RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV#0800079 AGAINST VAL DAVENPORT FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Val Davenport, ZCV #0800079, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 2008, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Val Davenport was not present or represented at said hearing, although all
parties were notified of said hearing by Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
named above to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with
legal action against Val Davenport to remedy the violation of the Weld County Code, and any other
persons occupying the properties, any persons claiming an interest in the properties, and any
persons acting in active concert with the identified parties.

previous Principle Dwelling unit), shall be permitted as a Temporary during Construction or removed fron
the property. It is my understanding that you indicated the mobile home would be removed within
approximately 30 days. If the 2nd mobile home has been removed prior to May 12, 2008, the above
referrenced hearing will be cancelled.
RECOMMENDATION
The Department of Planning Services recommends this case to be referred to the County Attorney's
Office for immediate legal action.

This is a Request for a : Zoning Permit for a Mobile Home for a Principle Dwelling.
Legal Description of Parcel: Lot 3, Block 32 of Aristocrat Ranchettes, Weld County, CO.

The Department of Planning Services'staff has reviewed this request and approves this request for the following
reasons:

x Be compatible with the Weld County Comprehensive Plan.
Be compatible with the surrounding area.
x Be in harmony with the character of the neighborhood.
x Adversely affect the immediate area.
x Be adequately served by water and sewage disposal facilities.
x Adversely affect the general health, safety and welfare of the
inhabitants of the area and the County.
The Department of Planning Services' staff recommendation for approval is conditional upon the following:
1. The applicant must obtain a building permit for a mobile home and must comply with all installation
standards of Chapter 29 of the Weld County Code applicable to mobile homes prior to locating the
mobile home on the property.
2. Prior to receiving a certificate of occupancy, the mobile home shall be connected to an approved
sewage system and a legal water supply.
3. The mobile home shall not be occupied until such time that the applicant has complied with Conditions
1 and 2 stated above.
4. If demolishing or removing an existing structure, specifically a mobile/modular home, please contact
the Weld County Treasurer's office at 970-353-3845, to ensure that the taxes have been paid and that
this structure is removed from the tax roll.
5. The second mobile home currently on site shall be utilized for a temporary use during the construction
of the principle house. The temporary mobile home will be approved for a period of six (6) months.
At the end of the six(6) months, the permit will be reviewed for compliance with this condition. Should
the temporary mobile home still be on the property after the six month time frame, a violation will be
issued. The temporary mobile home shall be removed from the property at the end of the six(6)month
time frame. A certificate of occupancy will not be issued until the second home has been removed
from the property.
6. Should the applicant wish to convert the temporary during construction into temporary storage for six
months, a new permit and fees shall be applied for and approved.
7. The property is in violation of Chapter 23 of the Weld County Code(Violation#0600226).The applicant
shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance
of the property.
8. All vehicles located on the property must be operational with current license plates, or be screened
from all adjacent properties and public rights of way, or be removed from the property. All other items
considered to be part of a noncommercial junkyard must also be removed from the property or
screened from adjacent properties and public rights-of-way.
9. All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of setback in the Weld
County Code, the required setback is measured from the future right-of-way line.
10. Derelict manufactured(mobile)home:a manufactured(mobile)home that is partially or totally damaged
by fire, earthquake, wind, or other natural causes, or is in a state of general dilapidation, deterioration,
or decay resulting from improper lack of maintenance,vandalism,or infestation with vermin or rodents.
Any such derelict manufactured(mobile) home shall be returned to and maintained in the condition as
originally established on site and as inspected by the Weld County Building Inspection Department,
or it shall be removed from the site.
11. Any future structures or uses on site must obtain the appropriate zoning and building permits.
12. Effective January 1, 2003, Building Permits issued on the proposed lots will be required to adhere to
the fee structure of the Weld County Road Impact Program. (Ordinance 2002-11)
13. Effective August 1, 2005, Building Permits issued on the proposed lots, may be required to adhere to
the fee structure of the Capital Expansion Fee and Stormwater/Drainage Impact Fee. (Ordinance 2005-
8)
14. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations. In the event
the system is found to be inadequate, the system must be brought into compliance with current
I.S.D.S. regulations.

15. Mary Avenue is designated on the Weld County Road Classification Plan as a local gravel road, which
requires 60 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is
maintained by Weld County.
16. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Section 15-1-10 of the Weld County Code.
17. The applicant shall maintain compliance with Section 23-4-200 of the Weld County Code at all times.

in a timely fashion. Since this project is taking much longer than anticipated, you do need
to apply for a Zoning Permit for a Mobile Home (ZPMH) for a Temporary during
