HomeMy WebLinkAbout20080789 RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION ZCV#0800015 AGAINST FRANCISCO LOMA FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Francisco Loma, ZCV#0800015, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of March, 2008, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Francisco Loma was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Francisco Loma to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties,and any persons acting in active concert with the identified parties. 2008-0789 PL0824 01 ". I did speak with Peggy Campbell who had concerns with two properties. The other property is the one that T show no previous violations on. The property located North of you show three previous violations. Two were on the previous neighbor who did in fact submit a USR application (USR-1318) and later withdrew it. The violation number is V1-0000303. I will continue to look into the concerns von have regarding1957 11th. However, the program snapfish is blocked through our web server and would need to be attached to an email separate from the snapfish account. Also I want you to make note of the bow in the fence that my husband and I put up that is anchored to a pipe steel fence that has been severely damaged due to their negligence. They lean "stuff' against it, and when they do their form of weed control (which is with a front end loader scraping the weeds throwing seed into the air for noxious weeds to spread further in Weld) they hit the fence with the 01/28/2008 Page 2 of 2 bucket. Just wanted to ensure that you had this on the record. I also spoke with Peggy Campbell today and she said that you told her that you have no other record on this property. We had issues also with a previous owner that bought the property that thought that he could do what ever he wanted. It was case # USR-1318 that started in 2000 and ended in 8/2002. We in this area are NOT going to tolerate this! Many of us have lived here 20-30 years! I used to live at the property bordering the west(another trash issue for you-4908 46th Ave) from 1985-1999 prior to moving to where I am now, next door.
