Legal Description: Lot A of RE-2914; Part of the NW4 of Section 5, T1 N, R67W of the 6th P.M., Weld • County, CO. Location: East of and adjacent to County Road 15 and 1/2 mile south of State Highway 52. Size of Parcel: 2.47 +/- acres Parcel Number: 1469 05 000026 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE DENIED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the Weld County Code. 2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with Section 23-2-220 of the Weld County Code as follows: A. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The site is located within three miles of the Cities of Dacono and Frederick. The City of Dacono, in their referral dated December 3, 2007, stated that the property is located in an area designated as medium density by their Comprehensive Plan. The City of Dacono therefore determined that approval of the Use by Special Review application is not compatible with the intent, goals, objectives and policies of their Comprehensive Plan and the City can not support • the application and therefore recommends denial. No response was received from the City of Frederick. Section 19-2-60.8 — If a MUNICIPALITY's objection to or recommendation of disapproval of a Development proposal is based upon a conflict or incompatibility between proposed uses in the Development and the MUNICIPALITY'S anticipated zoning classification USR-1640 Calderon Page 2 for the property,' COUNTY will not approve same unles' the COUNTY'S judgment: a) such conflict or incompatibility is unlikely to occur; b) that suitable mitigation measures to be imposed by the COUNTY as conditions of approval will eliminate or adequately mitigate adverse • consequences of incompatibility or conflict; or c) the MUNICIPALITY's anticipated zoning classification of the property is unreasonable. The City of Dacono, in their referral dated December 3, 2007 recommended denial of the application due to their comprehensive plans future development of the area being classified as medium-density residential. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. If this case is denied, staff recommends that violation case number (VI-0600088) be referred to the County Attorney's office, but to delay legal action for 30 (thirty) days in order to give the applicant adequate time to ensure that all operations and vehicles have been removed from the property.
