Dear Ms. Hatch:
This referral does not appear to qualify as a"subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
• addition,the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or the physical availability of water.
According to the referral information, the site will be served by a proposed well. According to
the records available in the State Engineer's office the Applicant has obtained well permit no. 65351-
F, which allows the construction of a well into the Laramie-Fox Hills aquifer for commercial use. We
do not have evidence that this well has been constructed. Once constructed, the well can be used to
serve the commercial uses at the site as long as it is operated in accordance with the terms and
conditions of the well permit. We note that, according to the referral information, there will be cattle on
the property and mobile homes for employee housing. The well can only be used to water the cows
and serve the mobile homes if they are part of a commercial operation.

Environmental Health Services has reviewed this proposal for truck parking,
maintenance and office. We have no objections to the proposal, however, we do
recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. In the event, the applicant intends to wash vehicles or equipment on site the
following shall apply:
• The applicant shall provide evidence that the washing area will be designed
and constructed to capture all effluent and prevent any discharges from the
washing of vehicles or equipment in accordance with the Rules and
Regulations of the Water Quality Control Commission and the Environmental
Protection Agency.
2. The applicant shall submit evidence of an Aboveground Storage Tank permit
application from the Colorado Department of Labor and Employment (CDL&E),
Oil Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
•
3) The waste handler and facility where the waste will be disposed (including
• the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to operation:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area. The
applicant shall inquire with the Water Quality Control Division (WQCD) of the
Colorado Department of Public Health and Environment at
www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a
stormwater discharge permit. Alternately, the applicant can provide evidence
from WQCD that they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
• 2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations. (Permit SP-0700074 has been issued but is not installed)
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.

• 4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
8. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
9. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
• 11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
12.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Ms. Hatch:
Thank you for the opportunity to comment on the Bartez development project.The goal of the Colorado Division
of Wildlife(CDOW)is to provide complete,consistent and timely information to all entities who request
comment on matters within our statutory authority and our mission-which is to protect,preserve,enhance and
manage wildlife and their environment for the use, benefit,and enjoyment of the people of Colorado and its
visitors.
• District Wildlife Manager Chris Mettenbrink recently visited the site and made an assessment of the project's
impact to wildlife.The property is currently a grassland pasture with an existing gravel road that accesses an oil
well.The wildlife that could be expected to be found using this property include a variety of grassland birds,
raptors,deer,coyotes,raccoons, and a variety of other small mammals.
The CDOW makes the following recommendations to minimize impacts to wildlife:
1. Any fences constructed should follow the guidelines below.
2. Initial groundbreaking construction should take place after August 15 and before April 1 to prevent
the destruction ground nesting bird nests.
3. A weed management plan should be developed for during and after construction.
Fencin
The area of the proposed development lies in an area where deer can be found foraging and migrating through.
Some types of fencing can be dangerous and even fatal to deer and other wildlife.CDOW recommends that if any
fencing is to be used within or around development site,either during or after the project, it should be the type
that would allow the free passage of wildlife. Fencing plans should avoid the use of woven wire type fences that
will trap or prevent movement of wildlife. The Division of Wildlife prefers the use of three or four strand fencing
with a bottom strand height of 17 inches and a maximum top strand height of 42 inches,along with installation of
double stays between posts.This design allows young deer and other wildlife to pass under,as well as allows
mature deer to cross over the top.

Ground Nestine Birds
Grassland pastures and meadows make for desirable nesting habitat for many ground-nesting birds found in
Colorado. Human activities around these nests can have negative impacts on them. It is recommended that any
construction that takes place on the site occurs before April 1 and after August 15 to minimize any impacts that
• human activity may have on these nests.
Noxious Weeds
It is important to help prevent the spread of noxious weeds. During new construction,weed seeds can be carried
on machinery being transported from one site to another. Noxious weeds reduce property value and wildlife
habitat. Care should be taken to avoid spreading and introducing noxious weeds. Equipment should be cleaned
periodically to remove weed seeds even if no weeds are recognized. Recently altered soils rapidly become
infested with noxious weeds. The area should be promptly revegetated using native species to prevent erosion and
invasions by weeds. It is also recommended that a weed management plan be developed for during construction
and for at least 5 years after construction.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
Weld County Strategic Roadway: (December 2002) WCR 22 is classified by the County is a Strategic
Roadway, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning
(23-1-90), the required setback is measured from the future right-of-way line. (WCRs 7, 9.5, 11, 13, 22, 24, 27,
37, 49 and 74)
The applicant shall reserve or dedicate an additional 40-foot right-of-way parallel to the WCR 22 right-of-way
for future build-out.
Our most current average daily traffic count (ADT) reflects 727 vehicles taken per day in 2006 on WCR 22 just
east of this location. This USR application will add about 67 vehicle trips per day per the data supplied by the
applicant.
REQUIREMENTS:
The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is
dedicated, private, or deeded to provide adequate access to the parcel. Section line accesses are considered
private lanes with no county maintenance.
Storm Water Drainage:
All storm water detention facilities shall be designed to detain the storm water runoff from the fully developed
USR boundary from a one-hundred-year storm and release the detained water at a rate not to exceed the rate
of a five-year storm falling on the undeveloped site. (Weld County Code Ordinances 2001-1; 2003-10, and
2006-7). All storm water must be detained on site and follow the requirements per Weld County Code 24-7-130
D and Ordinance 2006-7.
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
plan.
This area is NOT in FEMA Flood Zones.

Explain in detail what type of proposed surface will be installed for the driveways and parking lots.
A stop sign shall be placed at the intersection of WCR 22 and the driveway into the USR maintenance facility
to stop northbound traffic entering onto the WCR 22.
Place signs to indicate where the trucks and trailers are to park.
The right-of-way or easement shall be a graded and drained road to provide an all-weather access.
The applicant shall contact the oil and gas or ditch owner to obtain, in writing, permission to utilize their access
road(s) for a commercial access.
Striping and signs will be required to define parking stalls for employees and visitors and for semi truck
parking.
Stop blocks will be required to be installed for all employee and visitor parking where a constructed element is
not present to help prevent automobiles from rolling after being parked next to buildings.
Parking lots shall conform to all standards of the American with Disabilities Act.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
ursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
come established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
