Prior to recording the plat: B. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment. Alternately, the applicant can provide evidence from the APCD that they • are not subject to these requirements. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. (Department of Public Health and Environment) C. The applicant shall submit a dust abatement plan for all driving and parking areas for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. (Department of Public Health and Environment) D. A recorded agreement allowing utilization of SemCrudes water and sanitation facilities shall be provided to the Department of Public Health and Environment. The reception number shall be noted on the plat. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if applicable. The applicant shall submit evidence of an Aboveground Storage Tank • permit from the Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any aboveground storage tanks located on the site. Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection Section that they are not subject to these requirements. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. (Department of Public Health and Environment) G. A detailed design and operations plan for the truck washout building shall be submitted to WCDPHE for review and approval. The design shall demonstrate how all spilled waste, stormwater and wash down water will be contained. The design shall also include the method to prevent leakage. A leak detection system shall be designed and installed beneath the washout bay. The truck washout shall be constructed and operated in accordance with the approved design. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. (Department of Public Health and Environment) H. A Spill Prevention Control and Countermeasure plan, for the Noble facility, shall be submitted to Department of Public Health and Environment. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. (Department of Public Health and Environment) • . The applicant shall submit an updated waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. Evidence of Department of Public Health and Environment approval shall be submitted to the Department of Planning Services. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). The applicant shall address the requirements (concerns) of the State of Colorado Division of Wildlife, as stated in the referral response dated September 2, 2008. In the third paragraph, we would like to add language that says "an update traffic study may be completed by the applicant to show an accurate number of vehicles utilizing the SemCrude facility to determine a proportionate share of improvements required" . The applicant shall either enter into a new improvements agreement, or amend the existing improvements agreements for USR-1614, and post adequate collateral only for improvements required to be constructed immediately. The new or amended improvements agreement(s) and the form of any necessary collateral shall be reviewed by County staff and accepted by the Board of County Commissioners prior to recording the plat, and shall include the following provisions: Upon being presented with evidence that traffic counts conducted by Weld County on Weld County Road ("WCR") 30, west of WCR 49, exceed 1,000 ADT, the applicant shall design and construct acceleration and deceleration lanes on WCR 30 to serve each of its approved access points. The cost for design and construction of such acceleration and deceleration lanes shall be paid entirely by the applicant. The Weld County Public Works Department shall have final approval of the design. Sufficient collateral for the construction of such acceleration and deceleration lanes shall be posted with Weld County immediately prior to the commencement of such construction. Additionally, the applicant shall pay its proportional share of the cost of improvements and upgrades to WCR 30 along its frontage and at the intersection with WCR 49 at such time as Weld County upgrades that roadway. The applicant's proportional share of WCR 30 improvement • costs shall be determined to be the applicant's percentage of the total traffic on WCR 30 west of WCR 49, as determined by traffic counts conducted by Weld County and an updated traffic study completed by the applicant.
