WELD COUNTY COUNCIL

The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter, Monday, July 21, 2008, 6:30 p.m., at the Weld County Southeast
Services Complex, 2590 9th Street, Ft. Lupton, CO.
ROLL CALL: The meeting was called to order by President Ginny Buczek. Vice
President John Kivimaki, Councilman Gene Stille and Councilman Don Mueller were
present, constituting a quorum of the members. Councilwoman Nancy Teksten was
excused. Also present was Public Works Director Pat Persichino, Wayne Howard, David
Bauer and Karla Ford, Council Secretary.
AGENDA APPROVAL
Councilman Kivimaki made a motion to approve the agenda as printed and Councilman
Stille seconded the motion and it passed.
REVIEW PROGRAM:
Pat Persichino gave an overview of the divisions within the Public Works Department—
engineering, administration, bridge, grader, maintenance support, pavement
management, trucking, weed, buildings & grounds, veteran's services and special
projects. The grader division now includes the mining division.
Mr. Persichino addressed the dust control program. The full depth dust program will be
69 miles with a second application of 58 miles for a total of 127 miles. To date, 43 miles
are completed. The state statute states if there are over 200 vehicles working on a gravel
road in a 24 hour period, there needs to be some type of dust control.
Trucking — as of June 1st, there has be 346,000 tons of materials hauled. This includes
gravel, sand, rock, asphalt. The county has completed 200 out of 299 miles of gravel
plan.
Pavement Management—the paving plan is 50% complete (19 of 38 miles). This is the
full overlay on a road. A roto milling machine was purchased. Slurry seal is another
product used. There were 377 patched locations. Ten miles of cracks were filled.
The county has spent $140,000 in tornado cleanup. Councilman Stille asked if there had
to be overtime in relation to the tornado and Mr. Persichino stated there was some
overtime involved. This cleanup was a good experience for the workers.
Bridges —five bridges have been completed to date and the goal is to complete seven.
This group installs culverts, repairs and replaces cattle guards.
Mr. Persichino noted some future issues for this department. The budget will be reduced
next year. The asphalt price will be rising 20- 30% and the fuel costs are continuously
rising. Councilman Kivimaki asked if the county will be affected, like the state, with the

shortage of asphalt and Mr. Persichino replied that the state uses a different mix — so the
county will not be affected.
Building projects - Old work release/jail building at Centennial Building will have new
construction on 2nd & 3rd floors to add five court rooms and conference rooms; Social
Services new three stories building that will be in the Social Services complex. The
completed projects this year are the jail addition, alternative building (work release) and
the cleaning of the courthouse exterior.
Wayne Howard, County Engineer of Design, presented information about strategic roads
and how the county determines what roads will be paved and the five year plan.
Strategic road program — This program completes three miles per year. The funding is
diminishing due to the low road impact fees; however, there is some funding through
grants. The program does partner with other agencies that want to contribute partial
funding to these roads. Generally 1-2 of these partnerships happen per year.
Paving roads - Weld County has their own crews that pave the roads — not contractors.
Choosing projects is driven by state health codes, which dictates the dust rules. Weld
County is proactive in this area. The roads chosen to be paved are usually the high
maintenance roads.
David Bauer, County Engineer of Development, coordinates between the design group
and towns regarding proposed developments. This group is a referral agency to the
planning department. They review site plans for communities, dairies, gravel pits,
drainage, grading and parking areas. They review and write all requirements for what
needs to be done regarding the above mentioned issues. They get involved in IGA's and
help with health department and planning departments.
Mr. Bauer addressed Councilman Mueller's question about the Pioneer Project. He
stated this is going to be a 25 year project populated with 25,000 people. The agreement
with Pioneer is very detailed and they will have to pay fees and create a pedestrian
bridge. There will need to be two freeway interchanges at WCR49 & 53. The upgrades to
roads within this community will happen whenever a certain phase of the project is
completed.

June 16, 2008 Minutes
Councilman John Kivimaki made a motion to approve the June 16, 2008 council
minutes with the addition and change:
Resolution 171 -After much discussion, including President Buczek reviewing the
County Council's authority from the Weld County Charter, Councilman Stille made a
motion to adopt Resolution 171 and Councilman Kivimaki seconded the motion and the
motion passed with the roll call vote as follows: President Buczek, Councilman Kivimaki
and Councilman Stille all - Yes and Councilwoman Teksten - No. Councilwoman
Teksten stated that she did not vote for this resolution because the Council has not

been informed on this issue, it is personal opinion brought to vote and it is beyond the
purview of the Council to do so.
Councilman Stille seconded the motion and it passed.
OLD BUSINESS:
Correspondence —Weld County Complaint Letter
An email from Casey Medina was sent to the Council regarding a complaint about an
employee's rudeness on the phone. President Buczek investigated the letter and
discussed it with Sue Elton in Human Services. Ms. Elton did send a response letter to
Casey Medina and a copy was given to the Council.
Correspondence — Roger Kenney Emails
The Council was copied on several emails between the Planning Commission and
Roger Kenney. Councilman Kivimaki did discuss with Tom Hahn and the council does
not need to take any action.
NEW BUSINESS:
Correspondence— R. Hill
An email was sent to the council regarding some concerns in Roggen. The concern
was the town did not have a formal government/municipal government. Councilman
Kivimaki emailed the patchwork of government for the county. GIS sent Mr. Hill a map
of the districts.
Correspondence — J. Steward
A letter was mailed to President Buczek with concerns of the legal system. No
response will be given.
Coordinator Report— Senator Salazar Hearing
Councilman Stille went to the Senator Salazar Hearings on June 30t n. The Senator
talked about Colorado regional plans and how it affects our particular county. Weld
County is the 16th largest county in United States. Our state has 66 million acres and 1/2
of those acres are in agriculture. He also stated that the FSA office in Greeley will not
be closed. He also discussed the energy aspects, water and distribution of farm bill.
Coordinator Report - Elected Officials Meeting
Councilman Stille attended the June 23rd Elected Officials Meeting and discussed with
Don Warden the Temporary Mill Levy reduction mechanism under TABOR. Mr. Warden
gave a written description/definition of this and it was distributed to the Council. This
information will be added to the Council notebook.
Petition Press Release — Pickup
Councilman Stille had been contacted questioning the two and four year council
positions. He talked with Attorney Bruce Barker and Clerk and Recorder Steve Moreno
and clarified when someone picks up a petition to run, they must state at that time which
position they are running for. Each position is outlined with specific term.

Payment of the Bills
Councilman Kivimaki made a motion for the bills to be paid as listed below:
Mileage for Council President Ginny Buczek $ 14.04
Mileage for Council Vice President John Kivimaki $ 20.77
Mileage for Councilman Gene Stille $ 67.65
Mileage for Councilman Don Mueller $ 10.11
The motion was seconded by Councilman Mueller and passed.
