (6) will only involve
a small tip of that parcel and parcels (3) and (4) are on the West side of the road
with a 70 foot wide easement from the centerline of Section 31. Parcel (2) is land
owned by an owner of Varra Companies, Inc.
We respectfully request relief from showing the R-O-W and easement information
for parcels 2, 3, 4, and 6 on the survey and site plan as they should not be
adversely impacted by the proposed USR. This release from the 200 foot
requirement for these parcel areas will save $2,000.00± in binder expenses.
If necessary to meet the full intent of the code, we do not object to identifying the
owners of easements and rights-of-way for those areas not shown by gathering
information in a good faith effort by other means from either Weld County
Assessor information, Weld County R-O-W department, or UNCC locate data and
including them in the list of adjacent owners for public notice purposes.

Information gathered in this manner would appear as a list of names and addresses
to aid notification.
Binder information for the affected parcel and bus depot should reveal the most
relevant information potentially affecting access and land use impacts under this
USR, and we hope a variation in part or whole as requested can be accomplished.
Please let us know at your earliest convenience as we need to contact the land title
company for the binders and other information required by the surveyor in order
to get the field work underway.
I addressed this concern to both of you since it is a policy matter for Weld County
and was uncertain as to how to best direct the questions. Regardless, thank-you
for your understanding and assistance in this regard.
Finally, since my scanner is not working, I am submitting a request to vacate the
USR's (248) for the Del Camino and related parcels we discussed on Tuesday.
Please look for it in snail mail. It was directed to your office Jacqueline.
I will also endeavor to keep Jacqueline periodically updated by e-Mail of progress
pertaining to the removal of material at the Del Camino parcel and attending
fencing of retained materials. I will inspect the property on every Friday and at a
minimum update you with material progress as I observe it - and most specifically
on 4 April 2008.
Thank-you for your e-Mail Jacqueline, and know the comments and good will of
everyone attending the pre-subrnittal conference was genuinely appreciated. We
look forward to bringing the concerns and desires of Weld County and Varra
Companies, Inc. to a satisfactory conclusion.

On November 26, 2003, the Colorado 'Division of Minerals and Geology approved your Lecucst for
release of tlite Amendment 1 and Amendment 2 areas from Permit M-197'1 052.
The permit <Irea was reduced to your original permit area of 147.9 acres, through the release of the
Amendment areas. Also, during the review of your release request, it was noted that the current
►eyuired bond amount was recorded as $169,802.30, although the Division only has a 5130,500.00
bond on Me. i ecause of the release of the Amendment areas, the Division believes that $I39,500
bond is adequate and acceptable. Please note that because the permit is not totally released, you are
still liable for filing annual reports and fees.

Dear Mr. Adams,
Your request of October 30, 2001 that the Division of Minerals ;aid Geology extract the
coal tly ash pilot project from the MLk13 permit is granted.
Your letter included a map, labeled Figure 3, showing the study arca relative to the mine
peiirut. On that map was an inset map, labeled "l,xhibit D Coal ash tic-rich anti monitoring
well location plan,"upon which arc shown several "proposed monitoring well location"
points. You indicated that Varna wishes to extract the area encompassing the coal ash
trench and monitoring well network, for a total of I A3 acres.
Unless the Division hears from you or Varra Companics further, we shall presume that
the extraction area will circumscribe all of the drill holes shown on the l-:xhibit D inset
map. Please assure that the exclusion area is marked in the field.
The Division remains interested in this projcel and its progress, and appreciates Varra's
willingness to keep us apprised with periodic updates and reports-
