RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST J A R HOLDINGS, LLC, FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, J A R Holdings, LLC, ZCV #0701049, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 11th day of December, 2007, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, at
which time this matter was continued to January 8, 2008, to allow adequate time for the property
owner to submit a completed Use by Special Review application.
WHEREAS, on the 8th day of January, 2008, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Dan Rodarmel, representative, was present at said hearing, and
WHEREAS,the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until February 8, 2008, to allow adequate time for the property owner to submit a
completed Use by Special Review application to bring the subject property into compliance and for
an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV#0701049 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against J A R Holdings, LLC, to remedy the violation of the Weld County
Code, and any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties, with an instruction
for delay of action upon such referral until February 8,2008,to allow adequate time for the property
owner to submit a completed Use by Special Review application to bring the subject property into
compliance.

REMEDY
It is my understanding that you are really close to completing the Use by Special Review application. If
a complete application is submitted prior to the above referenced date, the above hearing will be
canceled.
RECOMMENDATION
The Department of Planning Services recommends that this case be referred to the County Attorney's
Office for immediate legal action.

06/05/2007 Property Inspected Upon a visual inspection of the property, the following
items were noted: I noted several commercial vehicles. It
was obvious that a large scale commercial operation has
moved into this location. No pictures were taken during
this inspection.
10/12/2007 Phone Call I called Dan Rodarmel w/JAR to advise him of Firestone"s
referral response. He was not happy. He indicated that
he had completed the following items and gotten the
following responses:
-09/14/07 - He spoke to Rebecca, she said maybe 1 more
day (in order to complete the referral).
-09/19/07 - Rebecca indicated they didn"t have the Notice
of Inquiry form.
-09/28/07 - Rebecca told him that she didn"t know yet, but
would try to get him an answer by the end of the week.
-10/11/07 - Rebecca indicated that they didn"t know yet
I read him the referral and advised him that in order to
proceed through the County we would definately need to
receive something from Firestone indicating that they did
NOT wish to annex. He indicated that everytime he has
spoken to Bruce Nickerson, Bruce keeps telling him that
he"ll be in that area the next day. I advised him if he was
having problems, he might want to consider speaking to
the Mayor. He said he was going to have to do that. I
asked him if he wanted a copy of the Notice of Inquiry
faxed to him. He said that he would. His fax number is
303-684-6594. I faxed him a copy (see file).

Based upon what we have received from the Town of Firestone, they are requesting an annexation
agreement. Therefore, in order to cancel the above referrenced hearing we will need to receive one of tt
following on or before the hearing:
1.) Notification from Firestone indicating you have submitted a complete annexation application.
2.) Evidence from Firestone withdrawing their request for annexation and a complete Use by Special
Review application.
3.) Evidence that the business has been removed from the property.
Hopefully by scheduling this out until December 11th, it will give you enough time to complete 1
(one) of the foregoing options.
RECOMMENDATION

Please see the following Notice of Inquiry response received from Bruce Nickerson with the Town of
Firestone. Thank you in advance.
As we discussed, in order to proceed through the County, we will need to receive written evidence from the
Town of Firestone that indicates they will not require annexation. However, if they do require annexation they
might be willing to allow you to develop your property through the County and annex at a later date (which we
would also need to receive in writing); otherwise, their existing referral response requiring you to annex will be
acknowledged by the County.

Upon further review, it does appear that your property is situated within our IGA
(Intergovernmental Agreement) area with the Town of Firestone. It is my
understanding that you already have approached Firestone, but we need to actually
receive something in writing from them stating they do not wish to annex. Please see
the enclosed document (if you have already received the enclosed Notice of Inquiry,
please disregard). I recommend that you take this to them right away (sometimes it
takes a little bit of time to get this back from them).
I am granting this last 30 day extension request in order for you to complete and submit
the Use by Special Review (USR) application. I will not be able to grant any additional
extensions.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
10/11/2007, to correct this zoning violation. Failure to do so will result in this office scheduling the
