A public hearing was conducted on November 12, 2008, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated September 26, 2008, and duly published October 3,
2008, in the Greeley Tribune, a public hearing was conducted to consider the request of Kelly and
Sally Harmon for a Site Specific Development Plan and Use by Special Review Permit#1669 for
a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial
or Industrial Zone Districts (truck parking) in the A (Agricultural) Zone District. Bruce Barker,
County Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
entered the favorable recommendation of the Planning Commission into the record as written. He
gave a brief description of the location of the site and stated the property is located within the
three-mile referral area for the Cities of Dacono, Northglenn, and Thornton, Adams County, and
the City and County of Broomfield. He stated the Cities of Dacono and Thornton, and the City and
County of Broomfield, indicated they had reviewed the request and found no conflict with their
interests; the City of Northglenn recommended approval of the proposed application; and Adams
County did not return a referral. Mr. Ogle stated the property is accessed from County Road 6,
which is a two-lane paved road, the internal access is gravel, and there is a staging area north of
the metal building that serves as a garage for the trucking operation and general storage for the
property owner. He stated the property contains an office structure which is fenced and gated, and
the permit is for the parking of trucks associated with the applicant's business, Kelly's Construction
Debris. Mr. Ogle stated employee vehicles will access the site, park temporarily while the company
trucks are moved into the service yard, and then be moved inside of the garage while the company
trucks are out in the field. He stated the hours of operation will be from 6:00 a.m., to 4:00 p.m.,
Monday through Friday, and there will be no more than four (4) employees on-site at any given
time.

Mr. Ogle stated the property is landscaped, the operation has no outside storage, other than
equipment utilized in the on-site agricultural operations, water will be provided by the Mountain
View Water User's Association, the site will be serviced by a septic system, and site lighting will be
from wall mounted lights that are shielded from surrounding lands and roads. He gave a brief
review of the surrounding land uses, and stated 17 referral agencies reviewed the proposal, and
14 offered comments which have been addressed in the Conditions of Approval and Development
Standards.
David Snyder, Department of Public Works,stated the site is accessed from County Road 6,which
is a collector status road requiring 80 feet of right-of-way at full buildout. He stated County
Road 13, to the west, is a strategic roadway requiring 140 feet of right-of-way at full buildout. He
further stated the applicant is proposing to use an existing access, which will be widened to
accommodate truck traffic, and no drainage improvements are being required.
Lauren Light, Department of Public Health and Environment, stated the site will be serviced by the
Mountain View Water Users' Association, and staff has determined the septic system for the
residence is adequate to handle the additional hydraulic load created by employees of the
business. She stated the applicant will be required to submit a Dust Abatement Plan for on-site
dust, and staff has no concerns with the proposal.
Kelly Harmon, applicant, stated the company trucks are only parked at the site, he does not do any
work on the property, the trucks are parked indoors for security purposes, there will be no outdoor
storage, and employees are only at the site for 10 to 15 minutes before leaving in a company truck
to go to the work site. In response to Commissioners Masden and Garcia, Mr. Harmon stated he
has two single-axle trucks and two double-axle trucks, and the hours of operation may need to be
extended to 6:00 p.m.
No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Harmon
stated he has reviewed,and concurs with,the Conditions of Approval and Development Standards,
as proposed and modified. Commissioner Rademacher moved to modify Development
Standard #19 to make the hours of operation from 6:00 a.m., to 6:00 p.m. The motion was
seconded by Commissioner Masden, and it carried unanimously. Chair Jerke commented it is
encouraging to see there are no apparent neighborhood concerns, and the pictures of the site
depict a very nice property.
Commissioner Masden concurred with Chair Jerke and moved to approve the request of Kelly and
Sally Harmon for a Site Specific Development Plan and Use by Special Review Permit#1669 for
a Use Permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial
or Industrial Zone Districts (truck parking) in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record and modified by a previous
motion. The motion was seconded by Commissioner Rademacher, and it carried unanimously.
There being no further discussion, the hearing was completed at 10:20 a.m.
