Jerke, Chair Commissioner Robert D. Masden, Pro-Tern Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Jennifer VanEgdom County Attorney, Bruce Barker Public Works representative, Wayne Howard The following business was transacted: I hereby certify that pursuant to a notice dated October 31, 2008, and duly published November 7, 2008, in the Greeley Tribune, a public hearing was conducted to obtain public input regarding the "O" Street Arterial Corridor Study which was prepared by Felsberg Holt and Ullevig (FHU)for the Weld County Department of Public Works, the City of Greeley Public Works Department, and the Town of Windsor. Wayne Howard, Department of Public Works, provided a brief a history of the O Street Corridor, and confirmed a study of the Corridor was previously completed two years ago by the City of Greeley. He stated several alternatives were studied at that time; however, a route was not selected. He indicated the City of Greeley and the Town of Windsor entered into an Intergovernmental Agreement (IGA) with Weld County earlier in the year, in order to study two miles of the Corridor to be able to find an alignment to extend O Street to State Highway 257. He stated the study committee members consisted of Greg Flebbe, Bill Andrews, Fred Jones, and Steve Bagley from the City of Greeley, Dennis Wagner from the Town of Windsor, a consultant from FHU, and himself, representing the County. He clarified the three agencies equally shared the consultant's costs for the study, and he reviewed his PowerPoint presentation, marked Exhibit AA. He indicated the purpose of the study was to establish a preferred alignment in order to extend O Street, west of 83rd Avenue,to State Highway 257 at Crossroads Boulevard, providing a regional connection to Interstate 25. He clarified the need exists to improve regional east-west connectivity, to provide alternatives for motorists other than U.S. Highway 34 and State Highway 392, and the preferred alignment will serve as a guide to preserve the necessary right-of-way for future improvements. Mr. Howard indicated the North Front Range Metropolitan Planning Organization (MPO)completed an analysis of traffic patterns through the year 2035, and provided a map, indicating U.S. Highway 34 is expected to serve over 50,000 vehicles per day, and the O Street Corridor is expected to serve over 25,000 vehicles per day, by the year 2035. He clarified O Street, as it is currently developed, will not be able to handle the amount of traffic which is anticipated, which stresses the need for the project. 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 2 Mr. Howard clarified the study assessed the conceptual design alternatives, and confirmed there is currently no funding available to construct the roadway; in fact, it may be many years until the necessary funds for construction are able to be acquired. He indicated the Town of Windsor has set a designated alignment within it's Master Transportation Plan,therefore,the agencies together only focused on the remaining two miles of the Corridor. He briefly described the study process, indicating both data collection and public input were utilized to create a preferred alignment. He gave a brief description of the schedule of the public involvement program, as well as the study process, and indicated the comments received at the first public open house, held in June, 2008, were analyzed to help provide alternatives. He stated the preferred alignment was presented at the second public open house, held in August, 2008, and he clarified many alignments were studied; however, only the routes which are actually able to be constructed were included within the alternatives. He confirmed there are many different ways to be able to travel between two points; however,the committee only provided consideration for the routes which are physically able to be constructed. Mr. Howard displayed a map of the surrounding area, indicating the various land uses within the area, as well as the municipal limits for both Greeley and Windsor, and the designated floodplain area. He confirmed the committee studied the possibility of utilizing County Road 64.5, which currently exists, and the alternative was scored within the study; however, the committee had numerous concerns regarding the alignment of County Road 64.5, adjacent to the Great Western Railroad right-of-way. He confirmed the four proposed alignments directly adjacent to the intersection of O Street and 83rd Avenue were evaluated, and the recommendation of utilizing County Road 64.5 was considered as Alternative E. Mr. Howard indicated the aspects of the alternatives were reviewed by the committee, and he provided a synopsis of the final report, indicating the negative and positive aspects of each of the alternatives. He clarified Alternative A did not receive any votes at the open house, as it bisects future mining operations, and severs several parcels; however, there are no known environmental issues. He further clarified Alternative B received one vote during the open house, it is in close proximity to the northern Firestien home, and it does not achieve design criteria; however, it has the lowest estimated construction costs, and there are no known environmental issues. He indicated Alternative C received three votes during the open house and it adversely affects both of the Firestien residences; however, the straight alignment will increase safety and is the second lowest of construction costs. He further indicated Alternative D impacts an existing asphalt batch plant, it does not achieve design criteria, and it creates an out-of-direction travel to the south; however, it does not impact any existing residences,and it received the most votes during the open house. He clarified Alternative E creates out-of-direction travel, a high construction cost, does not achieve design criteria, and the proximity of the railroad tracks does not permit this option to be constructed. Mr. Howard reviewed the evaluation criteria considered by the committee on a conceptual level, which includes community input, community impacts, geometrics, safety, environmental impacts, and construction costs, and he confirmed over 60 miles within other corridor studies have utilized similar criteria. He confirmed this is a conceptual study only, and all of the fine details will be addressed within the construction phase. He indicated the committee's preferred alignment is Alignment C, which provides a straight alignment of O Street through the intersection with 83rd Avenue, following the section line to the intersection of State Highway 257 and Crossroads Boulevard. He confirmed the committee has indicated this alignment should be protected for future right-of-way preservation. 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 3 Mr. Howard briefly explained the typical roadway sections, indicating the road may handle up to 12,000 vehicle trips per day as a two-lane road. He clarified the road will need to be configured as a four-lane road in order to accommodate the additional traffic demand of up to 25,000 vehicle trips per day. He further reviewed the process of public participation, and indicated several one-on-one meetings were held with landowners, and approximately 30 people attended both of the public open houses on June 10, and August 19, 2008. He explained the Board will consider the adoption of the study in approximately two weeks, and if the study is approved, the necessary agencies will incorporate the study into their respective planning processes in order to begin preserving right-of-way, and Weld County will continue to coordinate with the other agencies as development occurs. In response to Commissioner Rademacher, Mr. Howard confirmed the final design will incorporate 140 feet of right-of-way, the design criteria are broken down into disciplines, and the details of the criteria are listed within the report to indicate how each of the criteria were scored and related to the design goals. He clarified the alternatives which did not meet the design goals received a lower score than the alternatives which did achieve the design goals. Further responding to Commissioner Rademacher,Mr. Howard confirmed Alternatives C and D did not contain significant environmental impacts; however, the placement of the road will be located within the outskirts of the floodplain boundary. He clarified the constructed road will serve as a border to the floodplain, and many details will have to be evaluated within the design process. In response to Commissioner Masden, Mr. Howard indicated the speed limit design varies between each of the alternatives, and he confirmed the speed limit design for Alternative D will be 45 miles per hour, and the speed limit design for Alternative C will be 55 miles per hour. Further responding to Commissioner Masden, Mr. Howard indicated the timeline for the design of the road will be based upon how the surrounding area develops. He clarified the Town of Windsor has recently improved Crossroads Boulevard, and there is a two-mile segment within the jurisdiction of the Town of Windsor which will need to be designed and/or developed before this additional two-mile stretch may be designed. He further clarified the Town does not have any current plans to move forward with expanding its two-mile stretch, and does not expect to begin any plans for at least five years; however, if the economy changes within the area, the need may expedite the project. In response to Commissioner Long, Mr. Howard indicated the municipal limits for the City of Greeley and the Town of Windsor on the map provided, and stated the City of Greeley does not currently have any plans for annexation within the area. He explained it has been important for the three agencies to work together within this study, and all three agencies agree the future connectivity is important, therefore, all three are committed to protect the necessary right-of-way. Responding to Commissioner Rademacher, Greg Flebbe, City of Greeley, stated the intersection of 83rd Avenue and O Street is within the City's Long-Range Expected Growth Area; however, there is no expected timeframe for ultimate buildout. He confirmed the intersection is outside of the Mid-Range Expected Service Area, which is the area planned to be developed within the next five to ten years; however, the surrounding area is part of a rail corridor study, which is a separate study and has not been completed. In response to Chair Jerke, Mr. Howard clarified, approximately five years ago, the County adopted seven roadways to be considered as Strategic Roadways, and these roads have a proximity to other major routes within the County, a majority of which are State Highways. He indicated County Road 49 collects a large amount of traffic from Interstate 76, traveling north to U. S. Highway 34, and County Road 27, also known as 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 4 83rd Avenue and Two Rivers Parkway, is expected to become a major route for vehicles traveling to and from State Highway 392. He clarified, upon completion of a separate study, the County protected the 140 feet of right-of-way necessary to construct a straight road. He indicated County Roads 13, 7, and 9.5 (the 1-25 Parallel Corridors), 74 (Harmony Road), and 24 make major connections throughout the County, and are paved for many miles in length. He clarified Department staff has been evaluating roadways which do not make proper major connections, and has been working to find alignments to create major connections; however,four-lane roads will not be built until necessary, rather, the Department is trying to plan for the future by reserving the necessary right-of-way before the area gets congested. He confirmed if the necessary 140 feet of right-of-way is not reserved in advance, the right-of-way will become too expensive when it is necessary to be utilized since improvements may be constructed within the necessary area. Chair Jerke expressed his appreciation to Mr. Howard for his summary of strategic roadways, and he clarified it is important to understand that the County must plan in advance for the construction of major roadways within the County. He stated it is important for the Department to be able to pre-determine what right-of-way will be necessary so that developments are not constructed within the middle of the necessary right-of-way. In response to Commissioner Rademacher, Mr. Howard confirmed County Road 27/83rd Avenue was adopted as a Strategic Roadway in 2002, and Two Rivers Parkway followed shortly after. He further stated the existing residences along 83rd Avenue are in very close proximity to the necessary right-of-way for the future expansion of that road, as well as within close proximity for the expansion of O Street, depending on which design is implemented. He confirmed the residences are currently outside of the reserved right-of-way for 83rd Avenue; however, it is extremely close. Bill Andrews, City of Greeley, indicated he is responsible for studying long-range plans in order to preserve the necessary future right-of-way to accommodate traffic. He indicated the City has been aware of the need for a strategic roadway within this area for the past seven years, as the area has become more congested. He clarified State Highway 392 is a popular option for travel within the area; however, it does not contain a bypass, and the road travels straight through the Town of Windsor. He indicated he has studied the need for a regional connection to Interstate 25 (1-25), and the logical choice seems to point to Crossroads Boulevard. He confirmed the only current connection to 1-25 is U.S. Highway 34, and the road is becoming very congested. Mr. Andrews confirmed the previous study of the O Street Corridor named three alignment alternatives, and the City did meet with residents within the surrounding area during the study. He clarified the City currently supports Alternative C, which creates a straight road, he confirmed the extension of O Street will become a needed route, and the MPO has also indicated O Street will become a route of regional significance. He reiterated the City of Greeley supports the Alternative C alignment and confirmed the City realizes the need for expansion of O Street. Dennis Wagner,Town of Windsor, confirmed the Town concurs that it is important to plan for future roads, and the Town would have previously created a bypass route for State Highway 392 if it had previously understood the impending need. He indicated a study was completed by the Colorado Department of Transportation(CDOT)approximately two years ago,which recommended a bypass route to the north of the Town of Windsor; however, the idea was not popular with residents. He indicated the Town now wishes it would have reserved the necessary right-of-way fifteen years ago so that a bypass route could have been properly planned. He indicated a consulting firm completed an alternative study, in response to the results provided by the study completed by CDOT, and the 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 5 results indicated the Town of Windsor should plan for the expansion of Crossroads Boulevard, in order to alleviate traffic congestion on State Highway 392. He confirmed the Town supports the expansion of Crossroads Boulevard, and the intersection with County Road 17 was recently constructed as a roundabout. He further confirmed the Town supports an extension of Crossroads Boulevard to the east, to eventually connect with the O Street Corridor. He indicated the Town does have a concept alignment for the first two miles of the expansion to the east; however, there is no known timeframe for construction of the road. Melvin Dinner, Attorney, indicated he represents Ruth Firestien and Judy Firestien, both of whom are opposed to the Alternative C alignment of O Street. He clarified the two Firestien residences are in very close proximity, located at the intersection of 83rd Avenue and O Street, where it currently ends. He read the legal descriptions of the Firestien properties into the record, and provided two maps of the properties, marked Exhibits P and Q, which indicate Lot A of Recorded Exemption #2802 is 2.5 acres in size, and Lot B is 44.44 acres in size. He gave a brief history of the property, indicating the Firestien family has been involved with working the acreage for the past 91 years, and has owned the acreage since 1966. Mr. Dinner indicated he has been practicing law for over 57 years, and he is personally acquainted with members of the Firestien family; therefore, he understands that the results of this study are very personal to the individuals involved. He indicated if the Alternative C alignment is selected by the Board, the Firestien residences will be destroyed, as well as other improvements on the properties, including sheds, etcetera. He reiterated both are opposed to Alternative C and believe there are other alternatives which are acceptable. He indicated the U.S. Highway 34 Business Route is currently being expanded and other existing roads could be restructured to accommodate additional traffic. He stated since the study indicates the actual construction work for the expansion of O Street will not be necessary for several years, there is ample time to restructure the intersection of U.S. Highway 34 and State Highway 392. He further stated these roads are capable of being improved, there is adequate time to complete the improvements, and it is more cost efficient to upgrade existing roads than to build new ones. Mr. Dinner submitted photographs of the Firestien properties, marked Exhibit R, and reiterated the improvements located on these two properties will be demolished if the County decides to proceed with Alternative C. He clarified the second residence was previously rented to a tenant; however, after the death of Chuck Firestien, Ruth Firestien's husband, which was caused by a tragic traffic accident, Judy Firestien moved back to the family property and now occupies the second residence. He indicated the study conducted by FHU is flawed, inadequate, and insufficient, and he believes more information is necessary before the Board may make a decision regarding a preferred alignment. He further indicated he understands the consultant attempted to complete an efficient study based upon the future traffic needs within the surrounding area; however, the study only reviewed a very small portion of the County. Mr. Dinner reiterated several comments made by Mr. Howard, regarding the purpose for the study, and indicated it appears to him that the main purpose is to establish an additional route for traffic from U.S. Highway 85 to 1-25, to the Cities of Loveland and Fort Collins. He indicated a new alignment for O Street is not necessary; rather, the County needs to more fully utilize U.S. Highway 34 and State Highway 392, and if the need for another roadway truly exists, other established routes, such as County Road 64.5, should be considered. Mr. Dinner provided a map of the alignment alternatives, marked Exhibit S, and indicated the public comment received at the open house held in June, 2008, indicated the 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 6 preferred route is Alternative D. He clarified Alternative E, utilizing County Road 64.5, was not considered as an alternative before the June, 2008, meeting, and at the persistence of Ms. Firestien, Mr. Howard finally agreed to give consideration to the already existing route. Mr. Dinner provided another map of the roads within the area, marked Exhibit T, and confirmed County Road 64.5, to the north of O Street, already exists and utilization of this road as a part of the extension of O Street will reduce construction costs. He indicated if the County is determined to go forward with the extension of O Street, his clients prefer the utilization of either Alternative E, utilizing County Road 64.5, or Alternative D, which would cause the alignment of O Street to dip south of the Firestien residences. Mr. Dinner provided a copy of the draft preferred alternative, marked Exhibit U,and indicated staff prefers Alternative C, since it is a straight alignment; however, the right-of-way necessary for Alternative C bisects both properties owned by the Firestiens. He indicated he believes the study is flawed because the consultant failed to adequately understand the status of the floodplain which is located west of 83rd Avenue, as well as the wildlife status within the proposed corridor. He further indicated the Colorado Division of Wildlife (CDOW) has expressed opposition to the preferred Alternative C. He clarified the proposed road corridor is located within the Poudre River Corridor, and the County should act to preserve and protect the 2.5-mile stretch of wildlife habitat in this area. He indicated the study failed to address several significant issues, more specifically the Whitney Ditch,an important irrigation ditch for area farmers, and the Sharkstooth Pipeline, which provides domestic water to eleven surrounding residences. He expressed his concerns regarding the construction of the road destroying the water pipeline, which would cause the affected owners to be required to purchase a water tap from the City of Greeley. Mr. Dinner indicated he has been involved with the implementation of the Poudre River Trail,which has provided wonderful recreational opportunities for residents; however, the extension of O Street will negatively affect the trail, the river, and the Tigges property, which contains several permits for recreational activities. He provided a copy of the evaluation rankings, marked Exhibit V, and indicated the study committee decided Alternative C, with the lowest ranking score, would be the preferred route; however, the route preferred by the public at the open house was Alternative D. He clarified of the seven committee members, four were employees from the City of Greeley, one was an employee of the Town of Windsor, one was a representative from FHU, and Mr. Howard was the seventh member, which creates an unbalanced committee since the affected property is located within unincorporated Weld County. Mr. Dinner provided a copy of the corridor evaluation rankings, marked Exhibit W, and indicated the preferred route presented at the open house held on August 19, 2008, was Alternative C, even though it was the secondary selection of the committee. He confirmed the public was not able to provide input regarding the preferred route at the second open house meeting. He indicated over 700 residents have indicated opposition to the preferred Alternative C, and Ms. Firestien will provide the names of those who have signed the petition. He reiterated the Firestiens are opposed to any roadway expansion within the corridor; however, if the County is adamant about creating a roadway, the preference is for the utilization of either Alternative E or D. He further reiterated his desire for the County to utilize and expand existing highways to accommodate future traffic. Ruth Firestien, surrounding property owner, indicated she lives at the intersection of 83rd Avenue and O Street, and she has provided numerous letters regarding her opposition to the expansion of O Street, as well as several newspaper articles and a few appearances within television news 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 7 segments. She indicated she does not want her home to be destroyed for the creation of a road which is not necessary, and the website created by her family has received over 700 signatures of other residents who oppose the expansion of O Street. She confirmed she opposes the use of eminent domain, and she explained the expansion of O Street will damage her family's heritage, as well as the Poudre River Corridor. She further indicated she understands she is not the only property owner to be affected by the planned expansion, she is upset about the turmoil she has been subjected to regarding the possibility of her home being destroyed, and she feels like she is being harassed by those associated with the corridor study. She indicated her husband and his brother grew up on this property, and proudly served their Country during World War II, and she, as well as her husband's sister, living within the City of Northglenn, oppose the destruction of the heritage of the family property which has been passed down through the generations. Ms. Firestien stated she has lived in her residence for a total of 56 years, since the time she married her husband, and she has raised her family in the residence she still occupies. She clarified her husband was a farmer, who loved farming in the area, and had dreams of living in this house for his entire life. She indicated he was known throughout the region as an exceptional farmer, and he took great pride in his straight rows of sugar beets; however, he was killed in a tragic vehicle accident on January 14, 2004. She indicated the property contains all of the original buildings, and she does not understand why the County would want to destroy the wonderful memories of a life lived on a farm, since she is proud of her family's heritage and way of life. Ms. Firestien indicated the consulting firm has indicated that the straight alignment will produce a safer road, as curves will be eliminated, allowing traffic to continue to travel at speeds of 55 miles per hour; however, she does not believe curves within a roadway cause more accidents, rather, they are necessary to reduce the speed of drivers. She expressed her concerns regarding the private domestic water line, which has been in existence since 1951, and she indicated she does not believe the study provided any consideration to the pipeline. She further expressed her concerns regarding the expensive costs which will have to be paid by affected property owners to purchase a water tap if the pipeline is destroyed within the road construction work. She indicated members of the Firestien family have been hard-working people who have lived on the property since 1917,and have always paid the appropriate taxes so government employees were able to do their jobs. She requested that the Board members consider what it would feel like to be told that a future road will destroy their homes and their future livelihoods. Jennifer Vecchi and Anne Johnson, representatives for LaFarge West, indicated LaFarge is currently within the process of obtaining permits for the Parsons Mine, which is approximately 400 acres in size, located west of 83rd Avenue and south of County Road 64.5, and the Poudre River runs along the boundary of the property. Ms. Vecchi clarified the permit application will be reviewed by the Board within the upcoming months, and at the request of staff, the location of the proposed O Street Corridor has been included within the plans for mining and reclamation. She further clarified the company expects proper compensation for any land necessary to preserve right-of-way, as well as for the sand and gravel resource underneath the proposed alignment, and she provided a large vicinity map of the project, marked Exhibit X. She indicated the preferred alternative will bisect the property, and there will be additional costs associated with constructing a conveyor belt to cross a major roadway. In response to Commissioner Rademacher, Ms. Vecchi confirmed Alternative C, staff's preferred alignment, is the alignment which has been accommodated within the mining plans. Responding to Chair Jerke, Ms. Vecchi confirmed the property is located to the west of County Road 25. 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 8 Chair Jerke issued a recess for the purpose of a lunch break. Upon reconvening, Joe Lohnes, surrounding property owner, indicated he supports the position presented by the Firestien family. He indicated he has lived within the area for approximately twelve years, he has seen changes in the traffic flow, and he understands additional traffic will be generated in the future. He confirmed two Realtors have visited his property to determine the property value and the marketability of the property, and he has been notified that the expansion of O Street will reduce his property value by approximately 25 percent. He expressed his concerns regarding the need to provide disclosure to potential buyers, and he expressed his desire to be treated with fairness and honesty. In response to Chair Jerke, Mr. Barker indicated Mr. Omas has the duty to disclose that a study has been conducted, and the possibility of the roadway being expanded does exist. He further stated the value of the property is not taken into consideration until the time that compensation is provided for the purchase of the required right-of-way. He confirmed the compensation provided will be calculated depending on the value of the remainder of the affected property, and the calculation will take place at such time the County decides to begin purchasing the necessary property. Ken Tigges, surrounding property owner, indicated he owns a farm adjacent to the Firestien property. He stated a current mining operation within the area contains five lakes and a drainage ditch, and he has not studied any geological profiles; however, he does not understand how the County proposes to build and support a roadway on marsh ground. He indicated construction crews will have to excavate down to the shale and haul in overburden in order to construct the road base. He stated Alternative E, utilizing County Road 64.5, has been built on stable land, and he confirmed he has lived within the area since 1949, and his family purchased the property in 1935. He indicated a lot of excavation activities have taken place in the marshland areas within past years, and most recently when an exploration company was digging pits to drill a well, the operator of the backhoe was sucked into the mud and lost the backhoe. He expressed his concerns regarding construction of the proposed roadway to be located on the same type of marsh ground. Mr. Tigges stated he worked in conjunction with Hall-Irwin Construction regarding a proposed mining project in the year 2000, and at the time, the mining plans were delayed due to the plans of the City of Greeley to construct a road in the area. He indicated the City never presented formalized plans for the road, therefore, the Board approved the USR permit application. He indicated Larimer County has been paying property owners to create open spaces, and he does not understand why Weld County wants to ruin the last open space corridor in the area by constructing a new roadway. He further indicated the Pourdre Learning Center was a wonderful donation for area residents, and the construction of the proposed road will significantly impact the learning center. In response to Commissioner Masden, Mr. Tigges indicated his farm is approximately 120 acres in size, and the Shiloh Lakes Subdivision was required to be setback from County Road 64.5, because it was anticipated at the time that the road will be utilized to expand the O Street Corridor. He indicated staff did not request the proper amount of right-of-way, therefore the roadway conflicts with the railroad right-of-way; however, he believes an agreement can be reached to utilize additional right-of-way. Gerry Firestien,surrounding property owner,expressed his support for the two Firestien residences to remain in their exact location. He indicated he has lived in the area for over seventy years, and he is still able to farm the ground he owns. He further indicated he provided his service for his 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 9 Country many years ago, and he would like the County to create a way to save the Firestien residences and to satisfy the expected traffic needs at the same time. Pam Frye, surrounding property owner, indicated she, and her husband David, live approximately one-quarter mile from the Firestien residences. She expressed her concerns regarding the domestic water provided to property owners within the area, and indicated she is disappointed that the issue of the water service to eleven residences was not considered within the road alignment study. In response to Ms. Frye, Chair Jerke indicated during road construction projects, the necessary utilities are moved and accommodated,and he confirmed nearly every road construction project must provide the necessary realignment of utilities. Ms. Frye questioned whether there are plans to provide water to the affected properties when the pipeline is not serviceable due to the realignment construction activities. Further responding to Ms. Frye, Chair Jerke indicated these types of situations happen multiple times per year,and the contractors completing the construction activities work out the details with the various utility providers. Ms. Frye indicated she believes the Board cannot answer whether the pipeline will be replaced or relocated, or who will pay for the necessary replacement costs, because the pipeline was not considered within the alignment study. She expressed her concerns regarding the pipeline being significantly disturbed as a result of the road construction, and concerns regarding the need to purchase a water tap from the North Weld County Water District, which many of the property owners are against. She clarified the purchase of her home included the water rights within the Sharkstooth Pipeline. She further expressed her concerns regarding the need to service the pipeline, which is completed by her husband, and she is nervous with the thought of traffic traveling 55 miles per hour right next to the pipeline. She requested that the Board give her assurance that the expansion of the O Street Corridor will not make it necessary for her to purchase a water tap for her residence. In response, Chair Jerke indicated the Board does not currently have the knowledge of the necessary future actions, therefore, guarantees cannot be made. Responding to Chair Jerke, Ms. Frye indicated the President of the Sharktooth Pipeline could identify the source of the water, and she requested that consultants be required to give consideration to water pipelines for any future road studies. Commissioner Long indicated he would like Mr. Howard to address whether the study included consideration of the pipeline costs following the conclusion of public testimony. Ms. Frye confirmed she read through the results of the study, and the results did not mention any information regarding the pipeline. She further confirmed she questioned the use of domestic water at the open houses; however, no staff members were able to answer her questions, as they claimed to be unaware of the pipes providing domestic water to the eleven property owners. Tom Livingston, surrounding property owner and operator of Livingston Livestock, indicated he would like to offer a different perspective on the proposed road project. He expressed his concerns regarding the environmental impacts of the proposed road expansion and the perceived lack of respect for the Poudre River Corridor area, and he believes the input provided by surrounding property owners has fallen on deaf ears. He indicated Mr. Andrews from the City of Greeley has been receptive to his thoughts since the year 2005; however, all of the information and testimony presented regarding the utilization of County Road 64.5 has been ignored. He confirmed his family owns the Artesia Farm and Ranch, which is 92 acres in size and contains a Historic Certificate, and he confirmed his family has worked hard to restore the historic integrity of the farm, which includes artesian springs and wells. Mr. Livingston indicated he is a Commercial Real Estate developer who has worked on many projects within Northern Colorado, and he has experience in all classifications 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 10 of development. He stated green belts around developments create value, and it is important that the Board have the opportunity to help guide the direction and the location of the proposed road, since it will affect the property values of Weld County property owners. He indicated it is inappropriate to impose a four-lane road in an area which is environmentally sensitive. He indicated he understands the need to prepare for additional traffic; however, the preservation of the river corridor area and the provision of open space is more important. He stated public funds are spent to purchase open space in other counties, and he believes constructing a road with a large amount of right-of-way within a floodplain is very short-sighted. He reiterated that County Road 64.5 is an acceptable alternative, and even though his property is located adjacent to the road and would be negatively impacted, he believes the existing road is a more appropriate option. He confirmed County Road 64.5 contains the established right-of-way, it is an existing, functioning road, and the ability to construct additional improvements does exist. He further confirmed there are challenges in relation to the location of the railroad right-of-way; however,these challenges are not as extensive as those which will be encountered during construction of a brand new road. Mr. Livingston indicated the County should construct or make improvements to a road in a location where the road can be"double loaded,"meaning development has the ability to occur on both sides of the road. He confirmed the preferred Alternative C, located within the floodplain,will not be able to be "double loaded." He indicated, as a developer, he understands that the County needs to create value for Northern Colorado, which includes maintaining existing open space even if it presents a negative impact to traffic. In response to Chair Jerke, Mr. Livingston indicated if development cannot occur on both sides of a constructed road, the feasibility of the road is reduced, since the County will only be able to recoup half of the investment. He reiterated the Board has the opportunity to direct the decision to create value for Northern Colorado. Luis Cantarero, business owner within Larimer County, indicated he is considering relocating his business to Weld County as his company experiences the need to expand. He indicated it is difficult to recruit quality employees within the surrounding area, and he has found that the open space and beauty of the land within Northern Colorado has helped to recruit and retain quality employees. He requested the Board take into consideration that the expanding employment base is partly based upon scenic areas which attract people to come and live and work. Jeff Cook indicated he lives adjacent to the Shiloh Lakes Subdivision, and confirmed he moved to his residence for the quiet open space. He stated the open space within the surrounding area is very important to his family, and he suggested staff study the expansion of the State Highway 392 corridor instead. He confirmed the properties within the subdivision are in very close proximity to County Road 64.5, and the expansion of the road will cause detriment to the surrounding property owners. He indicated he understands that State Highway 392 does bottleneck within the Town of Windsor; however, there has to be a better way to allow traffic to flow through the area. Steve Heinike indicated he is the President of the private water company which provides water through the Sharkstooth Pipeline, and his residence is approximately three-quarters of a mile from the intersection of O Street and 83rd Avenue. He stated he has lived in Northern Colorado for approximately 25 years, and he confirmed he has stayed in Northern Colorado because he wanted to remain in a place where families are raised and where a balance of economic development and lifestyles occur. He further stated he is employed by Vestas, and approximately five years ago, he worked with the Northern Colorado Network and Business Alliance to attract companies to Northern 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 11 Colorado. He clarified he was recently walking along the Poudre River Trail with the Vice President of Manufacturing at Vestas, who indicated he was enamored by the beauty of the area, and was surprised to find out the County was considering construction a four-lane road within the corridor. Mr. Heinike indicated he does not believe the County is putting ample weight into the value of preserving open space between the merging cities within Northern Colorado, and he requested the Board not underestimate the value of keeping the corridor as open space. He stated the study should have addressed the ability to build within the floodplain area, as well as the issue with replacing existing wells within the area. He further indicated the residents which are moving to northern Weld County value the green space offered, and want to raise their families within a beautiful area. In response to Chair Jerke, Mr. Heinike confirmed the Sharkstooth Pipeline is connected to a water line from the City of Greeley, and is approximately five miles in length, with thirteen active taps for eleven residences and two mining companies. He clarified the Sharkstooth Water Company trades shares of water to the City in return for treated water, and the price is dispersed among the customers situated along the pipeline. Responding to Commissioner Rademacher, Mr. Heinike confirmed the water company is responsible for the maintenance of the pipeline, which is measured monthly. He further stated the price for replacement of the pipeline was estimated to be approximately$135,000.00 over five years ago, and he estimated it will cost approximately $375,000.00 to replace the pipeline now, which is equivalent to tap fees for connections to the North Weld County Water District. Judy Firestien, surrounding property owner, indicated she previously forwarded information for the Board to review, which is contained within Exhibit H. She confirmed she is greatly opposed to the expansion of O Street as proposed within Alternative C, and she does not believe there is a need to demolish residences, since there are other viable alternatives within the area. She reiterated the U.S. Highway 34 Business Route is currently being widened, and Alternative D within the conducted study does not interfere with any existing residences. She indicated her desire for the proposed road to be forgotten altogether, especially since many other residents agree that the expansion of the road is not necessary. She stated the construction of the road will destroy residences, farmland, recreational areas, and will significantly negatively impact the Poudre River Corridor, including causing damage to wildlife and bald eagle habitats. She further stated the Poudre River Trail is known for its peacefulness, and the trail will be impacted by the increased traffic expected within the area. She confirmed the widening of O Street, east of 83rd Avenue, will also affect many property owners, and she believes there are numerous flaws within the study, including the recommendation which was submitted from an unbalanced committee. Ms. Firestien indicated staff never gathered public input regarding Alternative E,which utilizes County Road 64.5, and the study results presented today did not make any mention of the concern for headlight glare, which she believes is a ridiculous concern compared to the threat of two residences being destroyed. She indicated the study results contain misleading and untrue information, and she confirmed she was previously told that the road would be constructed within the next two years; however, at the meeting in August, 2008, the information was given that the road would be constructed within the next ten years. She stated an open house was supposed to be postponed so that her mother could attend; however,the open house was not postponed, and her mother was not able to attend. She further stated she requested additional notification of the open houses be provided; however, no notification was provided within the Greeley Tribune regarding the final open house, and she does not believe that 300 surrounding property owners received notice of the scheduled open houses through the mail. 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 12 Ms. Firestien indicated Channel 7 News quoted one of the Commissioners, indicating that the Department of Public Works had revamped the plan for the road, and the southern route (Alternative D) would be presented to the Board as the preferred alternative; however, the study recommendation has been presented as Alternative C. She further indicated Chair Jerke was recently interviewed by Fox 31 News and indicated that traffic from the Owens-Illinois factory would likely utilize this new route; however,a previously printed newspaper article indicates Owens-Illinois has confirmed the manufactured bottles are delivered to the City of Fort Collins. She indicated the statement presented leads her to believe that none of the staff involved with the project have done much more than study an aerial map of the surrounding area. She confirmed she has extended the offer of providing a tour of the area, to indicate the natural resources location within the area; however, no one has accepted the invitation, and she is not sure that any of the Commissioners are truly familiar with the location of the proposed road. She indicated some of the statemens made have been misleading to those who are not aware of the proposed project, and she believes the wishes of her neighbors have been ignored. She confirmed she has not received any type of response to the correspondence she has provided, and she is still waiting for an explanation of the discrepancy of the statement made to Channel 7 News. Ms. Firestien indicated the public input wishing to save the residences has been ignored by the members of the committee, which is evidenced with the recommendation of Alternative C, which will destroy at least two homes. She expressed her concerns regarding the threat of eminent domain, and the potential to lose the historic homes which have been occupied by members of her family for over 80 years. She clarified her parents moved onto the farm, intending to live out the rest of their lives there, and her mother would like nothing more than to continue to live her life in the home where she has spent the large majority of her time. She confirmed her mother has been through a lot of stress and pain concerning this project and she does not desire to move into another home or secure a large amount of debt to build a new residence. She expressed her concerns regarding the loss of income from the farmland and mineral development, since the proper monetary value will not be offered for the necessary right-of-way. She confirmed she has spent a large amount of time writing letters of opposition, sending e-mail notifications, and creating a website for others to express their opposition, and her family and many of her neighbors have experienced a lot of anguish and irritation as a result of this proposed project. Ms. Firestien confirmed three television stations have reported on the situation, and there have been over 1,400 visits to the website created, many letters of opposition have been submitted to the Board, and 762 signatures of opposition were collected when the project was first introduced in the year 2005. She provided a copy of the petition of opposition, marked Exhibit Z, and indicated an online petition was started in September, 2008, and so far over 700 signatures of opposition have been provided to this petition as well. She confirmed over 100 comments have been received from the community, indicating opposition to the destruction of homes and the Poudre River Corridor, and many state that the expansion of O Street is not even necessary. She requested the Board consider an alternative alignment, or stop the project altogether, since the expansion of O Street will serve to destroy properties, wetlands, wildlife, and the prosperity and livelihood of area residents. Chair Jerke indicated the comments he provided to Fox 31 News were regarding the entire continuum of the finished product of the road, and the type of motorists which will utilize the road. Commissioner Long indicated Channel 7 News asked which recommendation the representative 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 13 of the County provided, and he confirmed Mr. Howard preferred Alternative D, the southern route. He further stated the hearing today is for the sole purpose of obtaining public input,and public input will also be welcome at the subsequent meeting when the Board makes a determination. In response to Commissioner Masden, Ms. Firestien indicated her family owns a total of 50 acres,and a Recorded Exemption was completed in order to facilitate the construction of a garage for her parent's residence. She confirmed her family originally owned close to 200 acres total, and 120 acres were sold to Hall-Irwin in 1996. Mr. Livingston stated when the Owens-Illinois bottling plant was constructed,two curves in the road had to be modified, and four curves still require modification to increase safety in the area. He confirmed if Alternative C is constructed, O Street will be become a death trap, due to the proposed speed of 55 miles per hour. He indicated with the proper design and timing, the necessary curves could be modified and improved. Tad Stout, resident of the Town of Severance, indicated he is a family friend of the Tigges family, and he is a Wildlife Biologist who is helping Mr. Tigges develop the wetlands within the area. He gave a brief description of the property and expressed his concerns regarding the creation of a major roadway polluting the newly designed warm water aquaculture facility. He indicated if the road is developed, he requested that the City of Greeley create an allowance of mitigation for the wetlands. He clarified the County is not utilizing the full potential of County Road 23, and believes the O Street Corridor will only serve as a band-aid fix to a bigger traffic problem. He confirmed the U.S. Highway 34 Business Route is currently in the process of being expanded, and it will be able to handle an increased load of traffic once construction is complete. He further confirmed the Town of Windsor has not allowed for proper development to circumvent the traffic congestion, and a developed road through the Town of Severance will be able to handle traffic from the Vestas facility and the heavy traffic utilizing roads within the Town of Windsor. Mr. Stout indicated he has studied the Poudre River Corridor area, and confirmed it contains the last remaining unspoiled portion of riparian area within the area. He further confirmed there are many species of wildlife and migratory wildlife which reside in the area, and even the very small disturbance of the Poudre River Trail has created huge impacts on the wildlife. He indicated the development of the area will take away the food source for wildlife, will create a loss of revenue, and will create a loss of integrity of the land itself. He expressed his desire for his children and grandchildren to be able to appreciate the natural beauty of the area, and the Board holds the responsibility to make the right decision for future generations. He reiterated an expanded road does not need to be constructed within the area, and the Board needs to find a solution to the overall bigger problem. In response to Mr. Dinner, Mr. Barker confirmed all of the exhibits which were submitted have been included as a part of the record. In response to Ms. Firestien, Mr. Barker indicated he is not sure if the exhibits will be posted online by Public Works staff. Mr. Howard stated this hearing contained a large amount of discussion regarding the Sharkstooth Pipeline, and he confirmed the study did include focus on the pipeline. He clarified the proper utility work is always provided within road construction projects, and any extraordinary requirements may be focused upon at a later date. He further clarified the relocation of a gas line will also have to be addressed within the details of the design, and during the design process, the consultants will determine the best way to accommodate all the necessary relocations. He explained a specific 2008-3005 EG0058 HEARING CERTIFICATION - "O" STREET ARTERIAL CORRIDOR STUDY PAGE 14 time for the construction of the road improvements has never been stated; however, the proper time for the commencement of construction activities will be once all of the concerns of the utility providers have been adequately addressed. Responding to Commissioner Long, Mr. Howard confirmed the configuration of Alternative E, utilizing County Road 64.5, has fatal flaws. He indicated the alignment has too many obstacles, and it is the general consensus of engineers that out-of-direction travel along a road is not preferred, and the motoring public within the area have expressed dislike for the utilization of roundabouts at intersections. He stated the connection of the road with the railroad tracks is an unsolveable issue, since the railroad company will not grant an additional permit to cross the tracks and the railroad right-of-way supercedes the road right-of-way. He clarified Alternative E was not originally considered as a part of the first open house, since staff recognized that a road through the area would not be buildable, therefore, the study was focused at the intersection of O Street and 83rd Avenue. Ruth Firestien indicated County Road 64.5 was previously known as Stagecoach Road,which was constructed before the railroad tracks, therefore, the road should have superceding right-of-way. Judy Firestien indicated she believes Crossroads Boulevard,from State Highway 257,will become out-of-direction travel, since it should line up with County Road 62. Chair Jerke indicated the utilization of County Road 64.5 includes an extra half-mile of abrupt out-of-direction travel, and the alignment of Crossroads Boulevard is phased over multiple miles. Judy Firestien indicated she understands that different areas within the County are experiencing growth; however,the MPO has indicated that most of the growth for the City of Greeley is occurring on the south side, therefore, she believes a study should be conducted for 37th Street instead. Chair Jerke indicated 37th Street is also a major road of interest for the County, and the County is taking steps to preserve the necessary right-of-way within that corridor as well. In response to Chair Jerke, Mr. Barker confirmed the Board will make a determination at the regularly scheduled Board meeting of December 8, 2008, at 9:00 a.m., at which time additional public input may be presented. He indicated the Board has heard a large amount of testimony through the public input hearing today, and he clarified the Board will want to consider any additional testimony; however, repetitive testimony will not be necessary at the upcoming meeting. Mr. Howard indicated the public input hearing for the County Road 24 Corridor Study has also been scheduled for December 8, 2008. At the request of the Board, Mr. Howard indicated that the County Road 24 hearing will be delayed to another date.
