RE: ACCEPT REQUEST TO WITHDRAW CHANGE OF ZONE, PZ #1098, FROM
A (AGRICULTURAL) ZONE DISTRICT TO PUD (PLANNED UNIT DEVELOPMENT)
ZONE DISTRICT FOR EIGHT (8) LOTS WITH E (ESTATE) ZONE USES, FOUR (4)
COMMON OPEN SPACE OUTLOTS (2.35 ACRES), AND TWO (2) AGRICULTURAL
OUTLOTS (137.87 ACRES) -WAYNE HARSH AND RANDY LAMP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 30th day of January, 2008, at 10:00 a.m. for
the purpose of hearing the application of Wayne Harsh,22994 County Road 30, Hudson, Colorado
80642, and Randy Lamp, P.O. Box 421, Hudson, Colorado 80640, requesting Change of Zone,
PZ #1098, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone
District for eight (8) lots with E (Estate) Zone uses, four (4) common open space outlots
(2.35 acres), and two (2) agricultural outlots (137.87 acres), for a parcel of land located on the
following described real estate, to-wit:
Lot C of Recorded Exemption #3453, located in the
SE1/4 of Section 26, and Lot B of Recorded
Exemption #4583, located in the E1/2 NE1/4 of
Section 26; all in Township 3 North, Range 65 West
of the 6th P.M., Weld County, Colorado
WHEREAS, at said hearing, at the request of the applicant, the Board deemed it advisable
to continue the matter to April 2, 2008, at 10:00 a.m., to allow the applicants additional time to
continue working with staff to resolve design issues, and
WHEREAS, on April 2, 2008, the Board was presented with a written request from the
applicants to withdraw the application for Change of Zone, PZ #1098, from the A (Agricultural)
Zone District to the PUD(Planned Unit Development)Zone District for eight(8)lots with E(Estate)
Zone uses, four (4) common open space outlots (2.35 acres), and two (2) agricultural outlots
(137.87 acres), a copy of which is attached hereto and incorporated herein by reference, and
WHEREAS, the Board of County Commissioners heard all the testimony and statements
of those present, studied the request of the applicant and, having been fully informed, finds that
this withdrawal request shall be accepted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Wayne Harsh and Randy Lamp to withdraw the application
for Change of Zone, PZ #1098, from the A (Agricultural) Zone District to the PUD (Planned Unit
Development) Zone District for eight (8) lots with E (Estate) Zone uses, four (4) common open
space outlots (2.35 acres), and two (2) agricultural outlots (137.87 acres), be, and hereby is,
accepted.

The above and foregoing Resolution was, on motion duly made and seconded, adopted by

To Whom It May Concern: at the offices of weld county planning&engineering. I WAYNE HARSH
and I RANDY LAMP. With much regret and thought and several meetings we have had with Michelle
Martian and Park Engineering Consultants have decided to withdraw our request for the Pud Rural
Cluster at this location of. Weld Co Rd# 30 and Weld Co Rd# 47, Weld Co Colorado.
