This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: At the pre-submittal stage, I had to ask the applicant to show the tank storage area, water quality capture feature, and identify the drainage pattern with flow arrows, and show the drainage culverts at the access points. All the items have been placed on the plat drawing to my satisfaction. Weld County Road Classification Plan (FHU): (June 2002) WCRs 79.75 and 68 are local gravel roads and require a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. • These roads are maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Access: Both approaches from WCR 39.75 shall be graded and drained to provide an all-weather access to the site. Off-Street Parking: The parking and storage area for equipment and outdoor storage tanks shall be surfaced with gravel or the equivalent and shall be graded to prevent drainage problems. Stormwater Drainage: The applicant is showing a bermed water quality capture feature on the property, which meets our requirements. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. Water Division 1, Water District 3 Dear Mr. Ogle: We have reviewed the above referenced proposal for a Site Specific Development Plan and Special Use Permit to operate a commercial and industrial business facility (tank repair, agricultural millwork, & accessory to farm mobile home) on a 40 acre parcel. Since the submitted material does not appear to qualify as a "subdivision" as defined in Section § 30-28-101(10)(a), C.R.S., pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this development or the ability of the water supply plan to satisfy any County regulations or requirements. From the submittal materials, the property is served by a domestic well. According to our records, well permit number 71545 was issued September 24, 1973 as the only well on a 40 acre tract described as the SE1/4 of the NE1/4 of Section 22, Twp. 6 North, Rng. 62 West of the 6th P.M., Weld County. Pursuant to C.R.S. 37-92- 602(3)(b)(II)(A), the permitted uses for this well include fire protection, ordinary household purposes inside up to three single-family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more than one acre of home garden and lawns. The well was constructed on October 18, 1973 to a depth of 255 feet and the pumping rate was reported in 1973 as fifteen gallons per minute. According to the information provided, located on the property are a primary single family residence, an existing mobile home which serves as a single family residence and used as an accessory to farm, and various shop and farm out buildings. The business portion of the site is for an agricultural millwright business. It appears from the submitted material that non-family employees will access the property to only pick up parts and work orders, as work for the millwright business is done at the • customer's property. DATE: 07/02/2008 COLORADO Environmental Health Services has reviewed this proposal for an agricultural millwright business, tank repair and a 2nd residence. The site is served by a domestic well (permit - 71545) and two individual sewage disposal systems (permits — SP-9600012 and G19732642). Septic permit G19732642 was never finaled. Due to the age of the system this department will require a statement of existing to ensure the system is adequate for the proposed use. The application indicates there are two employees who come to the site on an intermittent basis to pick up parts and do paperwork. The application does not indicate water and sanitary facilities for the employees however the pre-application meeting memo, dated January 31, 2008, states that bottled water and a portable toilet is utilized • for the employees. As this is not a seasonal or temporary use, a permanent, adequate water supply is required as well as a permanent restroom facility. The applicants will need to verify with the Division of Water Resources that the existing well will allow for drinking water for the employees. The applicant indicated, in a phone conversation on July 1 , 2008, that employees will use the existing restroom facility located in the main house. The septic system for the main house was completed in 1996 and was sized for 6 people. The addition of two employees to the existing system is acceptable as there are only two people who currently live in the main house. However, the well may need to be re-permitted to allow the use of the residence for restroom facilities in association with the business. The application states that the majority of the tank repairs and agricultural millwright maintenance are done at the customers' site. As there are some repairs and maintenance that are done on the site, a waste handling plan is required. If water is utilized in the repair of tanks or in conjunction with the agricultural millwright business the well permit may have to be re-permitted to commercial. The applicant will need to verify with the Division of Water Resources whether the existing well can be used for the business. • The 2nd residence is served by the existing well and an individual septic system. The applicant shall verify with the Division of Water Resources that the existing well is permitted for two residences. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan (vehicle traffic) for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. • 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 3. The applicant shall submit evidence to the Department of Planning Services and the Environmental Health Department, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the business and for a second residence. 4. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. According to our records the existing septic system permitted as G19732642 was never finaled. A statement of existing and an I.S.D.S. evaluation is required. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. • 2 • 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan". 5. The facility shall be operated in accordance with the approved "dust abatement plan" at all times. 6. Any vehicle washing area(s) shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S., as amended. • 8. Adequate handwashing and toilet facilities shall be provided for employees of the facility, at all times. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking purposes. 11.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. Additionally, please note the following: 1. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. commercial use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. • 3 Hello
