HomeMy WebLinkAbout20083013.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST KENNETH AND VICKI AUGUSTENBORG FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Kenneth and Vicki Augustenborg, ZCV#0800210, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 18th day of November, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Kenneth Augustenborg, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 18, 2009, to allow adequate time for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent properties and public rights-of-way to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. A SCREENING PLAN shall be submitted and approved by the Department of Planning Services. 2008-3013 Violation Summary Report REMEDY As I previously indicated, while a NONCOMMERCIAL JUNKYARD in the Agricultural zone district (such as Wattenburg), consisting of DERELICT VEHICLES is an allowed use it must be completely SCREENED from all adjacent properties and public rights-of-ways. Furthermore, evidence shall be submitted that all screened vehicles belong to the current property owner or tenant. I have noticed on numerous occasions that the vehicles overflow into the street and road rights-of-ways. This is not allowed. During my last inspection conducted on September 26, 2008, I noted: bricks/blocks, buckets, iron/metal, an engine, trash and Derelict Vehicle pouring out into the street. With the exception of the trash, all of the above items shall be Screened or removed. The trash shall be removed from the property. It has become a pattern of abuse that Derelict Vehicles show up and are removed which indicates that some sort of a business is occuring on this property. This would not be an allowed use. RECOMMENDATION The Department of Planning Services recommends that this case be referred to the County Attorney's Office for immediate legal action.
