FOR CREATION OF A WELD COUNTY COMMUNITY CORRECTIONS DIVISION AND
FACILITY AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Energy and Mineral Impact Assistance
Program Application for the Creation of a Weld County Community Corrections Division and Facility
from the County of Weld, State of Colorado, by and through the Board of County Commissioners
of Weld County, on behalf of the Department of Administrative Services, to the Colorado
Department of Local Affairs, commencing upon full execution, with further terms and conditions
being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Energy and Mineral Impact Assistance Program Application for the
Creation of a Weld County Community Corrections Division and Facility from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf

6. a. Brief Description of the Community's Documented or Demonstrated Need:

For the past several years,Weld County has relied upon the private sector to manage and house our Community
Correction facility and programs, now coupled with growth and continued demand for jail space, the Board of County
Commissioners believe it is in the best interest of the public to bring both components of criminal justice support and services
back under the preview of direct county oversight, and to develop a Corrections Division within Weld County government.
To carry out this task, it is imperative that a new, modem, facility be constructed to assist with this function. We fully intend
to undertake a complete revision of our current Community Corrections functions. While we do this we are requesting funds
to assist Weld County in the construction of a Community Correctional/Jail Alternatives facility. The proposed facility will be
30,000 sq feet in size and have the capability to house up to 200 offenders,and support several new programs.

This project will benefit the community by affording a safe and modern facility to conduct community corrections and jail
alternative programs. This facility will be located,outside of a residential neighborhood, and be located in an area currently
providing community support services such as the Weld County Jail,WC Food Bank,WC Alterative Center,and Island Grove
Regional Treatment Center all assisting clients with educational counseling, and training opportunities. Additionally, public
safety will be greatly enhanced by locating this facility away from it's currently location in a residential neighborhood and
adjoining the University of Northern Colorado campus.
b. Brief Description of how this project addresses the Community's Documented or Demonstrated Need:
(Is the project a benefit to public health [e.g. improve water quality, provide for a more reliable quantity of water]; or
does the project improve the effectiveness or efficiency of services [e.g.by improving the drainage system,upgrading the
financial records system, adding office space]; or does the project add to the quality of life of the community [e.g.

The Board of Weld County Commissioners has examined the Community Corrections and Jail Alternative program
structures and determined that the future of this program rests with the ability of the county to provide a different level of
service and intervention to keep clients out of the county jail facility. For sometime the county officials involved with
corrections and jail overcrowding have been of the opinion that county governments must do more than simply building more
jail space("We can't out-build the problem."),and as a result more and more effort and resources must be dedicated to trying
different jail alternative programs in Weld County that will meet the correctional needs in the county,protect public safety,
and be affordable.
Three main factors have driven these policy decisions: 1)if the county can find alternatives to housing a prisoner in the
county jail,it saves between$16,000 to$20,000 per inmate bed annually. Or, in our most recent experience by avoiding the
addition of a jail pod of 240 beds,the county saves over$2 million in annual operating costs and$18-20 million in capital
construction. 2)The corrections programs that have a treatment component to them have greater success rates in solving the
inmate's problems,such substance abuse,mental health issues,domestic violence,or other antisocial behavior,thus reducing
the recidivism rate of returning the inmate to jail or prison at a later date. 3)The Weld County criminal justice system
members have been seeking evidence based practices being used by other entities to alternatively supervise and treat those
individuals sentenced by the courts.New programs,such as ICAPP,have been recommended for implementation in Weld
County in order to keep the use of valuable jail beds to a minimum. It is necessary to construct an appropriate facility to
conduct these programs.

D. PROJECT INFORMATION.
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial assistance to
"political subdivisions socially or economically impacted by the development,processing or energy conversion of minerals
and mineral fuels."
1. Energy/Mineral Relationship/Social and Economic Impact.
a. Describe how the applicant is, has been, or will be impacted by the development, production, or conversion of energy
and mineral resources.
Weld County has over 21,000 oil and gas wells dispersed throughout the county with over 10,000 of these being active wells.
According to DPT, this represents over fifty percent of all active wells in Colorado. The biggest effect of this production is
seen in impacts to general governmental services particularly those providing for the needs of the general population.
According to the 2007 Upstate Colorado Demographic Profile there was a total of 114,849 employees in Weld County, of
these, it is estimated that 6561 of there workers were actively engaged in mining and mining support activities in Weld
County. Census data reports from the Weld County jail, for 2007, show that 227 residents of the jail self reported that they
were employed as an oil and gas worker prior to placement in the jail.
b. To further document the impact in the area, name the company or companies involved, the number of employees
associated with the activities impacting the jurisdiction and other relevant, quantitative indicators of energy/mineral
impact. (This list is attached)
The attached map delineates the active oil and gas activity in this area.
As of July 15,2008, 554 permits for oil and gas have been issued in Weld County.
2. Project Significance/Demonstration of Community Need.
a. Why is the project needed at this time?
Counties have the responsibility to provide correctional services and in doing so Weld County is responsible for ensuring that
offenders receive appropriate treatment allowing them to reenter our community prepared to actively contribute to it. This
facility will assist Weld county government in carrying out this mission.
Weld County currently presently operates several alternative jail programs. All programs are operated by the Weld County
Sheriff,except Probation(State)Useful Public service(Contract)and Community Corrections. A program not yet
implemented is a Therapeutic Community Program for inmates with special needs for a more intense treatment program.
Also,in partnership with North Front Range Behavioral Health there are opportunities to develop programs providing
alternatives to incarceration for individuals with mental health needs,both pretrial and sentenced people.
b. How does the implementation of this project address the need?
This grant will provide funds needed to help construct a new community correction/alternative jail facility. Incarceration in
alternative facilities are often less costly for the state and yield a far greater success rate for the clients.
The following programs currently operated in Weld County but will be expanded and modified to service a larger county
client base once the new facility is constructed: Under the new program county offenders could be directly sentenced to the
new facility and avoid the County jail altogether while receiving individualized rehabilitation.

c. Does this project, as identified in this application, completely address the stated need? If not, please describe additional
work or phases and the estimated time frame. Do you anticipate requesting Energy and Mineral Impact Assistance funds
for future phases?
Yes,these funds will be matched 50%by a Weld County local match allowing for the construction of this facility. And, the
county has dedicated a five acres site to house this facility. Based upon comparable sales in the area the value of this site is
approximately$620.00.00.
d. What other implementation options have been considered?
Continuing to run this community correction operations from the county Jail. We currently have space to house this function
but anticipate that in the near future this space will be needed to house county jail inmates. If community corrections is not
provided then inmates stay in jail to fill out the terms of their sentences, and often do not receive the specialized treatment
such as mental health or substance abuse.
e. What are the consequences if the project is not awarded funds?
It is likely that the current facility(County Jail) will become inadequate (due to housing demand constraints) to house these
clients. If no funding is available than it is likely that community corrections will be provided in less than modem and
appropriate facilities,thereby reducing the positive outcomes of this program,or the program may not be provided at all.
3. Local Commitment.
a. Why can't this project be funded locally?
Weld County is prepared to fund fifty percent(50%)or two million dollars of this project,but lacks the additional funds to
support total construction costs.Our capital resources for buildings are limited due to competition for capital dollars from
Road and Bridge,which is heavily impacted by energy development,especially with the cost or fuel and asphalt prices going
up.
b. Explain the origin of your local cash match. (Note: Whenever possible, local government cash match on a dollar for
dollar match basis is encouraged.)
Local,general fund matching 50%dollars.
c. Describe any in-kind contributions by type and value. How were the in-kind services valued? (If in-kind contributions
are included in the project budget,detailed tracking will be required on project monitoring reports).
Staff times to run the project from fiscal and administrative support, and building construction support time to mange the
project during construction. Weld County is also prepared to dedicate five acres of county owned property to support this
project.
d. Has the applicant dedicated the financial resources in their current budget,reserve funds and/or unused debt capacity that

Unless a project is directly related to an energy impact, i.e. road impact, the industry is hesitant to provide other funding,
since they pay property tax and severance tax. It is their feeling that those taxes are their contribution to general
governmental functions,such as correctional facilities.
4. Relationship to Community Goals/Increased Livability of Community.
The next series of questions attempts to more clearly understand how your community development/capital development
project improves the livability of your community. Livability means, increasing the value and/or benefit in the areas that are
commonly linked in community development such as housing, jobs, infrastructure benefit, transportation, education and
environment.
a. Is the project identified in the applicant's budget or a jurisdictionally approved plan (e.g. capital improvement plan,
equipment replacement plan, comprehensive plan,utility plan,road maintenance and improvement plan or other local or
regional strategic management or planning document)? What is its ranking?

Defined project management and accounting tracking for each grant project. This will be tracked and appropriated in the
2009 budget.

This project will be ran as a General fund project and administered from the capital improvements budget. There is a
contractual/operating agreement between Weld County and the Colorado Department of Corrections to provide this service,
as well as county general funds for correction programs operated by the County.

e. Describe how your facility will meet the energy standards specified in C.R.S. 24-30-1301 - 1305, if applicable? How
were these measures determined to be appropriate? Are the measures cost-effective'? What is the estimated time for
return on investment?
All buildings constructed by Weld County government are built according to the highest applicable standards. Institutional
facilities are generally exempt from local building codes; however efforts will be made to ensure that energy standards are
incorporated into the design and functionality of this project. It is anticipated that construction of this facility will occur
prior to the implementation date of this regulation.
The proposed construction time for this facility is 12-15 months.
f. Describe how you determined that the project can be completed within the proposed budget as outlined in this
application? Are contingencies considered within the project budget?
Weld County has a proven history of construction facilities built on time and within budget.
g. Has the necessary planning been completed?How?What additional design work must still be completed, if any? When?
How did the applicant develop project cost estimates? Is the project supported by bids, professional estimates or other
credible information? Please attach a copy of any supporting documents.
The proposed site has the appropriate zoning to support the proposed use. Project costs were based on similar, previous,
construction projects recently completed by Weld County. The project will be supported by bid only after a grant has been
awarded and received from the Department of Local Affairs.
h. Does the project duplicate service capacity already established? Is the service inadequate?(Has consolidation of services
with another provider been considered?)
No,this project will not duplicate services.
6. Measurable Outcomes.
a. Describe measurable outcomes you expect to see when implementation of this project is complete. How will the project
enhance the livability of your region,county,city,town or community(e.g. constructing a new water plant will eliminate
an unsafe drinking water system and provide safe and reliable drinking water; the construction of a new community
center will provide expanded community services, or projects involving energy conservation, community heritage,
economic development/diversification,traffic congestion)?
Construction of this facility will allow the current jail to be used for its intended purpose of housing those individuals
sentenced to this facility. Historically,community corrections and jail alternative programs were provided in an old housing
unit located on the University of Northern Colorado campus. This location created many challenges for the adjoining
neighborhoods of this facility. The relocation of a permanent community correctional facility to the Weld County Business
Park will eliminate residential conflicts and allow the residents of this facility to more conveniently seek support services
they need.
b. How many people will benefit from the project? (i.e.,region,county,city, town, community, subdivision,households or
specific area or group;or any portion thereof)
The gross costs for the county jail programs and Community Corrections total$22.1 million in 2008.Property tax dollars to
support these programs total$18.5 million or 24.7%of the county's property tax levy in 2008.This does not count the over
$24 million spent on capital construction for jails and alternative jail facilities in the last five years,or the projection to spend
another$20 million on jail construction in the next six years.
Any opportunity to positively impact the growing costs of jail incarceration by developing alternatives that better meet the
needs of the offender,protect the public,and are more costs effective needs to be explored and be a top priority for the policy
makers,managers,and members of the criminal justice Weld County in that direction.

There are approximately 140 residents currently assigned in community corrections in Weld County, however all Weld
county residents will benefit by providing an improved community correction Community Corrections is the a proven cost
effective alternative to incarceration in a jail setting. Community corrections clients are expected to contribute to society and
those they have offended.
c. How will the outcome of the project be measured to determine whether the anticipated benefits to this population
actually occur?
The Department of Corrections in conjunction with the Weld County Community Corrections Board measures the benefit of
placement in community corrections.
