HomeMy WebLinkAbout20081252.tiff MINUTES OF THE WELD COUNTY UTILITIES ADVISORY COMMITTEE A regular meeting of the Weld County Utilities Coordinating Advisory Committee was held on Thursday, April 10, 2008 at 10:00 a.m., in the Conference Room of the Weld County Planning Department at 918 10th Street, Greeley, Colorado. Members Present: Don Posselt, Robert Fleck, Jerry Adams, Don Magnuson, Dave Snyder, and Don Somer. Members Absent: Doug Melby, Lyle Sheeder, and Al Trujillo. Also Present: Chris Gathman, Department of Planning Services; Don Dunker, Department of Public Works, and Kris Ranslem, Secretary. CASE NUMBER: PF-1129 APPLICANT: Homestead Development, LLC(Home Ranch PUD) PLANNER: Chris Gathman LEGAL DESCRIPTION: Lot A of RE-4545; located in part of the E2SW4 of Section 32,T7N, R67W of the 6th P.M.,Weld County,Colorado. REQUEST: A change of zone from A(Agricultural)to PUD for eight(8)residential lots for E (Estate)uses along with 7.071 acres of open space. LOCATION: North of and adjacent to CR 74 and 1/4 mile east of CR 15. Chris Gathman, Department of Planning Services introduced the case. He stated that as shown on the proposed final plat there is a minimum 20' side lot setback, 15'front easement off of Kiley Court and Hannah Lane, and a 30 foot utility easement along the northern boundary of the PUD. Mr. Gathman said that Tracts A, B, and C are common open space areas. Tract A is proposed to contain a potential picnic area and there would also be a partial detention area there as well. Tract B will contain landscaping, a monument sign and also a school bus shelter. Tract C will have some landscaping and also a 40 foot ditch easement in which the Lake Lee Lateral crosses the property. Mr. Gathman indicated that this case is interesting as there is a tract that is not part of the PUD which is listed as a portion of Lot B of RE-4545. He added that some of their detention will run across that lot. Mr. Gathman commented that he talked to Mr. Serbousek, who is the applicant for this project and who had been in contact with the Poudre Valley REA and he indicated that they will be putting in a 10 foot utility easement along County Road 74 as well. Don Dunker, Department of Public Works, referred to the additional utility easement from Poudre Valley REA and commented that he wants to make sure that it is outside of the Department of Public Works' future setback of which is 40 foot. Don Somer said that for Tract B he will need a pocket easement or he would like to see it as a utility easement because he will need to put some cabinets in there. Jerry pointed out that Tract A, B, and C are called out as common open space parcels. He asked if we could add "common open space area and utility easement". Mr. Gathman asked for clarification if they wanted it on all of the Tracts. Jerry said particularly Tracts A and B as a blanket easement. Mr. Gathman said that he would change that. Don Posselt said that was good point as they are working with the applicant to put water in and added that otherwise they are going to be putting a water line in with no easement. Jerry asked then if a blanket type would be good coverage for them. Mr. Posselt said that it would. Mr. Gathman asked if they also want that on Tract C. Jerry said that it looked like Tract C already calls out the 15'front and side utility easements and therefore it should be okay as is. Don Magnuson commented on the Lake Lee Lateral and asked where is it and the status on that. Mr. Gathman said that it is a diagonal lateral and is located in the Southeast corner of the site. He added that it runs across Tract B and it crosses the road. Mr. Gathman stated that the applicant does have a crossing agreement with Lake Lee lateral. Mr. Gathman commented that in a referral received from Lake Lee Lateral they indicated that they have no concerns, however there may be some additional specific improvements for the road crossing that they may need. y owdf- 2008-1252 Don Posselt referred to the radius for the school bus shelter and commented that he doesn't think that they want to be bending a water line clear around that thing and would rather like to go through there. Mr. Gathman replied that the school bus shelter will have to meet setbacks and this plat shows it right off of the road. He added that they didn't call out a setback exception at the Change of Zone, therefore the shelter will have to be moved back 10 to 20 feet further. Mr. Gathman asked for clarification if he was referring to the water line bending around the turn around or the bus shelter to be further off the road to allow that. Mr. Magnuson asked if it is going to be on Tract B or is the cul de sac going to be part of the easement. Chris stated that the turn around is part of the right of way. Chris commented that the water line could be located in the road right-of-way. Jerry referred to Poudre Valley REA giving a 10 foot easement on the south edge of the property, adjacent to County Road 74. Mr. Gathman said that this is just in discussions with the applicant and currently does not have anything on paper. He added that it sounded like it might be more of a generic type of an easement. Jerry noticed that the standard 15'front and/or side lot easement is not shown on the map and asked if we would want to bring it up to standard and make it a 15 foot front and side easement. Mr. Gathman replied that they could do that. Jerry summarized the changes as suggested: 1)to add verbage to Tract A and B to contain a blanket utility easement, and 2)the addition of a 15 foot front and side lot easement along County Road 74. Don Posselt moved to approve Case PF-1129 with the suggested changes, seconded by Don Somer. Motion carried. CASE NUMBER: 2n°AmPF-496 APPLICANT: George Bollinger PLANNER: Chris Gathman LEGAL DESCRIPTION: Lot A of Avery Acres PUD; located in W2 of Section 10,T6N, R65W of the 6th P.M.,Weld County, Colorado. REQUEST: An Amendment to the PUD final plan (adjust the outer boundaries of Outlot A and create an additional single-family residential lot)for Outlot A of Avery Acres PUD. LOCATION: East of and adjacent to CR 43 and north of and adjacent to CR 70. Chris Gathman, Department of Planning Services, had apologized for the drawing that the board had received as the applicant did not submit a revised plat that accurately shows what they are proposing. Mr. Gathman commented that he tried to draw in exactly what they were proposing to do. Mr. Gathman stated that the applicant is proposing to place two additional lots (Lots 6 and 7) at the north end of the subdivision. He added that according to the condition for this PUD there will be a County Road dedicated from the north and that is where the access will be for the two lots which is through a cul de sac. He added that there will be a 30 foot emergency access which is currently shown on the east side of Lot 6. He said that it is proposed to be moved over to the west side so it would be located on what is Outlot A which is an Agricultural Outlot. He further added that it would connect in with Outlot B which is Avery Drive that accesses the five existing lots. Mr. Gathman said that the existing five(5) lots currently do have all of the easements: the 10 foot side lot easements, 25 foot easement along the rear lot line and also a 50 foot easement for stormwater retention in addition to a standard 15 foot drainage easement which is adjacent to Avery Drive. He added that staff recommends that the 20 foot side lot easements(10 feet on either side of the property) be shown for Lots 6 and 7. Mr. Gathman said that there is currently a 30 foot easement shown that was already there through the original plat along the rear lot line on the east edge of the subdivision. He added that staff is also recommending that they show a 15 foot utility easement along the cul de sac and also all the way down the east edge of the lots to the southern boundary of Lot 6. Don Posselt asked about the 30 foot water line easement that is shown on the map. Mr. Gathman said that it is existing. Mr. Posselt said that it is indicated on the map with a curve and added that it is a straight easement all along there. Mr. Gathman clarified that the easement would not be a curve and would remain straight from his discussion with the North Weld County Water District. He added that would be another thing that would need to be changed on this plat and the water line would actually be going under the road. Don Magnuson assumed that the irrigation ditch/pipeline has an existing easement because it is along Avery Drive. Mr. Gathman said that it is the North Weld County Water District's water line easement that runs right along the road. Mr. Gathman also wanted to add that Outlot A is currently proposed as a non-buildable Outlot. It would only be builable for Ag Exempt structures and no Residential structures could be built out there as it is entirely within the 100 year floodplain. He added that right now no easements are shown for the exception of the North Weld County Water District's water line easement. Jerry commented that this case seems a little unusual because there are so many unknowns. He said that what is described sounds okay with all the utility easements added on Lots 6 and 7 per County Code. He asked if there would be another plat made to come back to review at a later time. Mr. Gathman replied that his comment was fair and added that he was in contact with the applicant and it was his understanding that there would be full-sized plats prior to this meeting. He mentioned that this could be continued to a later date and suggested either April 24, 2008 or May 8, 2008. Jerry suggested leaving it up to Mr. Gathman for setting the date, but to tentatively schedule the hearing for April 24, 2008.
