HomeMy WebLinkAbout20082702.tiff HEARING CERTIFICATION DOCKET NO. 2008-66 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1664 FOR AN OIL AND GAS PRODUCTION FACILITY IN A PUD (PLANNED UNIT DEVELOPMENT) WITH E (ESTATE), C-1 AND C-2 (COMMERCIAL),AND R-1, R-2, R-3, AND R-4 (RESIDENTIAL) ZONE DISTRICTS - CARMA BAYSHORE, LLC, C/O KERR-MCGEE OIL AND GAS ONSHORE, LP A public hearing was conducted on October 8, 2008, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner Robert D. Masden, Pro-Tem Commissioner William F. Garcia Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Cyndy Giauque Planning Department representative, Jacqueline Hatch Health Department representative, Lauren Light Public Works representative, David Snyder The following business was transacted: I hereby certify that pursuant to a notice dated August 29, 2008, and duly published September 5, 2008, in the Greeley Tribune, a public hearing was conducted to consider the request of Carma Bayshore, LLC, do Kerr-McGee Oil and Gas OnShore, LP, for a Site Specific Development Plan and Use by Special Review Permit#1664 for an Oil and Gas Production Facility in a PUD(Planned Unit Development) with E (Estate), C-1 and C-2 (Commercial), and R-1, R-2, R-3, and R-4 (Residential) Zone Districts. Cyndy Giauque, Assistant County Attorney, made this a matter of record. Jacqueline Hatch, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She stated the proposal consists of four separate parcels contained in Section 25, Township 3 North, Range 68 West, located east of County Road 11, and south of State Highway 66, comprising 467 acres. She stated the proposal is compatible with the surrounding land uses, and the applicant intends to use four existing well sites to directionally drill under land owned by the Homeowners'Association for Carma Bayshore, LLC. Ms. Hatch stated the sites are located within the three-mile referral area for the Towns of Firestone and Mead, as well as the City of Longmont, which indicated no conflict with its interests. She stated the Town of Mead expressed concern with the access location along State Highway 66, in close proximity to a property not owned by the applicant. She stated no response was received from the Town of Firestone, there are twelve property owners within 500 feet of the proposed sites, and she displayed photographs of the facilities and surrounding area. Ms. Hatch stated 15 referral agencies reviewed the proposal, five offered no comment, five responded with comments that have been addressed in the Conditions of Approval and Development Standards,and staff received no response from the Colorado Oil and 2008-2702 PL1867 a() ,Gf/ /fL /!7-//o CJuG HEARING CERTIFICATION - CARMA BAYSHORE, LLC, C/O KERR-MCGEE OIL AND GAS ONSHORE, LP (USR #1664) PAGE 2 Gas Conservation Commission, Colorado Department of Public Health and Environment, Boulder Valley/Longmont Soil Conservation District, Town of Firestone, or the Colorado Division of Wildlife. David Snyder, Department of Public Works, stated the applicant will use existing accesses which meet the 20-foot width requirement for emergency responders and provide all-weather access,and staff has no concerns with the proposal. Lauren Light, Department of Public Health and Environment, stated this is not a manned site, therefore, water and sewer services will not be required. She stated the applicant has submitted a Dust Abatement Plan, which is acceptable, and staff has no concerns with the proposal. Robed Spencer represented the applicant and stated there is an existing facility on the northwest corner, which is in close proximity to an adjacent property owner; however, they have signed a waiver regarding the distance between the property line and the facility. Regarding the comment from the Town of Mead concerning the access on State Highway 66, he will ensure the access is adequately constructed so that it does not negatively impact the access for the nearby residence. In response to Commissioner Garcia, Mr. Spencer stated the facility in the northwestern corner effects the Boda property. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Spencer stated he and the applicant have reviewed, and concur with, the Conditions of Approval and Development Standards, as proposed. Commissioner Long moved to approve the request of Carma Bayshore, LLC, do Kerr-McGee Oil and Gas OnShore, LP, for a Site Specific Development Plan and Use by Special Review Permit#1664 for an Oil and Gas Production Facility in a PUD (Planned Unit Development)with E (Estate), C-1 and C-2 (Commercial), and R-1, R-2, R-3, and R-4 (Residential) Zone Districts, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Masden, and it carried unanimously.
