RESOLUTION
RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#43 -XCEL ENERGY/
PUBLIC SERVICE COMPANY OF COLORADO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated April 15, 1970,the Board approved Use by Special Review
Permit#43 for an Industrial Waste and Sewage Treatment Plant for the Public Service Company
of Colorado on the following described real estate, to-wit:
SE1/4 of Section 3, and the NE1/4 of Section 10, all
in Township 3 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS,the Board has received a request from Xcel Energy/Public Service Company
of Colorado, 550 15th Street, Suite 700, Denver, Colorado 80202-4256, to vacate said Use by
Special Review Permit#43, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit#43 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 24th day of March, A.D., 2008.

SUBJECT: USR-1647 Xcel Energy/Public Service Company of Colorado
As required by the Conditions of Approval for USR-1647, Public Service Company of
Colorado is requesting the vacation of SUP-43 and the partial vacation of USR-1063.
SUP-43 was approved in 1970. This application was for the installation of the sewer
treatment facilities that continue to serve the plant today.
USR-1063 was approved in 1995 as a Major Facility of a Public Utility. This permit was
for the repowering of the St. Vrain Facility and approximately 22 miles of natural gas
pipeline. The request is to vacate the portion of this USR that covers the power plant
and retain the portion that covers the gas lines. Since this permit was approved by the
Planning Commission the Planning Commission will hear and decide on the request for a
partial vacation of the USR.
Staff is supportive of the vacation request as the vacation of these USRs will clarify the
permits related to the facility and prevent multiple USRs from being layered on the same
site.

Re: Vacation of SUP and USR in Association with Approval of USR 1647, Installation
of Two Simple-Cycle Natural Gas Turbine Generators (Units 5 & 6) at the Fort Saint
Vrain Generating Facility
Dear Ms. Hippely:
We are formally requesting that all of Special Use Permit (SUP) #43 and those portions of Use
by Special Review permit (USR) #1063 lying north of Weld County Road 34 be vacated per
Weld County Code Chapter 23-2-200.G. Please see the attached map.
Please contact Jason Manassee (303-571-7759) or Rick Thompson (303-571-7284) with any
question you may have regarding the request. Please also notify Jason Manassee concerning
the date when the request will be before the Board of County Commissioners.

RESOLUTION
RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT#1063-
PUBLIC SERVICE COMPNY OF COLORADO.
WHEREAS, the Planning Commission of Weld County, Colorado, pursuant to Colorado statute
and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld
County, Colorado, and
WHEREAS, by Resolution dated November 3, 1994, the Planning Commission did approve the
request of Public Service Company of Colorado for Use by Special Review Permit #1063, for a Major
Facility of a Public Utility (electric power plant and associated gas pipeline) in the A (Agricultural) Zone
District, on the following described real estate, to-wit:
Parts of Section 3 and Section 10 of T3N, R67W of the
6th P.M.,Weld County, Colorado.
WHEREAS, the Planning Commission has received a request from the current property owner,
Public Service Company of Colorado., 550 15 St, Ste 700, Denver Colorado 80202, to vacate a portion of
said Use by Special Review Permit#1063, and
WHEREAS, the Planning Commission heard all of the testimony and statements of those
present, studied the request of the applicant and the recommendations of the Department of Planning
Services staff and all of the exhibits and evidence presented in this matter and, having been fully
informed, deems it advisable to approve said partial vacation
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of Weld County, Colorado,
that Use by Special Review Permit#1063 be, and hereby is, partially vacated.
The above and foregoing Resolution was moved by Tom Holton, and seconded by Mark Lawley.
