HomeMy WebLinkAbout830680.tiff RESOLUTION RE: GRANT MOBILE HOME PERMIT NO. 801 - JOHN DOUGHERTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners of Weld County, Colorado on the 16th day of November, 1983, considered the request of John Daugherty to place a mobile home to be used as a tempo- rary use during a medical hardship, and to be occupied in an A-Agricultural Zone District, on a parcel of land more particularly described as follows : Lot 8, Block 63 , Aristocrat Ranchettes Subdivision, (Section 27 , Township 2 North, Range 66 West of the 6th P.M. ) Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony, finds that said request should be granted sub- ject to the following conditions : 1) the applicant shall apply for a building permit for the mobile home within thirty (30) days from the date of approval by the Board of County Commissioners, 2) prior to the issuance of a building permit, the owner shall submit evidence that the proposed water tap is supplying water in such a manner as to be adequate in quality, quantity and dependability for the proposed use, and 3) the mobile home shall not be occupied until such time that the applicant has complied with Conditions 1 and 2 above . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the request of John Dougherty to place a mobile home to be used as a temporary use during a medical hardship on the above described parcel of land, which was found to be in compliance with the Seld County Zoning Ordinance, Section 43 , be, and hereby is , granted subject to the conditions as above listed. Lupton, CO 80621 Dear Mr. Dougherty: In response to your request, transmitted through the Division of Planning and Zoning, for a conditional permit to connect a second mobile residence unit on your property at 15723 Barley Avenue, Aristocrat Ranchettes (otherwise known as Lot 8, Block 63, Second Filing) to the sewage disposal system used by the first unit, the Department takes the following position: We accecpt the existing two units' use of a single system, under a certificate of medical hardship, with the three condi- tions stated in your letter of September 13, 1983, and the imposition of one additional condition. The three conditions to which you have agreed are: 1. "If I sell the property, I will remove the second mobile home;" 2. °If Mom moves somewhere else, I will move her mobile home;" 3. °In the event of her death, I will move her home.` A copy of your letter containing the above is attached. The fourth condition is that the total number of residents of the two trailers never be allowed to exceed six persons, which is the reasonable maximum number of persons expected to occupy the three bed- rooms of the first mobile home on the property.
