RE: GRANT ZONING PERMIT FOR A COMMERCIAL VEHICLE, ZPCV #0027 - MICHAEL
AND CHARMAINE KASPERBAUER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners of Weld County, Colorado, on the 8th day
of September,2008,considered the request of Michael and Charmaine Kasperbauer,5378 Ocotillo
Court, Johnstown, Colorado 80534, for a Zoning Permit for a Commercial Vehicle, and
WHEREAS, said commercial vehicle is to be located on a parcel of land being more
particularly described as follows:
Lot 28, Block 5, Northmore Acres, 2nd Filing; being
located in Section 24, Township 4 North, Range 68
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds
that said request should be granted subject to the following conditions:
1. The zoning permit shall not be transferrable by the applicant and/or owner to any
successor. The zoning permit shall terminate automatically upon conveyance or
lease of the property.
2. The property is in violation of Chapter 23 of the Weld County Code (Violation
#ZCV08-00086). The applicant shall schedule a final inspection with the Weld
County Zoning Compliance Officer to ensure compliance of the property.
3. Approval of this application for a zoning permit application shall not be considered
to release the applicant from complying with any private covenants in place.
4. The commercial vehicle permitted must be operational with current license plates
at all times.
5. There shall be no parking or staging of commercial vehicles on the County Road
right-of-ways. The applicant shall utilize on-site parking only.
6. The applicant shall maintain compliance with Section 23-4-950 of the Weld County
Code at all times.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the request of Michael and Charmaine Kasperbauer for permission to place
a commercial vehicle on the above described parcel of land, which was found to be in compliance
with Chapter 23, Article IV, Division 11, of the Weld County Code, be, and hereby is, granted
subject to the hereinabove listed conditions.

This case comes before the Board of County Commissioners as it does not meet the requirements of Section
23-4-960.B. as 34% of surrounding property owners have objected to the request.
The Department of Planning Services'staff has reviewed this request and recommends this case be approved
for the following reasons:
1. The zoning permit shall not be transferable by the applicant and/or owner to any successor. The
zoning permit shall terminate automatically upon conveyance or lease of the property.
2. The property is in violation of Chapter 23 of the Weld County Code (Violation#ZCV08-00086). The
applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure
compliance of the property.
3. Approval of this application for a zoning permit application shall not be considered to release the
applicant from complying with any private covenants in place.
4. The commercial vehicle permitted must be operational with current license plates at all times.
5. There shall be no parking or staging of commercial vehicles on the County roads or rights-of-way.
The applicant shall utilize on-site parking only..

The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU):
Ocotillo Street is a local paved road and requires a 60-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line.
REQUIREMENTS:
The applicant shall utilize the existing residential access to this parcel.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicantlandowner shall be responsible for controlling the noxious weeds.
No parking or staging of commercial vehicles is allowed on the subdivision streets. Use the on-
site parking area.
The area is not within a FEMA Flood Zone

As a result of the recent changes in Weld County zoning regulations and in response to
the application referenced above,the Northmoor Acres HOA now has a policy in place to
address commercial vehicles within Northmoor Acres. This policy will guide us with our
future enforcement actions and should assist the County with any future decisions of this
nature. The HOA Board of Directors met with the Kasperbauers on August 13th and
resolved the Board's concerns stated in our original denial letter to the planning
department dated July 17.2008. Therefore the Board is rescinding our opposition to the
Kasperbauer petition.
Please let us know if this is sufficient justification to vacate the hearing which we
understand is scheduled for September 8,2008. We would like to save everyone the time
and trouble of attending a hearing if it is unnecessary. Please also advise us of your next
steps in this process and any decisions you may make.

Re: Northmoor Acres Policy on Commercial Vehicles
Dear Planning Department,
In the past,Northmoor Acres was able to rely on Weld County and some specific zoning
regulations of the County regarding what the County would allow in residential
subdivisions. The County had the authority to monitor compliance and enforce these
regulations which helped Northtoor Acres maintain the beautiful,peaceful residential
atmosphere in our community. Recently the County has changed its position on one of
these regulations. In the past the County regulation stated that parking of commercial
vehicles in a residential area was not acceptable. The County has now altered this
regulation and the new regulation says that residents can petition the County to be
granted permission to keep a commercial vehicle on their property. In order to assist the
County in the definition of what will be acceptable to our community the Board of
Directors has passed the policy attached. As with all policies this will be posted on the

THE NORTHMOOR ACRES HOMEOWNERS ASSOCIATION,INC.
POLICY FOR COMMERCIAL VEHICLES
The Northmoor Acres Homeowners Association (the "Association") wishes to adopt a
Commercial Vehicles Policy(the "Policy"). The Declaration,Articles of Incorporation and
Bylaws of the Northmoor Acres Homeowners Association and Colorado law grant the
authority to the Board to adopt such a policy.
1. Scope. In order to maintain a harmonious residential environment, no commercial
vehicles shall be stored or parked on any lot except in an approved building or approved
location, nor parked on any road or access-way except when engaged in transportation to or from
a residential dwelling. No more than one commercial vehicle per household can be parked at a
residence. The vehicle must be owned or operated by a resident in the household. For the
purposes of this policy,a commercial vehicle is defined as having a current commercial plate,
classified as a mid size truck or smaller,under 26,000 lbs gross vehicle weight as defined by the
manufacturer,and with a single rear axle. Any truck larger then this classification is not
considered suitable to be housed in a residential neighborhood and should be stored at an
appropriate facility outside of the community. It is the responsibility of the Homeowners
Association to promote and protect the quality of the life and property values within the
community. In order to best serve the Association membership and comply with Colorado law,
the Board determines that it is necessary to have policies and procedures for Commercial
Vehicles.
2. Definitions. Unless otherwise defined in this Resolution, initially capitalized or terms
defined in the Declaration shall have the same meaning herein.
3. Supplement to Law. The provisions of this Policy shall be in addition to and in
supplement of the terms and provisions of the Declaration,Bylaws,Rules and any other
governing document of the Association as well as the laws of the State of Colorado governing
the community.
4. Deviations. The Board may deviate from the procedures set forth in this Policy if in its
sole discretion such deviation is reasonable under the circumstances.
5. Amendment. This policy may be amended from time to time by the Board.

Dear Planning Department,
With regard to the notice referenced above received by Northmoor Acres Homeowners
Association, the Board of Directors is opposed to the approval of this application for the
following reasons:
The truck is in violation of Northmoor HOA Covenants 6, 7 & 8.
Covenant 6 states that no commercial enterprise may be conducted. The
operation of the commercial vehicle is in connection with a business being operated out
of the homeowner's residence, and for no other use. Additionally, the truck is being
used as a warehouse for his business materials. The Northmoor Acres HOA enforcement
policy for Covenant 6 states in part that no lot shall be used for any purpose other than
single-family residential purposes. It also states that any home occupation must be
restricted to the inside of the residential dwelling and no more than 15%of the residential
space is used. Home occupations are permitted if they do not unreasonably interfere with
the use and enjoyment of another lot within the sub-division. The operation of the large
commercial vehicle unreasonably interferes with the use and enjoyment of the
neighboring lots, creates more wear and tear on the sub-division roads and creates a
safety hazard.
Covenant 7 states that no noxious or offensive activity shall be carried on, nor
shall anything be done therein which may be or may become any annoyance or nuisance.
The operation of the large commercial vehicle is an annoyance to the Northmoor
community. Generally,vehicles of this type must be warmed up in the winter, tend to be
noisier, and create fumes.
Covenant 8 states that each owner shall keep his lot in a sanitary and sightly
condition at all times. The large commercial truck is not in character with a large-estate
residential community like Northmoor Acres. The truck is not sightly and not
harmonious for the residential area.

The Board of Directors does recognize that there are homeowners who may need to drive
their company work truck home, and if these vehicles are under 1 1/2 ton and are kept in a
proper/approved enclosed facility on the property,then they may be considered
harmonious for the residential area.
In conclusion, allowing a vehicle of this type,which obviously is only used in the
conduct of a commercial enterprise at the Kasperbauer's lot, is against our covenants.
We, the Northmoor HOA Board of Directors, do not want this activity conducted within
the sub-division and request that the application above be denied.
In the future if any applications for zoning exceptions are received by either the Planning
Department or the Zoning Department, the Northmoor Board of Directors would
appreciate also receiving notification.
