RESOLUTION
RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 437 - LOIS E.
BOOTH
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , the Board of County Commissioners has previously
approved Recorded Exemption No. 437 for Lois E. Booth concerning
property located in Part of the North Half of Section 6, Town-
ship 3 North, Range 67 West of the 6th P.M. , Weld County, Colo-
rado, and
WHEREAS, Lois E. Booth has requested that Recorded Exemption
No. 437 be amended by increasing the size of Lot A by eight-tenths
of an acre. This amendment would move the existing property line
to include a steel building which lies west of the existing pro-
perty line at the present time, and
WHEREAS, the Board of County Commissioners has studied said
request to amend Recorded Exemption No. 436 and deems it advisable
to approve said amendment.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the amendment to Recorded
Exemption No. 437 , as stated herein, be, and hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 12th day of
November, A.D. , 1980 .

Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Lois E. Booth to amend Recorded Exemption #437. The property is
described as Part of the NZ Section 6, T3N, R67W of the 6th p.m. , Weld County,
Colorado. This property is located 3 miles east and 2 miles north of Mead.
The request is to amend Recorded Exemption #437 by increasing the size of Lot
A by eight-tenths of an acre. This amendment would move the existing property
line to include a steel building which lies west of the existing property line
at the present time.
Based upon the information submitted, the Department of Planning Services Staff
recommends approval of this requested amendment for the following reasons:
1. The impact on surrounding land uses would not appear to be any
different than the original request which was approved.
2. This request is in compliance with Section 9-4 A. of the Weld
County Subdivision Regulations.

To Whom it May Concern:
Pursuant to the enclosed request for Amendment of
Recorded Exemption No. 1209-06-1-RE437 as per the
plat and application attached hereto, I wish to set
forth the following reasons for said request .
The reasons for request for Recorded Exemption were
fully explained in a letter submitted to your office
dated December 10, 1979, by Ullmann Farms who was the
fee owner at the time of application. The reasons
stated in that letter are still valid and I have re-
ceived an offer to purchase Lot "A" of said Recorded
Exemption subject to the inclusion of a steel building
which lies west of the existing property line. This
results in an increase in the acreage of Lot "A" by
approximately . 8 of an acre.
As this request does not alter any of the basic facts
stated in Ullmann Farms ' letter of December 10, 1979,
I respectfully ask for approval by the Planning Com-
mission and the Board of County Commissioners of Weld
County of the enclosed Application for Amendment of
Recorded Exemption No. 1209-06-1-RE437.

To Whom it May Concern : •
Pursuant to the enclosed request for Recorded Exemp-
tion on our Weld County farm as per the plat and ap-
plication attached hereto, we wish to set fortsi the
following reasons for said request.
We are making this request for Recorded Exemption as
present fee owners of subject property , however, we
have contracted to sell said property to Lois B. Booth
with a projected closing date of January 10, 1950.
The property is being purchased by Mrs. Bootn as a
source of feed for a cattle feeding operation in the
vicinity owned by the Booths. The farms will be ' farmed
by tenant farmers living in the area and, therefore,
Mrs . Booth •,:ill have no need for the improvement sites.
The particular buildin7 site detailed in this Recorded
Exemption is currently under contract for sale subject
to acquisition by Mrs . booth and subject to obtaining
the Recorded Exemption and said building site contains
no cultivated acres . The closing on the building site
will be subsequent to the closing of our total sale to
Mrs . Booth. •

WHEREAS, the Union Pacific Railroad Company has tendered
to the County of Weld, State of Colorado, an agreement renewing
for a period of five years beginning January 13 , 1975 , the
term of contract dated October 19, 1931, covering lease of
premises of the Railroad Company in Weld County, Colorado, to
be used for highway purposes, said agreement being identified
as Railroad Company' s C. D. No. 18618- I and A-40646, and
WHEREAS, the Board has said proposed agreement before it
and has given it careful review and consideration, and
WHEREAS, it is considered that the best interests of said
County will be subserved by the acceptance of said agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, that the terms of the
agreement submitted by the Union Pacific Railroad Company
as aforesaid be and the same is hereby accepted; that the

This cause coming on re ,ulerly for trial on the P5th day mad being
concluded on the P9th day of September, 1951, petitioner appearing by
Robert G. Smith and respondent appearing in parson and by taldo and Waldo,
his attorneys; thereupon a Jury of twelve freeholders were duly eeleated,
empeneled and sworn to try said cause, and witnesees on behalf of the re-
spondent and on behalf of the petitioner were duly sworn Brad examined,

After viewing the premises, hearing the evidence end arguments of council

and after due deliberation, a verdict according to law was rendered as to

2. Thence S. 0° 12' E. along said West line of the NEI of the NE} of
Section 20, a distance of 24.7 feet;
3. Thence S. 79° 56' E. a distance of 109.5 feet;

RESOLUTION TO SIGN AGREEMENT WITH
STATE HIGHWAY DEPARTMENT:
WHEREAS, The Board of County Commissioners of Weld County,
Colorado have been presented with an agreement by the State Highway
Department for participation in a Federal Aid Sedondary Project
designated as S-SG 0034(1) to consist of improvements on State
Highway No. 392, beginning at Lucerne and extending easterly, for

which the sum of $50,000.00 has heretofore been pledged by Weld
County for its share in the cost of this project.
NOW, THEREFORE, BE IT RESOLVED, by The Board of County
Commissioners of Weld County, Colorado, that they sign 5 Eopies
of said agreement on behalf of Weld County on the terms and
conditions contained in said agreement, a copy of which is hereto
attached and made a part of this resolution.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote:

AGREEMENT TO PARTICIPATE
IN THE COST OF HIGHWAY IMPROVEMENT

THIS AGREEMENT entered into this_�4_day of (/(/
1950, by and between the COLORADO STATE HIGHWAY DEPARTMENT, hereinafter called the
"Department," and the COUNTY OF WELD, hereinafter called the "County, " WITNESSETH
that
WHEREAS the Department has included in the Budget for 1949 dated January
15, 1949, a Federal Aid Secondary Project designated as S-SG 0034(1) to consist
of improvements on State Highway No. 392, beginning at Lucerne and extending east-
erly, for which the sum of $200,000.00 has been allocated, and in which the County
has previously agreed to participate to the extent of $50,000.00 of the cost of
the project,
NOW, THEREFORE, in consideration of the premises and the mutual covenants
and agreements herein contained, and the faithful performance thereof, the parties
hereto promise and agree as follows:
1. The Department will prepare the plans, specifications and estimates
for the work, will advertise for bids, will award the contract, prepare the month-
ly and final estimates, and pay the contractor according thereto. Also, the De-
partment will arrange for the force account work by railroad, utility and irriga-
tion companies.
2. The County will secure at its own expense all right of way required
for project, as indicated by right of way lines shown on project construction
plans.
3. It is the intent of this Agreement that the County will reimburse the
Department in the amount of twenty-five (25) per cent of the final cost of the
Project, exclusive of right of way, and with the understanding that the charges
for Engineering will not exceed six (6) per cent of the construction cost. If
after bids are received it appears that the final cost will be materially in ex-
cess of the budgeted amount above named, any obligation of the County in excess of
$50,000.00 will be subject to negotiation before contract is awarded.
4. The Department will submit each month a statement covering twenty-five
(25) per cent of the cost of the construction work on the project as represented
by the progress estimate paid to the contractor. This will not include any charges
for engineering, which charges will be billed when the project is completed and
final estimate made. The County agrees to promptly pay approved statements sub-
mitted as per this paragraph.
5. The County further agrees that when the project is completed and ready
for traffic, the County will maintain the same in a satisfactory manner, and if
said project is not so maintained the Department is authorized to do said mainten-
ance with its own forces and to bill the County for the cost thereof. If payment

is not made within thirty (30) days after receipt of said bill or bills, the ,
State Treasurer is authorized and requested to transfer to the State Highway Fund,
from the County's apportionment of the Motor Vehicle Fees, Chapter 16, C.S.A.
1935, and the Motor Fuel Taxes, Chapters 128 and 130, S.L. 1947, sufficient funds
to cover the delinquent payment or payments.
6. This Agreement shall not be deemed valid until it shall have been ap-
proved by the Controller of the State of Colorado, or by such assistant as he may
designate.
7, This Agreement shall be binding upon and inure to the benefit of the
successors and assigns of the parties hereto, respectively.
8. This Agreement is executed under authority of Section 105, Chapter 143,
C.S.A. 1935, and with reference to the signatories pp behalf of the County by
virtue of a resolution passed at a meeltaglof the Bo' d of/„CoUnty Commissioners

;ITH ISSaiit Whereas the lands hereinafter desoribed.have been declared by the
first party to be necessary as a right of way and the incidents thereto for a pablio
highway; and whereas the second party is owner in fee of the parcel of land here-
inafter described: -
Now, therefore, in consideration of one dollar ($1.00) in hand paid by the
first party to the second party, receipt whereof is hereby acknowledged, end in
further consideration of the covenants hereinafter mentioned to be perfo••med by
the first party the second party hereby agrees that upon paynent cf Seven Hundred
fifty dollars (1750.00) the second party will make, execute and deliver to the
first party a good and sufficient warranty deed to the following described parcel of
land, to wit:

65 Nest of the 6th 1. M. in Hold County, Colorado, containing 0.67 sores, more or
less, more particularly described as follows:

of the SE} of said notion 30; thence west along said boundary line 10 feet; thence
southerly and parallel to the eastern section line of Section 30, Township 6 N.,
Range 66 Seat of the 6th P. M. to a point opposite the northern end of the concrete
pavement; thence easterly 10 feet to a point 30 feet west of the eastern section line .
of Section 30, Township 6 N., Range 65 Hest of the 6th P. L'.; thence north of and
parallel to the eastern nation line of Section 30, Township 6N., Lange 65 'lestof
the 6th P. U. to the point of beginning.
The first party further agrees as follows:
1. To take up the fence now in existenoe on the west side of the present
traveled road opeosite the above described parcel of land and rebuild a legal fence
along the west line of the above described parcel of land.
2. To take up the fenos now in existence on the east side of the present traveled

6th P. IL. said fence extending from a point 186 feet south of the north line of

lineation for a distance of 2200 feet more or less, to a point opposite the north
