Ms. Hannah Hippely, Planner
918 10`h Street
Greeley, CO 80631
RE: Weld County Referral—Case No. USR-1631
Dear Ms. Hippely,
The Greeley-Weld County Airport Authority has reviewed the subject referral and offers
the following Comments:
This proposed Oil and Gas Production Facility is located in the Airport Zoning Overlay
District, as adopted by Weld County Ordinance, and the Airport Influence Area, as
• depicted in the 2004 Greeley-Weld County Airport Master Plan. The proposed Oil and
Gas Production Facility is also located in close proximity to the established aircraft traffic
pattern for Runway 9/27.
Although this land use is compatible with the Greeley-Weld County Airport Surrounding
Land Use Guidelines, the Greeley-Weld County Airport Authority strongly recommends
that an FAA Aeronautical Study under Part 77 of the Code of Federal Regulations be
conducted prior to approval of this Special Review Permit for any new oil and gas well
added to the Oil and Gas Production Facility.
The applicant may contact me for assistance in submitting the information for the
Aeronautical Study.
If you have any questions, please contact me at (970) 336-3002.
Sincerely,
i

TO: Hannah Hippely, Planning Services DATE: October 23, 2007
FROM: David Snyder, Engineer
SUBJECT: USR-1631, Hungenberg Investments LLC & D&B Hugenbert
Investments LLC
The Weld County Public Works Department has reviewed this proposal. Comments made during this phase of
the process may not be all-inclusive, as other concerns or issues may arise during the remaining application
process. This project falls primarily under the purview of the Use by Special Review Standards, Weld County
Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows:
COMMENTS AND REQUIREMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 39.5 is a local road and requires an 60-foot right-of-way at full build out. There is presently a 60-foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Access: Utilize the existing access to this parcel. No new accesses are requested.
The access shall be a graded and drained road constructed of road base to provide an all weather access.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it
is dedicated, private, or deeded to provide adequate access to the parcel. Please indicate in writing how you
are crossing the Troudt property to access your property.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Storm Water Drainage:
The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type generally
attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
The applicant must take into consideration storm water capture/quantity and provide accordingly for best
management practices.
The applicant is required to comply with all Colorado Oil and Gas Conservation Commission (COGCC)
rules and regulations including drill pad construction, storm water controls, and reclamation.
The applicant is required to comply with Weld County Code (Section 23-5 and 23-5-260-N) requirements for
anchoring oil and gas facilities located in floodplains and floodways where applicable.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
• become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
• •
• This area IS in FEMA Flood Zones.
All fill placed in the FEMA designated floodway and flood plain shall be removed and grade shall be restored to
historic elevations.
