RE: APPROVE REAL PROPERTY DONATION AND TEMPORARY CONSTRUCTION
EASEMENT FOR IMPROVEMENTS TO BRIDGE 13/54A OVER THE BIG THOMPSON
RIVER,AND AUTHORIZE CHAIR TO SIGN-LOVELAND READY MIX CONCRETE, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Real Property Donation and Temporary
Construction Easement for Improvements to County Bridge 13/54A over the Big Thompson River,
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County,on behalf of the Department of Public Works,and Loveland Ready
Mix Concrete, Inc.,1811 West 12th Street, Loveland, Colorado 80537, with terms and conditions
being as stated in said donation and easement, and
WHEREAS,after review,the Board deems it advisable to approve and accept said donation
and easement, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Real Property Donation and Temporary Construction Easement for
Improvements to Bridge 13/54A over the Big Thompson River, between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, and Loveland Ready Mix Concrete, Inc., be, and hereby are,
approved and accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said donation and easement.

REAL PROPERTY DONATION

Project Number: BRO C030-031
Property owners whose real property is needed for a transportation improvement project may donate all of
any part of the property to The County of Weld, A Body Corporate and Politic of the State of Colorado or
may donate (waive receipt of) all or any portion of just compensation due the owner for the property
required for the project.
Where the property owner wishes to use the donation for a tax deduction, the owner should seek advice
from the Internal Revenue Service or a tax expert regarding the current rules for valuation. It is the
property owners' responsibility to ascertain the fair market value of the property for tax purposes and the
County will pay the reasonable cost of an appraisal for tax purposes if the value of the acquisition is
estimated by the County at$5,000 or more and the appraisal is prepared by an independent appraiser.
If the property is contaminated, the costs to clean up such contamination will not exceed the value of the
property.
Donation of the property, more particularly described in Exhibit A which is attached hereto and
incorporated herein, to the County of Weld, is made voluntarily and with full knowledge of the right to
receive just compensation.
The undersigned, hereby releases, Weld County from obtaining an appraisal of the acquired property,
waives the right to receive an appraisal other than an appraisal for tax purposes as described above, and
waives the right to receive lust compensation for the property. The undersigned hereby agrees to execute
the necesspry conve R instrument ransfer said property free and clear of all liens and
encu br ces.

KNOW ALL MEN BY THESE PRESENTS, Loveland Ready Mix Concrete, Inc., A Colorado
Corporation of the County of Larimer, State of Colorado, hereinafter called the "Grantors", for and in
consideration of the sum of ONE DOLLAR ($1.00), and other valuable consideration to Grantors in hand
paid by Weld County Colorado hereinafter called the "County", receipt of which is hereby acknowledged, has
given and granted and by these presents does hereby give and grant unto the said County a Temporary
Construction Easement on, along, over and across the following described premises, to-wit:

DESCRIPTION
Temporary Easement No. TE-2 of the Department of Transportation, State of Colorado,
Project No. BRO C030-03I containing 12,850 square feet, more or less, being a portion
of the parcel of land as recorded under Reception No. 2002071557 of the Larimer County
Clerk and Recorder's Office, located in the SE '/ of Section 24, Township 5 North,
Range 68 West, of the Sixth Principal Meridian, in Larimer County, Colorado, said
easement being more particular described as follows:
Commencing at the Southeast corner of said Section 24, Thence N. 00°29'32" E., along
the west line of the Southeast quarter of said Section 24, a distance of 1387.39 feet;
Thence N. 89°30'28" W., a distance of 70.00 feet to a point on the west line of a parcel of
land described under Reception No. 20080006283, said point being on the westerly right-
of-way line of Weld CR 13; said point also being the POINT OF BEGINNING;
I. Thence N. 89°30'28" W., a distance of 25.00 feet;
2. Thence N 00°29'32" E., a distance of 514.09 feet;
3. Thence S. 89°30'28" E. , a distance of 25.00 feet to a point on the west line of
said parcel described under Reception No. 20080006283;
4. Thence S. 00°29'32" W., along said west line, a distance of 514.09 feet to the
POINT OF BEGINNING.
The above described parcel contains 12,850 square feet, more or less.
Basis of bearings: The East line of the Southeast quarter of Section 24, Township 5
North, Range 68 West of the 6th Principal Meridian, bearing North 00°29'32" East,
between a found 21/2" Aluminum Cap stamped "LS 17662" at the Southeast corner of
said Section 24 and the calculated position based on monument record ties at the East
quarter corner of said Section 24.
