Let's do this: Do the new USR, but have it include an easement across USR-1563 . Have the
new USR describe and show that easement on its plat. Then have the plat for USR-1563 be
corrected to show the easement. Have the Board say in the new USR that changing the plat
to show the easement across USR-1563 does not constitute a major change pursuant to
23-2-280.

Bruce,
I had a question come up re: a new windfarm USR application that is in the process of
being prepared east of the existing Cedar Creek windfarm. This windfarm will connect to
the existing Cedar Creek windfarm substation by an electrical line. This electrical line
will be crossing the boundaries of USR-1563 (Cedar Creek Windfarm) . The applicants are
looking to submit as a separate USR application vs. an amendment to USR-1563 for business
reasons. This would result in a separate USR crossing USR-1563 . I thought that maybe that
portion of USR-1563 crossed by the electrical line coming from the new windfarm could be
vacated to prevent the situation of two overlapping USRs. I have not seen specifically
where the electrical line will go yet so I am not sure that it will work from a practical
standpoint.
I was wondering what you thought in regards to this and if you had any suggestions and/or
concerns. . . .
