HomeMy WebLinkAbout830854.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 590 - LE NEITA STAMP WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 590, being the property of LeNeita Stamp, described as part of the Northwest a, Section 31 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove described parcel of land owned by Le Neita Stamp be, and hereby is, exempt from the definitions of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) That only one mutual 30 foot access easement be allowed to serve both parcels. This access shall be shown on the Recorded Exemption Plat before recordation by the office of the Clerk and Recorder; 2) The applicant shall provide an approved method of sewage disposal from the Weld County Health Department before the issuance of any building permits; and 3) The applicant shall submit a mylar plat to the Department of Planning Services ' Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Sub- division Regulations. The parcel of land on which this request is being made is described as part of the Northwest 1/4, Section 31, Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado. The property is located adjoining the western portion of the Union Reservoir on Weld County Road 1. The property contains approximately 22.74 acres of Class I and II irrigated and Class III and IV nonirrigated soils. The request is to divide the property in half, creating two parcels of 11.37 acres each. There are no dwellings on either parcel, as proposed, at present and approval of this request will allow one principal dwelling per legal lot. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulations submission requirements. 2. The request complies with Section 9-2 E. of the Subdivision Regulations as follows: - The 22.74 acres, more or less, under consideration will allow large lot residential uses which would be consistent with adjacent size lots. 830854 Board of County Commissioners March 1, 1983 Page 2 - The proposal was reviewed by the City of Longmont and was found to be adjacent to their Committed Service Area. - The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehensive Plan; therefore, the proposed use is consistent with efficient and orderly development. - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - Long's Peak Water Association has indicated adequate water service is available for this proposal. - The proposed lots are not part of a recorded exemption within the last five (5) years. - The two lots proposed will have adequate access from Weld County Road 1. The land immediately across County Line Road has been purchased by Hewlett Packard. The City of Longmont has agreed to zone it consistently with their needs for an industrial use, which in my opinion, will greatly change the character of the general neighbor- hood in the future. The four homes immediately south of the subject are on approxi- mately 14 acres, approximately 2/3 acre, approximately 12 acres, and approximately 1 acre and all are located in Weld County. A considerable amount of the neighborhood surrounding the subject is in small parcels. Most of these parcels have influence from Union Reservoir. Much of the land near the reservoir, while ideal for residential and acreage development, is not prime agricultural land. All of the land adjoining the subject to the City of Longmont is in the Longmont Prime Urbanized Area of Longmont. The City of Longmont has stressed they have no plans to cooperate with us in Weld County in the use of a large planned sewer, which is to be primarily financed by the Federal Government. The Longs Peak Water is on the property and one tap not in use is presently owned by us and available for connection as well as one Longmont City water tap. The Longmont City water tap is also owned by us and available for connection. Due to the above factors I believe the primary use as an irrigated farm is outdated and in the past. Please be advised that Union Reservoir Company is opposed to the approval of the proposed recorded exemption. Union Reservoir Company finds the septic type sewer system unac- ceptable since effluent may drain into the reservoir because the natural slope of the land is towards the reservoir. The Company does realize that in the past it has not opposed the septic sewer systems , but the Company has recently had to take a stand to oppose this type of system as more and more owners are dividing up their land and building houses around the reservoir. The Company has recently opposed the sewer system of Mountain Shores Subdivision, proposed for north of the reservoir, since it proposed to discharge treated effluent into the reservoir and there was the possibility of failure of the sewer system and untreated effluent might be discharged into the reservoir. The County acknowledged the concerns of Union Reservoir Company and Mountain Shores Subdivision was directed to plan a system whereby the effluent would be piped around Union Reservoir. If effluent is allowed to drain into the reservoir, the Company has been informed that the current recreation lessee of the reservoir will terminate the lease. The Company must take every appropriate step in order to keep the recreation lease, which is the major source of income for the Company. By allowing recreation use of Union Reservoir, the Company considers it is helping to meet the increasing demand for recrea- tion areas and feels the County should take a position consistent with the modern demands for facilities providing recreation. 830854 Weld County Department of Planning Services February 11 , 1983 Page 2 The Company would therefore request that this application for recorded exemption be denied. In the past the City has had no problem with recorded exemptions when related to a family farm situation. The applicants justification for the exemption only says that there are two buyers for the parcels - in essence the subdivision of land for two separate buyers. Currently, Hewlett-Packard is not scheduled to build until 1987. The major trunk sewer line (which is to be funded totally by the City and H-P with payback to the City as development occurs) is yet to be scheduled for construction - it is possible that it will not be needed for H-P' s first phase. Finally, when the City expanded its Committed Service Area, there was considerable input from Weld County residents - some wanted to be part of the City, some wanted nothing to do with the City and still others wanted the City's services without being part of the City. With this mixture of feeling, the City chose to draw its service area boundary at County Line Road. But planning is an ongoing process calling for future re-evaluations. At any point in time, each municipality has physical and fiscal limits to which it can commit its resources. Only over time can the boundaries of those limits be expanded.
