RE: APPROVE PETITION AND AGREEMENT FOR ANNEXATION OF A PORTION OF
COUNTY ROAD 34 AND AUTHORIZE CHAIR PRO-TEM TO SIGN - TOWN OF MEAD
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on May 28, 2008, the Board was presented with a Petition for the Annexation
of a Portion of County Road 34 from the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, to the Town of Mead, Colorado, and
WHEREAS, at said meeting the Board deemed it advisable to continue the matter to
June 4, 2008, and then to June 16, 2008, to allow the matter to be considered by a full quorum of
the Board, and
WHEREAS, the Board has reviewed the Annexation Agreement with the Town of Mead,
which addresses the annexation of this section of road, and finds the same to be acceptable and
• appropriate, and
WHEREAS, after review, the Board deems it advisable to approve said petition and said
agreement, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Petition for the Annexation of a Portion of County Road 34 from the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, to the Town of Mead, Colorado, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that said Annexation Agreement with the Town
of Mead, for the annexation of said roadways be, and hereby is, approved, and the Chair Pro-Tem
is authorized to sign said petition and agreement.

COLORADO SUBJECT: Mead Annexations of County Roads
Weld County Public Works Department has reviewed the 6 County road annexations that the town of Mead
has proposed that the County request in order to consolidate their roadway system adjacent to their recently
annexed subdivisions. These proposed annexations fall outside the I-25 MUD. All these proposed annexations,
except the WCR 13 annexation, lie west of 1-25. Our comments are below.
GENERAL COMMENTS:
1. Highland Estates Annexation — a serial annexation on WCR 7 south of WCR 38. This road
annexation of approximately 2650 feet of 60-foot Right of Way. This road annexation will result in
Mead jurisdiction over 1 mile of WCR 7 from WCR 38 to WCR 36. Public Works supports this
annexation.
2. WCR 36 Vale View Annexation—This road annexation is a full mile of 60-foot ROW along WCR 36
between WCR 7 and I-25. Public Works supports this annexation.
3. WCR 34 Annexation — This road annexation of 30 feet of ROW (the south half of WCR 34 not
• already annexed by Mead) extends between WCR 7 and 1-25 for a length of approximately 1504 feet.
Public Works supports this annexation.
4. State Land Board Annexation—This serial annexation will incorporate 60 feet of WCR 7 ROW south
of WCR 34 for a length of 1828 feet. This road annexation will create an approximately 320 acre
enclave of County jurisdiction surrounded by Mead. This road annexation will result in Mead
jurisdiction over 1 mile of WCR 7 from WCR 34 to WCR 32. Public Works supports this
annexation.
5. Hunters Ridge Annexation—This road annexation will incorporate 60 feet of WCR 7 ROW south of
WCR 32 for a length of approximately 2653 feet. Mead has already annexed the subdivisions on
either side of this stretch of WCR 7. This road annexation will result in Mead jurisdiction over 1/2
mile of WCR 7 from WCR 32 to WCR 30. Public Works supports this annexation.
6. WCR 13 Annexation—This annexation will incorporate the 60 feet of WCR 13 ROW 1/2 mile north
of State Highway 66 for a length of approximately 2653 feet. This road annexation lies adjacent to
the 160 acre Grand View Estates subdivision which has already been annexed into Mead. Public
Works supports this annexation.
Note that these proposed annexations will leave short segments of County roads interspersed with Mead
jurisdiction roads. Discussions between Public Works and the Town of Mead to address efficient maintenance
and snow plowing needs for discontinuous road segments have begun. Additional Mead annexations adjacent to
County roads(WCR 9-1/2, WCR 28) also need to be discussed.

• PETITION FOR ANNEXATION
TO: THE BOARD OF TRUSTEES OF THE TOWN OF MEAD, COLORADO:
Commissioner Robert D. Masden, Chair Pro-Tern of the Weld County Board of Commissioners,
on behalf of Weld County, in accordance with Colorado law, hereby petition the Town of Mead
and its Board of Trustees for annexation to the Town of Mead, the following described
unincorporated territory located in the County of Weld and State of Colorado, to-wit:
That portion of the Weld County Road 34 right-of-way lying in Sections 10 and 15,
T3N, R68W of the 61h PM, as more precisely described in Exhibit A, attached
hereto and incorporated herein by this reference.
As part of this petition, your petitioner further states to the Board of Trustees of Mead, Colorado,
that:
1. It is desirable and necessary that the territory described in Exhibit A be annexed to the Town
of Mead.
2. The requirements of C.R.S. sections 31-12-104 and 31-12-105, as amended, exist or have
been met in that:
a. Not less than one-sixth of the perimeter of the area proposed to be annexed is contiguous
with the Town of Mead or will be contiguous with the Town of Mead within such time as
required by 31-12-104.
b. A community of interest exists between the area proposed to be annexed and the Town
of Mead.
• c. The area proposed to be annexed is urban or will be urbanized in the near future.
d. The area proposed to be annexed is integrated with or is capable of being integrated with
the Town of Mead.
e. No land within the boundary of the territory proposed to be annexed which is held in
identical ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or parcels of real estate, has been divided into separate parts or parcels
without the written consent of the landowner or landowners thereof, unless such tracts or
parcels were separated by a dedicated street, road or other public way.
f. No land within the boundary of the area proposed to be annexed which is held in identical
ownership, comprises twenty acres or more, and which, together with the buildings and
improvements situated thereon has an assessed value in excess of two hundred
thousand dollars ($200,000.00)for ad valorem tax purposes for the year next preceding
the annexation, has been included within the area proposed to be annexed without the
written consent of the landowner or landowners.
g. No annexation proceedings have been commenced for any portion of the territory
proposed to be annexed for the annexation of such territory to another municipality.
h. The annexation of the territory proposed to be annexed will not result in the detachment of
area from any school district.
i. The annexation of the territory proposed to be annexed will not have the effect of
extending the boundary of the Town of Mead more than three miles in any direction from
any point of the boundary of the Town of Mead in any one year.
j. Prior to completion of the annexation of the territory proposed to be annexed, the Town of
Mead will have in place a plan for that area, which generally describes the proposed:

Location, character, and extent of streets, subways, bridges, waterways, waterfronts,
• parkways, playgrounds, squares, parks, aviation fields, other public ways, grounds,
open spaces, public utilities, and terminals for water, light, sanitation, transportation,
and power to be provided by the Town of Mead; and the proposed land uses for the
area; such plan to be updated at least once annually.
k. In establishing the boundary of the territory proposed to be annexed, if a portion of a
platted street or alley is to be annexed, the entire width of the street or alley has been
included within the territory to be annexed. The Town of Mead will not deny reasonable
access to any landowners, owners of any easement, or the owners of any franchise
adjoining any platted street or alley which is to be annexed to the Town of Mead.
3. The area proposed to be annexed, consists exclusively of certain rights-of-way for county
roads, 30 feet on either side of section and township lines, as established by the Board of
County Commissioners for Weld County, recorded October 14, 1889 in Book 86, at Page 273.
4. Accompanying this petition are four copies of an annexation map containing the information
following:
a. A written legal description of the boundaries of the area proposed to be annexed;
b. A map showing the boundary or the area proposed to be annexed, said map prepared
and containing the seal of a registered engineer;
c. Within the annexation boundary map, a showing of the location of each ownership tract in
unplatted land and, if part or all of the area is platted, the boundaries and the plat
numbers of plots or of lots and blocks;
d. Next to the boundary of the area proposed to be annexed, a drawing of the contiguous
boundary of the Town of Mead and the contiguous boundary of any other municipality
abutting the area proposed to be annexed, and a showing of the dimensions of such
contiguous boundaries.
• 5. Upon the Annexation Ordinance becoming effective, all lands within the area proposed to be
annexed will become subject to all ordinances, rules and regulations of the Town of Mead,
except for general property taxes of the Town of Mead.
6. The zoning classification (land use) requested for the area proposed to be annexed is "Public
Purposes" in Performance District 1.
WHEREFORE, the following petitioner respectfully requests that the Town of Mead, acting
through its Board of Trustees, approve the annexation of the area proposed to be annexed. By
this acknowledgment, the undersigned hereby certify that the above information is complete and
true.

ANNEXATION AGREEMENT /_
THIS ANNEXATION AGREEMENT is made and executed this �( th1 day of
• ,2008,by and between the COUNTY OF WELD,COLORADO
(hereinafter referred to as"Annexor")and the TOWN OF MEAD,COLORADO(hereinafter
referred to as"Town"),
WITNESSETH:
WHEREAS,Annexor is the governmental entity which owns and controls certain real
property which is part of various Weld County Roads located adjacent to Town and more
particularly described in Exhibit A,which is attached hereto and incorporated herein by
reference,
WHEREAS,Annexor has been requested to file petitions with the Town for the purpose
of annexing to the boundaries of the Town the real property described in Exhibit A,
WHEREAS,Annexor desires to impose upon the Town certain conditions relating to the
proposed annexations and to the effectiveness of the referenced petitions, and
WHEREAS,the Town has reviewed and approved the conditions requested by Annexor
and desires to make the proposed annexations subject to the conditions set forth hereinafter.
NOW THEREFORE,in consideration of the foregoing premises and the covenants,
promises and agreements of each of the parties hereto,to be kept and performed by each of them,
• it is agreed by and between the parties hereto as follows:
1. Submission of Annexation Petitions: Annexor has submitted to the Town for its
consideration certain annexation petitions for the annexation of the real property
described in Exhibit A,with said petitions being incorporated herein by reference
(hereinafter the"Annexation Petitions"). The Annexation Petitions have been
submitted on the express condition that they will be approved by the Town and
the real property described in Exhibit A will be annexed to the Town under and
pursuant to the conditions set forth in Paragraph 2,hereunder,and pursuant to the
agreement for Annexor to pave the intersection of WCR's 7 and 38, as set forth in
Paragraph 4,hereunder.
2. Conditions Applicable to Annexation. It is expressly understood by the Town
that certain requirements are being imposed by Annexor as a condition precedent
to the Town's annexation of the real property described in Exhibit A. These
conditions are as follows:
(a) From and after annexation of the real property described in Exhibit A,the
Town,except as hereinafter provided,will be responsible for prospective
maintenance of said real property.

state law,unless and until such time as the roadway is surfaced with concrete or
asphalt;
• (c) From and after annexation,no attempt will be made by the Town to limit
vehicular access or use of the property annexed so as to exclude farm or
agricultural vehicles and equipment.
(d) Current ingress and egress to the real property described in Exhibit A for
current uses will continue to be allowed for such purposes,the intent being that
annexation shall not impair or affect current access.
3. Town's Consent to Conditions. By execution hereof, the Town shall be deemed
to agree to each and every condition stated in Paragraph 2 hereof and the use and
maintenance of the real property described in Exhibit A shall thereafter be in
accordance with the provisions therein.
4. Paving of Intersection of WCR's 7 and 38. Prior to August I,2008,Annexor
shall, at its sole expense,pave the intersection of WCRs 7 and 38 in the manner
and liming agreed to by separate agreement of the parties.
5. Entire Agreement. This instrument embodies the entire agreement of the parties
with respect to the subject matter hereof. There are no promises,terms,
conditions,or obligations other than those contained herein;and this Agreement
shall supercede all previous communications,representations, or agreements,
either verbal or written,between the parties hereto. No modification to this
• Agreement shall be valid unless agreed to in writing by the parties hereto.
6. Binding Effect. This Agreement shall inure to the benefit of and be binding upon
the parties hereto and their successors in interest.
7. No Third-Party Enforcement. It is expressly understood and agreed that the
enforcement of the terms and conditions of this agreement,and all rights of action
relating to such enforcement,shall be strictly reserved to the undersigned parties
and nothing in this agreement shall give or allow any claim or right of action
whatsoever by any other person not included in this agreement. It is the express
intention of the undersigned parties that any entity other than the undersigned
parties receiving services or benefits under this agreement shall be an incidental
beneficiary only.
8. No Waiver of Immunities. No portion of this agreement shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees
may possess,nor shall any portion of this agreement be deemed to have created a
duty of care which did not previously exist with respect to any person not a party
to this agreement.
9. Severability. If any term or condition of this agreement shall be held to be
invalid,illegal or unenforceable,this agreement shall be construed and enforced
• without such a provision,to the extent this agreement is then capable of execution
within the original intent of the parties.

Gentlemen:
Please be advised that a public hearing before the Mead Board of Trustees has been set to review
and consider the annexation of portions of WCR 7,WCR 13, WCR 34 and WCR 36.The properties are
owned by Weld County and consist of scattered portions of Weld County roads adjacent to Mead Town
boundaries or connecting portions of roads that were previously annexed by the Town. Through their
annexation,the Town of Mead will assume the ownership and maintenance of these portions of the
roads.
In accordance with C.R.S. § 31-12-108 (2),this notice has been sent to the Board of County
Commissioners and County Attorney for Weld County, and to each special district or school district
having territory within the area to be annexed.
Attached is a copy of the published public hearing notice for each annexation,together with a
copy of the adopted resolution of intent to annex and the applicant's petition for annexation. Copies of
the full application, as well as the full-sized maps submitted with the application are available for review

WCR 34 ANNEXATION
NOTICE IS HEREBY GIVEN that the Board of Trustees of the Town of Mead has
adopted a Resolution of Substantial Compliance initiating annexation proceedings for the "WCR
34 Annexation," said Annexation being more particularly described in the following Resolution
No. 28-R-2008.
The Board of Trustees of the Town of Mead will hold a Public Hearing commencing at
7:00 p.m., Monday, October 13, 2008, at the Mead Town Hall, 441 - 3r° Street, Mead, Colorado
80542, for the purpose of determining whether the property proposed to be annexed meet the
applicable requirements of the statutes of the State of Colorado and is eligible for annexation to
the Town of Mead, and to establish the appropriate land use for the property, if requested.
Any person may appear at the Public Hearing and be heard regarding the matters under
consideration.
Copies of the petition and supporting material submitted to the Town are on file and
available for public inspection in the Office of the Town Clerk, at the Mead Town Hall, 441 - 3rd

RESOLUTION NO. 28-R-2008
A RESOLUTION FINDING SUBSTANTIAL COMPLIANCE AND INITIATING
ANNEXATION PROCEEDINGS FOR CERTAIN PROPERTIES IN WELD
COUNTY, COLORADO TO THE TOWN OF MEAD, SAID ANNEXATION TO BE
KNOWN AS THE WCR 34 ANNEXATION.
WHEREAS, a written petition together with four (4) prints of an annexation map for the
annexation of certain properties have been filed with the Board of Trustees of the Town of
Mead by Commissioner William H. Jerke, Chair of the Weld County Board of Commissioners,
on behalf of Weld County for the annexation of certain portions of the WCR 34 right-of-way,
between 1St Street and 1-25; and
WHEREAS, the Board of Trustees has reviewed the petitions and supporting material;
and
WHEREAS, the Board of Trustees wishes to permit simultaneous consideration of the
subject property for annexation and zoning, if requested in the petition; and
WHEREAS, the Board of Trustees has reviewed the petitions and desires to adopt by
Resolution its findings in regard to the petitions;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF MEAD, COLORADO, as follows:
Section 1. The petition, whose legal description is attached hereto as Exhibit A, and
incorporated by reference herein, is accepted and determined to be in substantial compliance
with the applicable laws of the State of Colorado.
Section 2. No election is required under C.R.S. §31-12-107(2).
Section 3. No additional terms and conditions are to be imposed except those
provided for in the petitions.
Section 4. The Board of Trustees will hold a public hearing for the purpose of
determining if the proposed annexation complies with C.R.S. §31-12-104, and with C.R.S. §31-
12-105, and will hold a public hearing to determine the appropriate zoning of the subject
properties if requested in the petition, at the Mead Town Hall, 441- 3r° Street, Mead, Colorado
80542, at the following time and date:
7:00 PM, Monday, October 13, 2008
Section 5. Any person may appear at such hearing and present evidence relative to
the proposed annexation or the proposed zoning.
Section 6. Upon completion of the hearing, the Board of Trustees shall set forth, by
resolution, its findings and conclusions with reference to the eligibility of the proposed
annexation, and whether the statutory requirements for the proposed annexation have been
met, and further, will determine the appropriate zoning of the subject property if requested in
the petition.
Section 7. If the Board of Trustees concludes, by resolution, that all statutory
requirements have been met and that the proposed annexation is proper under the laws of the
State of Colorado, the Board of Trustees shall pass one or more ordinances annexing the
subject property to the Town of Mead, and shall pass one or more ordinances zoning the
subject property if requested in the petition.
